EXECUTIVE SUMMARY

Under the provisions of the Local Government Act, 1993, Councils are required (Sections 248 & 249) to fix Councillor and Mayoral Fees on an annual basis for the period 1st July to the subsequent 30th June following an appropriate determination by the Local Government Remuneration Tribunal.

Hurstville City Council is within the Category 1 - Metropolitan Centres and has generally paid the maximum allowance as determined by the Local Government Remuneration Tribunal.

At its meeting on 25 May 2011 Council resolved to pay the maximum fees payable.

REPORT DETAILS

Below is the report submitted to Council on 25 May 2011.

Under the provisions of the Local Government Act, 1993, Councils are required (Section 249) to fix the Mayoral Fee on an annual basis for the period 1st July to the subsequent 30th June following an appropriate determination by the Local Government Remuneration Tribunal.

The Local Government Remuneration Tribunal by decision dated 28th April, 2011 has determined that a 4.2% increase in allowances for Mayors and Councillors should be granted for the 2011/12 financial year.

Hurstville City Council is within the Category 1 - Metropolitan Centres and the minimum / maximum fees are as follows:

Councillors - $11,340 - $21,170
Mayor - $24,100 - $56,250 (in addition to the Councillor allowance)

"A Council may pay the Deputy Mayor (if there is one) a fee determined by the Council for such time as the Deputy Mayor acts in the office of the Mayor. The amount of the fee so paid must be deducted from the Mayor's annual fee."

EXECUTIVE SUMMARY

To elect the Mayor for the ensuing term. Section 290 (1) of the Local Government Act, in part, states the election of the Mayor by the Councillors is to be held:

1. if it is the first election after an ordinary election of Councillors - within 3 weeks after the ordinary election
2. if it is not that first election or an election to fill a casual vacancy - during the month of September.

PART 1 - PRELIMINARY

Returning Officer

1. The General Manager (or a person appointed by the General Manager) is the Returning Officer.

Nomination

2. (1) A Councillor may be nominated without notice for election as Mayor or Deputy Mayor.

(2) The nomination is to be made in writing by 2 or more Councillors (one of whom may be the nominee). The nomination is not valid unless the nominee has indicated consent to the nomination in writing.

(3) The nomination is to be delivered or sent to the Returning Officer.

(4) The Returning Officer is to announce the names of the nominees at the Council meeting at which the election is to be held.

Election

3. (1) If only one Councillor is nominated, that Councillor is elected.

PART 2 - ORDINARY BALLOT OR OPEN VOTING

Application of Part

4. This Part applies if the election proceeds by ordinary ballot or by open voting.

Marking of ballot-papers

5. (1) If the Election proceeds by ordinary ballot, the Returning Officer is to decide the manner in which votes are to be marked on the ballot-papers.

(2) The formality of a ballot-paper under this Part must be determined in accordance with clause 345 (1) (b) and (c) and (6) of this Regulation as if it were a ballot-paper referred to in that clause.

(3) An informal ballot-paper must be rejected at the count.

Count - 2 Candidates

6. (1) If there are only 2 candidates, the candidate with the higher number of votes is elected.

(2) If there are only 2 candidates and they are tied, the one elected is to be chosen by lot.

Count - 3 or more Candidates

7. (1) If there are 3 or more candidates, the one with the lowest number of votes is to be excluded.

(2) If 3 or more candidates then remain, a further vote is to be taken of those candidates and the one with the lowest number of votes from that further vote is to be excluded.

(3) If, after that, 3 or more candidates still remain, the procedure set out in subclause (2) is to be repeated until only 2 candidates remain.

(4) A further vote is to be taken of the 2 remaining candidates.

(5) Clause 6 of this Schedule then applies to the determination of the election as if the 2 remaining candidates had been the only candidates.

(6) If at any stage during a count under subclause (1) or (2), 2 or more candidates are tied on the lowest number of votes, the one to be excluded is to be chosen by lot.

Ordinary Ballot - Manner of Marking Votes on the Ballot Paper

Clause 5 (1) above, provides for the Returning Officer to decide the manner in which votes are to be marked on the ballot-papers.

Should there be more than one (1) candidate nominated, and the Council resolves to conduct the Election by Ordinary ballot (secret ballot), as Returning Officer, the manner in which the General Manager would require the votes to be marked on the ballot papers would be by the placing of a cross (x) against the name of the candidate for whom it is desired to vote.

A sample formal ballot paper would be -

That is, a cross (x) beside the name of the preferred candidate.

Use of letters of the alphabet or a tick would render the ballot paper informal, as would the use of numerals, including the number '1' standing alone.

Clause 345 (1) (b) (c) and (5) of the Local Government (General) Regulations, 2005, referred to under Clause 5 (2) of Schedule 7 - Marking of ballot-papers, is in the following terms:

Informal Ballot-papers

345. (1) A Ballot-paper of an elector at an election is informal if:

(b) it has not been initialled on the back by the Returning Officer or an electoral officer; or

(c) it contains a mark or writing which, in the Returning Officer's opinion, would enable the elector to be identified.

(5) Despite subclause (1), a ballot-paper of an elector at an election is not informal merely because it has not been initialled on the back by the returning officer or an electoral official, so long as it bears the mark referred to in clause 305 (2).

Clause 305 (2) states that every ballot-paper must contain a mark that has been determined by the Electoral Commissioner.

Withdrawal of Candidate's name from Nomination

Legal opinion is that a candidate cannot withdraw his/her name from nomination after the ballot has commenced. If a person is declared elected as a consequence of some procedure other than the one specified, the opinion is that the Election would be a nullity.


PART 3 - PREFERENTIAL BALLOT

Application of Part

8. This Part applies if the Election proceeds by preferential ballot.

Ballot-papers and voting

9. (1) The ballot-papers are to contain the names of all the candidates. The Councillors are to mark their votes by placing the numbers "1", "2" and so on against the various names so as to indicate the order of their preference for all the candidates.

(2) The formality of a ballot-paper under this Part is to be determined in accordance with clause 345(1)(b) and (c) and (5) of this Regulation as if it were a ballot-paper referred to in that clause.

(3) An informal ballot-paper must be rejected at the count.

"When a Mayor is elected by preferential ballot, preferences must be shown for all candidates for votes to be formal (See clause Clause 9 (1) above)."

Count

10. (1) If a candidate has an absolute majority of first preference votes, that candidate is elected.

(2) If not, the candidate with the lowest number of first preference votes is excluded and the votes on the unexhausted ballot-papers counted to him or her are transferred to the candidates with second preferences on those ballot-papers.

(3) A candidate who then has an absolute majority of votes is elected, but, if no candidate then has an absolute majority of votes, the process of excluding the candidate who has the lowest number of votes and counting each of his or her unexhausted ballot-papers to the candidates remaining in the election next in order of the voter's preference is repeated until one candidate has received an absolute majority of votes. The latter is elected.

(4) In this clause "absolute majority" in relation to votes means a number which is more than one-half of the number of formal unexhausted ballot-papers.

Tied Candidates

11. (1) If, on any count of votes, there are 2 candidates in, or remaining in, the election and the numbers of votes cast for 2 candidates are equal and the candidate whose name is first chosen by lot is taken to have received an absolute majority of votes and is therefore taken to be elected; or

(2) If, on any count of votes there are 3 or more candidates in, or remaining in, the election and the numbers of votes cast for 2 or more candidates are equal and those candidates are the ones with the lowest number of votes on the count of the votes - the candidate whose name is first chosen by lot is taken to have the lowest number of votes and is therefore excluded.

INFORMALITY

Clause 345 of the Local Government (General) Regulations, 2005, referred to under Clause 9(2) of Schedule 7 - Ballot-paper and Voting, provides as follows:

Informal Ballot-papers

345. (1) A ballot-paper of an elector at an Election is informal if:

(a) the elector has failed to record a vote on it in the manner directed on it; or

(b) it has not been initialled on the back by the Returning Officer or an electoral official; or

(c) it contains a mark or writing which, in the Returning Officer's opinion, would enable the elector to be identified.

(6) Despite subclause (1), a ballot-paper is not informal by virtue of the existence of an unnecessary mark on the ballot-paper if, in the opinion of the Returning Officer, the elector's intention is clearly indicated on the ballot-paper.

(7) Nothing in subclause (2) authorises any person to encourage a voter to place a tick or a cross in a square on a ballot paper.


PART 4 - GENERAL

Choosing by Lot

12. To choose a candidate by lot, the names of the candidates who have equal numbers of votes are written on similar slips of paper by the Returning Officer, the slips are folded by the Returning Officer so as to prevent the names being seen, the slips are mixed and one is drawn at random by the Returning Officer and the candidate whose name is on the drawn slip is chosen.

Result

13. The result of the election (including the name of the candidate elected as Mayor or Deputy Mayor) is:

(a) to be declared to the Councillors at the Council meeting at which the Election is held by the Returning Officer; and

(b) to be delivered or sent to the Director-General and to the Secretary of the Local Government and Shires Associations of New South Wales.

Scrutineers

Whilst there is no provision under the Act for Scrutineers, the General Manager would permit and appreciate the appointment of at least two (2) Members of Council as Scrutineers.

Nomination Form
Nomination forms for the election of Mayor have been previously distributed to Councillors. A nomination form is attached as an appendix to this report.

EXECUTIVE SUMMARY

To elect the Deputy Mayor for the ensuing term.

The Council in accordance with S231 (2) of the Act may appoint the Deputy Mayor for the same term as the Mayor or for a shorter period.


AUTHOR RECOMMENDATION

THAT the Council elect a Deputy Mayor for the ensuing term to September 2012.

FURTHER THAT, letters be forwarded to the CEO Division of Local Government and the Secretary of the Local Government and Shires Associations advising the appointment of the Deputy Mayor.


REPORT DETAILS

Section 231 of the Local Government Act, 1993, provides:

1. The Councillors may elect a person from among their number to be the Deputy Mayor.
2. The person may be elected for the mayoral term or a shorter term.
3. The Deputy Mayor may exercise any function of the Mayor at the request of the Mayor or if the Mayor is prevented by illness, absence or otherwise from exercising the function or if there is a casual vacancy in the office of Mayor.
4. The Councillors may elect a person from among their number to act as Deputy Mayor if the Deputy Mayor is prevented by illness, absence or otherwise from exercising a function under this Section, or if no Deputy Mayor has been elected.

The Local Government (General) Regulation 2005, Division 5 - Council Committees, provides:

(i) Council may establish Committees
Clause 260

"(1) A Council may, by resolution, establish such Committees as it considers necessary.

(2) A Committee is to consist of the Mayor and such other Councillors as are elected by the Councillors or appointed by the Council.

(3) The quorum for a meeting of a Committee is to be:

(a) such number of members as the Council decides; or

(b) if the Council has not decided a number, a majority of the members of the Committee."

In connection with voting at Council meetings, Clause 251 (5) of the Local Government (General) Regulation, 2005 provides as follows:
"(5) Voting at a council meeting, including voting in an election at such a meeting, is to be by open means (such as on the voices or by show of hands). However, the council may resolve that the voting in any election by councillors for mayor or deputy mayor is to be by secret ballot."

As can be seen from the above, any election for members of committees must be by open voting. This Clause applies to both this item and the item for "Election of Delegates".

Section 360 of the Local Government Act 1993 provides:

“(1) The regulations may make provision with respect to the conduct of meetings of Councils and Committees of Councils of which all the Members are Councillors.

(2) A Council may adopt a code of meeting practice that incorporates the regulations made for the purposes of this Section and supplements those regulations with provisions that are not inconsistent with them.

(3) A Council and a Committee of the Council of which all the Members are Councillors must conduct its meetings in accordance with the Code of Meeting Practice adopted by it.”

Note: Council has adopted a Code of Meeting Practice, amendments to which are made from time to time in accordance with the provisions of the Act.

EXECUTIVE SUMMARY

To review Council's meeting procedures for Council and Standing Committees.

It should be noted that if Council resolves to alter its meeting structure following a review of the Code of Meeting Practice at its meeting on 28 September 2011 a further report will need to be submitted to Council.

REPORT DETAILS

Whilst meeting procedure is, in the main, set out under the provisions of the Act and Regulations and the Code of Meeting Practice, it is desirable that Council annually review procedures fixed by Resolutions.

Outlined hereunder (Appendix "A") are the recommended procedures, together with previous policy resolutions which could also be reviewed. Some of these procedures are also outlined in Council's Code of Meeting Practice. Accordingly the above recommendation is now submitted for consideration.

THAT the procedures and policies for Council and Standing Committee Meetings as outlined in the report are confirmed.

EXECUTIVE SUMMARY

The purpose of the report is to confirm meeting dates for the remaining period in 2011 and to schedule meeting dates for the year ending December 2012. It should be noted that Council on 28 September will consider a new draft Code of Meeting Practice. If the new draft Code is adopted a further report will need to submitted to Council with a new list of meeting dates.

REPORT DETAILS

The purpose of the report is to confirm meeting dates for the remaining period in 2011 and to schedule meeting dates for the year ending December 2012 for Council, Standing Committees, Development Assessment Committee (DAC) and Workshop meetings in addition to a number of Community and Advisory Committees.

Meetings concerning work on the CBD MasterPlan and City Centre (Civic Precinct) redevelopment are normally considered at the Policy Planning & Environment and Master Plan Implementation Committee or at a Workshop following Standing Committees, as and when required.
