EXECUTIVE SUMMARY

Under the provisions of the Local Government Act, 1993, Councils are required (Sections 248 & 249) to fix Councillor and Mayoral Fees on an annual basis for the period 1st July to the subsequent 30th June following an appropriate determination by the Local Government Remuneration Tribunal.

Hurstville City Council is within the Category 1 - Metropolitan Centres and has generally paid the maximum allowance as determined by the Local Government Remuneration Tribunal.

At its meeting on 25 May 2011 Council resolved to pay the maximum fees payable.

REPORT DETAILS

Below is the report submitted to Council on 25 May 2011.

Under the provisions of the Local Government Act, 1993, Councils are required (Section 249) to fix the Mayoral Fee on an annual basis for the period 1st July to the subsequent 30th June following an appropriate determination by the Local Government Remuneration Tribunal.

The Local Government Remuneration Tribunal by decision dated 28th April, 2011 has determined that a 4.2% increase in allowances for Mayors and Councillors should be granted for the 2011/12 financial year.

Hurstville City Council is within the Category 1 - Metropolitan Centres and the minimum / maximum fees are as follows:

Council at previous meetings has resolved to adopt the maximum fee for allowances for the Mayor and Councillors as provided by the Local Government Remuneration Tribunal.

When setting the budget for 2011/12 an allowance was made for a potential increase in allowances. Should Council adopt the maximum fees allowable, as it has in previous years, there will be a slight deficit in the budget of $2,040 for the Councillors' Allowance and $650 for the Mayoral Allowance, making a total amount of $2,690 deficit in the budget. This deficit will be taken up at the September Quarterly Review should the maximum allowance be adopted by Council.

Having regard to the above, the Council now needs to make a decision on the level of the Allowances it will pay for the Mayor and Councillors to commence from 1st July, 2011.

In connection with the payment of a fee to the Deputy Mayor when acting as Mayor, Section 249(5) of the Act deals with this question and is in the following terms:

Therefore, if the Council desires to pay the Deputy Mayor a fee it would appear that it must determine the amount each time the Deputy Mayor acts in the office of the Mayor with any such fee being paid from the Mayoral fee unless a daily fee is struck by the Council.

EXECUTIVE SUMMARY

To elect the Mayor for the ensuing term. Section 290 (1) of the Local Government Act, in part, states the election of the Mayor by the Councillors is to be held:



AUTHOR RECOMMENDATION

THAT the Council elect a Mayor for the ensuing term to September 2012.

FURTHER THAT, letters be forwarded to the CEO Division of Local Government and the Secretary of the Local Government and Shires Associations advising the appointment of the Mayor.


REPORT DETAILS

S394 of the Local Government (General) Regulations 2005 - (Election of Mayor by Councillors) states that if a Mayor or Deputy Mayor is to be elected by the Councillors of an area, the election is to be in accordance with Schedule 7.

(2) If more than one Councillor is nominated, the Council is to resolve whether the Election is to proceed by preferential ballot, by ordinary ballot or by open voting.

(3) The Election is to be held at the Council meeting at which the Council resolves on the method of voting.

(4) In this clause:

"ballot" has its normal meaning of secret ballot;

"open voting" means voting by a show of hands or similar means. ( 2 ) Candidate 'A'

in required manner)
(2) Despite subclause (1), a ballot-paper of an elector at an election in which only one candidate is to be elected is not informal merely because a tick or a cross has been placed in one square and the other square has been left blank. In such a case the tick or the cross is to be treated as a first preference.

(3) Despite subclause (1), a ballot paper of an elector at an election is not informal merely because it does not show the minimum number of preferences required by the directions so long as it shows at least half of the minimum number of preferences required by the directions.

(4) Despite subclause (1), a ballot paper of an elector at an election is not informal merely because a preference (other than a first preference) has been repeated or omitted so long as the ballot paper shows at least half of the minimum number of preferences required by the directions.

(5) Despite subclause (1), a ballot paper of an elector at an election is not informal merely because it has not been initialled on the back by the Returning Officer or an electoral official, so long as it bears the mark referred to in clause 305(2).

REPORT DETAILS

Section 231 of the Local Government Act, 1993, provides:

The Mayor is a member of all Committees of Council, by virtue of Office.

Further, Council at its Extraordinary Meeting on 14th September, 2005 resolved to the effect:Accordingly, the Council now needs to determine whether it desires to continue its existing policy when appointing members to the above-mentioned Standing Committees.

As Members are aware Council has suggested an amendment to Council's meeting structure and should the proposed structure be adopted on 28 September 2011, the Development Assessment Committee will no longer exist, however the proposed new meeting structure will not commence until 1 November if adopted. As the current membership is Full Council, it is recommended that the Committee continues in its current form until the proposed structure is determined. Should the Council adopt the proposed new meeting structure, the Development Assessment Committee will be discontinued.

To confirm the functions of Committees.


REPORT DETAILS

The Local Government (General) Regulations 2005, made under the Act, provides:


261. A Council must specify the functions of each of its Committees when the Committee is established, but may from time to time amend those functions. Note: Section 355(b) of the Act provides (in part) that a function of a Council may, subject to Chapter 12, be exercised by a Committee of the Council."

In addition to the standing Committees of Council, Council has established functions for each of its Community and Advisory Committees and these will continue until amended from time to time by Council.

As Members are aware the Council at its meeting on 27 July 2011 resolved to adopt a draft Code of Meeting Practice which is currently on exhibition and will be reconsidered by Council on 28 September 2011. Should the draft Code be adopted the Development Assessment Committee will no longer exist after 31 October 2011. If the draft Code is not adopted the Development Assessment Committee will remain. In either case, the functions of the Committee need to be confirmed to cover both scenarios.

REPORT DETAILS

Section 360 of the Local Government Act 1993 provides:

Council last reviewed the Code of Meeting Practice at its meeting held on 27 July, 2011 (CCL128-11) were it was resolved to advertise a new draft Code of Meeting Practice given the proposal to alter Council's meeting structure. The new Draft Code is open for submissions until 16 September and a report will be submitted to Council on 28 September 2011. Having regard to this review no further action is required at this time.

To review Council's meeting procedures for Council and Standing Committees.

It should be noted that if Council resolves to alter its meeting structure following a review of the Code of Meeting Practice at its meeting on 28 September 2011 a further report will need to be submitted to Council.

THAT the procedures and policies for Council and Standing Committee Meetings as outlined in the report be confirmed.


REPORT DETAILS

Whilst meeting procedure is, in the main, set out under the provisions of the Act and Regulations and the Code of Meeting Practice, it is desirable that Council annually review procedures fixed by Resolutions.

Outlined hereunder (Appendix "A") are the recommended procedures, together with previous policy resolutions which could also be reviewed. Some of these procedures are also outlined in Council's Code of Meeting Practice. Accordingly the above recommendation is now submitted for consideration.

EXECUTIVE SUMMARY

The purpose of the report is to confirm meeting dates for the remaining period in 2011 and to schedule meeting dates for the year ending December 2012. It should be noted that Council on 28 September will consider a new draft Code of Meeting Practice. If the new draft Code is adopted a further report will need to submitted to Council with a new list of meeting dates.

THAT the dates for the meetings from October 2011 to December 2012 as outlined in the report be adopted.


REPORT DETAILS

The purpose of the report is to confirm meeting dates for the remaining period in 2011 and to schedule meeting dates for the year ending December 2012 for Council, Standing Committees, Development Assessment Committee (DAC) and Workshop meetings in addition to a number of Community and Advisory Committees.

Meetings concerning work on the CBD MasterPlan and City Centre (Civic Precinct) redevelopment are normally considered at the Policy Planning & Environment and Master Plan Implementation Committee or at a Workshop following Standing Committees, as and when required.

This report reflects the current and proposed status of the active committees and their meeting schedule.
