In accordance with the provisions of Part 1 of Chapter 4 of the Government Act, 1993 IT IS RECOMMENDED that the Committee resolve under the terms of Section 10A(2)(c) of the Local Government Act, 1993 that the press and the public be excluded from that part of the Finance Committee Meeting at which this matter relating to property in Hurstville House is considered for the reason that the matter relates to property transactions where disclosure of the information would confer a commercial advantage on a person with whom Council is conducting business which could be detrimental to Council's financial position in the matter and therefore not in the public interest. That in accordance with the provisions of Section 11(2) of the Local Government Act, 1993, the reports and correspondence relating to this matter be withheld from the press and the public.

03.06 SYDNEY PARALYMPIC ORGANISING COMMITTEE LIMITED - PARALYMPIC TORCH RELAY (C/00174)

Members will recall that His Worship the Mayor, Clr Sansom, announced in "Other Matters of Privilege" at the Council Meeting on 14th June, 2000, that Council's nomination of Ms Pauline English to carry the Paralympic Torch had been accepted.

Pauline has been a Council's Library staff member for twenty-three (23) years and is a former Paralympian who attended the 1972 and 1976 Paralympic Games as a swimmer and won six (6) Paralympic medals.

The following letter dated 13th June, 2000 addressed to His Worship the Mayor, Clr Sansom, has been received from the Sydney Paralympic Organising Committee Limited regarding this matter.

"The Sydney Paralympic Organising Committee is delighted to announce Pauline English as the successful nominee of your council, for a position in the MAA Sydney 2000 Paralympic Torch Relay.

This opportunity came about because of your Council's excellent support both financially through the Paralympic Patrons' Fund and creating awareness in your community about the Games.

Councils across New South Wales have responded warmly to the invitation to nominate a member of their community to take part in the Paralympic Torch Relay. Deserving members from more than 50 Local Government Areas will be carrying the torch during its New South Wales journey between 12-18 October 2000.

We will shortly be forwarding a press release with the biography of your successful torchbearer to our contact in your council. We will request their assistance to forward the press release and profile to your local media outlets. This will give due recognition to your torchbearer in your local area and also assist to further promote the Paralympic Games and the torch relay.

Thank you again for your council's involvement in the torchbearer process. We are pleased to have this opportunity to acknowledge the significant contribution made by your Council in preparing for this great International sporting event and have no doubt that for your nominee, the experience will be exciting and memorable."

03.07 ASA Conference 2000 - Beyond the Screen: Capturing Corporate and Social Memory, 17 - 19 August, 2000

The annual conference of the Australian Society of Archivist, Inc will be held in Melbourne. The keynote speakers are Professor Terry Cook, University of Manitoba, Canada and Elizabeth Hallam-Smith, Public Record Office, United Kingdom. The registration fee is $385.00. It is considered that it would be appropriate and beneficial for Council’s Archivist to attend the conference.

The Divisional Manager - Business & Financial Services has advised that no amounts have been expended to date from the 2000/01 Delegates' Expenses allocations of $60,000 and $40,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers. However, members will be aware that Council has already authorised attendance at conferences in the 2000/01 Financial Year and whilst expenditure has not been incurred in respect of these as yet any costs involved will be allocated against the 2000/01 Delegates’ Expenses allocations.

The following letter dated 22nd May 2000 has been received from Inverell Shire Council:-

“Re: North East Zone Country Public Libraries Association
Inequality between the States of the level of Recurrent Funding to Public Libraries

The recent CPLA North East Zone Meeting held at Port Macquarie on the 14th April 2000, resolved to seek the assistance of the Shires/Local Government Associations to exert pressure on the NSW Government to increase the per capitaa funding from the current $2 to at least that of Queensland’s $5 per capita. See attached comparative chart.

The North East Zone also seeks your support in this campaign and would be grateful if your zone could take similar action.

Thank you for your co-operation.”

The Inverell Shire Council, on behalf of the North East Zone Country Public Libraries Association, has asked Council to exert pressure on the New South Wales Government to increase the current per capita funding from $2 to at least that of Queensland’s $5 per capita.

The per capita finding for public libraries has remained static for a number of years, the major funding being given in the form of grants. Whilst grant funding is reasonable, it possibly could be time for the State Government to consider increasing per capita funding.

The following letters have been received from NSW.net:-

“Re: NSW.net Rollout

The purpose of this letter is to update member councils and non-member councils on the activities of NSW.net. As you may be aware he contract with UUNET (Ozemail) and Southmark Solutions for the provision of ISP services and network integration services to NSW.net ended on 31 May 2000. We are currently concluding a tendering process that will deliver to members a reliable high performance network with stringent Service Level Agreements covering network availability, network speed and Help Desk arrangements. We will advise you of the successful tenderer in June 2000.

The new network will be a totally managed service, meaning that the successful contractors will be responsible for the overall management of the network down to and including the router attaching your own LAN/WAN to NSW.net. Members will obtain a number of important benefits from this development, namely:

* an even higher level of assurance of continuity of service, and
* a streamlined billing capacity

A totally managed service will require the change of ownership of all connections in the network from the State Library of NSW to the successful tenderer. In light of this the number of connections being rolled out over the last two months has been scaled back a little in order to avoid duplicating the cost of installing ISDN tails. Even so, by June 30 2000 NSW.net will have connected an additional eighteen libraries/councils to the network, including two Regional Information Servers at Grafton and Griffith. Total membership of the network will be seventy-eight by this date. As we had planned to have an additional twenty libraries/councils connected by this date, we have only missed our target by three.

Our first priority under the new contract will be the connection of the remaining new members who have taken up our offer since November 1999. A detailed project plan will be drawn up and a timetable for connection will be established upon the announcement of the successful tender and distributed to all member and non-member councils. The timetable will be determined in part by clumping together adjacent connections to minimise travel costs etc., but experience has shown that availability of local infrastructure often determines timing of installation.

NSW.net is committed to bringing the benefit of the State Government’s additional funding to its members as speedily as possible.

Re: NSW.net Rebate

Thanks to additional funding from the NSW State Government, NSW.net has been able to offer Internet access for metropolitan councils at the low cost of $8,000 p.a. since 1 January 2000.

Currently you are paying UUNET (formerly Ozemail) $650 per month in ISP charges and $251 to Telstra for ISDN rental. In order to reduce your per annum cost to the promised $8,000 we will shortly transfer to your account via EFT, a rebate of $1406.

In future there will be no need for a rebate as NSW.net’s ISP will have the capacity to bill you directly for an amount totalling $4,000 per annum.

This rebate applies to all 64K connections. Additional bandwidth purchased form UUNET is not eligible for subsidy or rebate.

The following letter, dated 6th June, was received from the Metropolitan Public Libraries Association NSW:-

“I am writing to inform you about “LIBRARIES HOMECOMING” – an exciting advertising campaign for Sydney Public Libraries with far reaching benefits and impacts for Local Government, and to seek your support and comments.

In 1999 the Metropolitan Public Libraries Association (MPLA) commissioned a marketing consultant to devise an advertising campaign to promote Sydney Public Libraries and to realize our vision:

Public Libraries are universally valued by the community as the gateway to local and global information

The MPLA’s strong basic tenet is that:

Every local library is a community focus, a public space, and a gateway to the world’s information resources for all Australians.

We believe that this campaign initiative will bring very high public visibility and consequent increased use of public libraries leading to stronger political support and more funding from sources other than local councils.

The campaign called “LIBRARIES HOMECOMING” is planned for the week of 12 – 18 November, 2001. It will include a program of both literary and popular events in libraries across Sydney, direct mail advertising and a “Back of Buses” campaign. The slogan is:

“You never know who you’ll meet at your local library”

This slogan is designed to establish the feeling that everyone who is anyone is going to visit the local library during “LIBRARIES HOMECOMING”. The critical core of the campaign is the celebrity endorsement factor. It is proposed that an “army” of celebrities be recruited to support the cause of public libraries and encourage public literacy.

The target audiences for this campaign are State and Federal members of Parliament, groups of library users or potential users such as youth, and the wider community of New South Wales.

The campaign is to be funded in part by corporate sponsorship and in part by public libraries. A sponsorship brochure has been produced to elicit expressions of interest from prospective corporate sponsors.

03.11 OLYMPIC TORCH RELAY THROUGH HURSTVILLE (C/00103)

At the meeting of Council held on the 14th June, 2000 Clr S Nasser raised a question in relation to activities the Council could possibly undertake in association with the Olympic Torch Relay passing through Hurstville and it was advised that a report would be submitted to this meeting in this regard.

Members would be aware through recent media coverage from the Northern Territory and Queensland that there would appear to be a large attraction towards the Olympic Torch Relay and will no doubt become larger as the Torch Relay comes closer to Sydney and the commencement of the Games.

As advised to Council at its meeting on 2nd June, 1999, the Olympic Torch will be passing through Hurstville in the early hours of Tuesday, 12th September, 2000. The Olympic Torch route will not be publicised until approximately eight (8) weeks before.

In an effort to generate community involvement in the Olympic Torch Relay through the Hurstville City area, letters have been sent to local schools, churches, preschools, etc. indicating that the Torch Relay would be an opportunity for children of all ages to be involved in and create the possibility of staging activities even though it will be in a school holiday period.

There have also been initial discussions with Westfield who has always been a willing partner with Council in staging events in the community domain or at Centre stage within Westfield.

Unfortunately the Marketing Manager of Westfield has resigned and the new Marketing Manager only commenced duties on the 26th June.

In addition to the above, a community awareness programme will be conducted through advertisements, the Council Comment, Central and Branch Libraries, etc. and naturally Council will be working with the Leader newspaper when details of the route are made public. It has been indicated that a ten (10) minute comfort stop will be made in Hurstville during the relay and therefore this may create an additional opportunity to undertake some community activities or subsequent to the relay leaving Hurstville.

Members may recall that Council at its meeting on 4th August, 1999 voted funds to purchase Olympic banners for display throughout the City area from early August until late in 2000. The banners will be displayed on a number of Council's existing banner poles.

It was also proposed to install the banners on Energy Australia electricity light poles (ELPs) however as Energy Australia has denied Council the opportunity of installing banners themselves, although they will install banners for an installation charge, which for the number of ELPs that had been identified, would be extremely excessive ($10,880) and cannot be justified. The banners that would have been installed on ELPs will now be installed on other Council banner poles, within Council buildings, etc.

As indicated earlier, the Torch Relay and accompanying cavalcade of vehicles will only be travelling through Hurstville with a ten (10) minute comfort stop. There will be no opportunity for the Council to be involved in "lighting the cauldron" as seen on TV, as this only happens at the end of each day, nor to undertake any major celebrations or activities that may have been undertaken at overnight stops and being heavily promoted through the media.

The Events and Protocol Officer and Manager - Corporate Services, along with other selected staff, have yet to be informed by SOCOG what the "comfort stop" may involve and whether any sponsors of the Olympics will be in attendance.

Although this is not to say that we will not carry out any activities but as SOCOG have yet to advise Council of the route and whether they have planned any activities for the comfort stop and as Westfields has only recently employed a new Marketing Manager, it has been difficult to confirm activities that are in the planning stages.

When further information has been obtained concerning the "comfort stop" and following discussions with the new Marketing Manager of Westfield Hurstville and SOCOG representatives, and when activities have been confirmed, a further report will be submitted to the Council.

In accordance with the provisions of Part 1 of Chapter 4 of the Government Act, 1993 IT IS RECOMMENDED that the Committee resolve under the terms of Section 10A(2)(g) of the Local Government Act, 1993 that the press and public be excluded from that part of the Finance Committee Meeting at which this matter relating to advice concerning valuation services is considered for the reason that disclosure of the information would be detrimental to Council's position in the matter and therefore not in the public interest. That in accordance with the provisions of Section 11(2) of the Local Government Act, 1993, the reports and correspondence relating to this matter be withheld from the press and the public.

The following letter dated 7th June, 2000 addressed to His Worship the Mayor, Clr Sansom, has been received from Shopfront Theatre for Young People Co-Op Ltd requesting Council to contribute towards repairs of two (2) of the main rehearsal spaces and a termite problem.

"I'm writing to you on behalf of Shopfront Theatre for Young People. As you know we are based in Carlton and are one of Australia's leading youth theatres. We work with young people between the ages 8 and 25 and give them skills in acting, directing, film, lighting, sound, stage management and design. We are soon to be 25 yrs old as a company, and are very lucky because in the early days of the company the community raised the funds to buy the building. This is sometimes a blessing in disguise, as we now have to raise the funds to maintain it.

We are in the process of repairing two of our main rehearsal spaces and have discovered that the building is riddled with termites. This is a disaster, as it will add at least another $4,000 onto the cost of the repairs. We have already secured funding from the Ministry of the Arts to pay half of the initial repairs, but we still need to raise $7000 to cover the rest of the repairs, let alone the termites issue. In total we now need to secure an additional $11,000 funding.

We are approaching all the local councils to see if they can contribute to this unforeseen financial situation. We must get rid of the termites now, as they are in our foundations and we don't want the building to crumble around our ears - let alone have a young person falling through the floor boards in a workshop!

I hope that Hurstville Council are able to help us in some way. We have enjoyed a fantastic working relationship with the council in the past on projects such as Millennium and Ambush, and expect to do so in the future.

We look forward to hearing from you."

As indicated in the above letter the Theatre is attempting to secure additional funding of $11,000 to cover the cost of repairs ($7,000) and the cost of a termite problem ($4,000). The building is located in the Rockdale Council area.

This matter was referred to the Divisional Manager - Business & Financial Services who has commented as follows.

"The funding requirements as specified in the correspondence would fall under a Section 356 contribution and funded accordingly from Program 1-014.

Currently this Sub-program is over-committed in the amount of $1,585 for the financial period 1999/2000.

Alternatively, Shopfront Theatre could apply for a grant in the 2000/2001 financial period pursuant to the Council's Community Grants Program.

Given the nature of the termite problem, the Shopfront Theatre should also be advised to review their building insurance cover to determine if there is any possibility of incorporating this aspect of the repairs into that policy and claim accordingly."

In view of the fact that provision has not been made within the Program Budget for financial assistance as requested and of the impending introduction of Council’s Community Grants Program the following recommendation is submitted for Council’s consideration.

Arrangements have been made for an Aboriginal flag to be purchased and for Elders of the Aboriginal community to present the flag to Council in privilege time (Item 3.[i]).

Dharawal Elders who will present the flag to Council are Mrs Iris Williams, Mrs Beryl Timbery-Beller, Gloria Ardler and Lola Ryan. The Elders have also been invited to attend dinner prior to the Council meeting.

It is proposed to table a program outlining the procedure to be followed for the presentation. The program will be distributed at the meeting.

His Worship the Mayor, Clr Sansom, has received an invitation from The Lamrock Committee of the St George Hospital to attend a pre-Olympic Evening at the new Research & Education Centre at the St George Hospital.

The pre-Olympic Evening will be held on Friday, 28th July, 2000 and commence at 7.00pm. Tickets are $25.00 per person which includes finger food and drinks. All proceeds from the evening will go to the St George Hospital.

As the pre-Olympic Evening is not being held until 28th July, 2000, any costs associated with this function could be met from the Delegates Expenses' allocation for the 2000/2001 financial year.

The Divisional Manager - Business & Financial Services has advised that no amounts have been expended to date from the 2000/2001 Delegates' Expenses allocations of $60,000 and $40,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers respectively.

03.18 ST GEORGE FAMILY NETWORK - CONTINUED USE OF BEVERLY HILLS EARLY CHILDHOOD CENTRE

Precis

The St George Family Network, which operates under the umbrella of the Hope for the Children Foundation Inc, has been granted free use of the Beverley Hills Early Childhood Centre by Council on an annual basis since it began utilising the premises in March 1998. Their continued use of these premises is subject to an annual review by Council. The last 12-month period agreed to by Council has concluded, and the following report is provided in accordance with Council’s requirement for an annual review as to their continued occupation of the Beverley Hills Early Childhood Centre.

Background

The St George Family Network is one of a number of such networks in NSW operated in accordance with the constitution and objectives of the Hope for the Children Foundation Inc, which is an initiative of Rotary. The St George Family Network is essentially a home visitation support service for stressed families in the St George region, especially those with new babies. Referrals to the services come from local early childhood centres, hospitals and medical practitioners. Families are assessed by the Network Coordinator, who then matches them with a volunteer who visits the family in the home. Previously, the Hope for the Children Foundation also occupied an office at the Beverley Hills Early Childhood Centre, but have relocated in the past 12 months.

Current Status of the St George Family Network

The Network employed a part-time coordinator in September 1999. During the period from September 1999 – February 2000, the Network received 37 referrals and has supported 19 families incorporating 49 children. As at February 2000, seven of these families were current clients. Referrals to the service have come from St George Hospital, local early childhood centres, Backstop Family Support Service, the Department of Community Services and local community health centres.

Referred families live in a variety of suburbs, including Beverley Hills, Kogarah Bay, Peakhurst, Arncliffe, Banksia, Bexley, Hurstville, Sans Souci, Penshurst, Turrella, Mortdale, Rockdale and Lugarno. The Network volunteers provide ongoing practical support to families, while Backstop Family Support provides crisis intervention and counselling support. A volunteer training program was successfully conducted in March / April this year, and attendance at monthly volunteer meetings is compulsory.

The Network expects referrals to continue to grow, doubling their client workload and volunteer base. They are focussing on access to the service for families from non-English speaking backgrounds, and are looking for Chinese speaking volunteers.

Financial Support and Accommodation

The core budget to operate the St George Family Network is estimated to be $80,000 per annum. The Network does not receive any government funding. During 1999, the Network raised $13,000 through fund-raising efforts, as well as receiving two one-off donations totalling $55,000.

The Network has written to Council expressing its gratitude for Council’s generous support in permitting use of the Beverley Hills Early Childhood Centre at no cost to the Network, and requesting that Council continue to provide this accommodation on a “rent-free” basis. The Network does not currently have the financial capacity to pay any rental to Council for the use of the Centre.

The Network also has written to Kogarah and Rockdale Councils seeking equivalent funding to the value of $15,000 each, to match Hurstville Council’s contribution by way of premises. The Network also has requested that Council consider the Network meeting half of the cost of capital works on maintenance of the premises, and in fact has contributed to the costs of maintenance on that basis during 1999. The Network pays for its own overheads, utilities and cleaning of the building.

The provision of accommodation to the St George Family Network by Council has contributed significantly to its ability to establish its operations and provide support services to families in the St George community. It is therefore recommended that Council consider authorising the continued free use of this centre by the St George Family Network for a further 12-month period.

03.20 FUNDING AGREEMENT - HOME & COMMUNITY CARE PROGRAM

Precis

Advice has been received from the NSW Ageing & Disability Department (ADD) regarding annual funding under the Home & Community Care (HACC) program for the 2000/2001 financial year. A Funding Agreement has been issued for Council’s execution under the Common Seal.

Funding Advice

Advice has been received from ADD regarding annual funding to be provided to Council under the HACC program for the 2000/2001 financial year, as follows:
Community Worker - Aged & Disability Services $15,860
These funds operate as a salary subsidy to Council’s Community Development Co-ordinator position, which has responsibility for aged and disability services issues.

ADD has formally advised that the amount determined under the funding agreement will be grossed up by 10% to all GST registered organisations. As such, Council must also submit a completed GST Invoices and Adjustment Notes statement that must be completed and forwarded along with the signed funding agreement.

Revisions to Funding Agreement

This Agreement has been revised by ADD and differs from previous Agreements signed by Council in that:

* a number of new arrangements have been implemented in order to ensure compliance with the GST;
* improved arrangements between the funding body and organisation have been determined regarding indemnity, events of default and ending the agreement;
* some terminology has been redrafted to ensure greater consistency.

Provision of funding by ADD is conditional upon Council’s signing of, and compliance with the Funding Agreement, which requires Council to operate its services in accordance with the terms and conditions of that Agreement

03.21A PRIVACY AND PERSONAL INFORMATION PROTECTION ACT 1998 - MANAGEMENT PLAN AND PRIVACY CODE OF PRACTICE

As Members may be aware, the State Government has introduced the Privacy and Personal Information Protection Act 1998 to deal with the manner in which the Government and various government agencies, including Local Government, collates and deals with personal information so as to minimise the misuse of that information with the operation of much of the Act due to commence on 1st July, 2000.

One of the provisions of this Act requires, in part, a Council to adopt a Privacy Management Plan by 1st July, 2000.

In view of the application of this requirement to local government in general, both the Department of Local Government and the Local Government Association in association with Privacy NSW, have formed a working party to prepare a Model Privacy Management Plan and Draft Privacy Code of Practice for local government with a view to these documents being finalised prior to 1st July, 2000.

Unfortunately recent discussions with the Local Government Association have indicated that despite extensive efforts, it is unlikely that the Model Privacy Management Plan will be completed prior to this date and therefore it will not be available for adoption by councils so as to meet the requirements of the Act in this regard.

Obviously it is important that local government approaches the provisions of this Act in a uniform and consistent manner and therefore it would be ideal for the Model Privacy Management Plan, with appropriate minor modifications to suit local requirements, to be utilised as a basis for a council adopting its own Privacy Management Plan.

In view of the above comments it is considered it would be appropriate for this Council to adopt the Model Privacy Management Plan to meet its requirements under the Act, however this cannot be done prior to 1st July, 2000.

This matter has been further discussed with the Legal Officer of the Local Government Association who has suggested that councils, where possible, could resolve to indicate their intention to adopt the Model Privacy Management Plan as their own Privacy Management Plan under the Act, with appropriate amendments, when such has been finalised by the working party, as an indication of its intentions to meet the requirements of the Act.

Accordingly it is suggested that Council should now resolve as suggested by the Association and once a Model Privacy Management Plan has been finalised by the working party and received by Council it will be submitted to Council as soon as possible with a view to its adoption with minor amendments as considered appropriate
