03.02 HURSTVILLE ENTERTAINMENT CENTRE

Note: - The Entertainment Centre Office has advised that there have been no negotiated charges for the use of Council's facilities since the last meeting of Council.
In addition, a schedule showing details of concessional rentals granted by Council from 1st July, 1999 to date for the Entertainment Centre facilities is attached as Appendix "B".

03.03 INTERNATIONAL COMMUNITY FELLOWSHIP - REQUEST FOR REDUCED CHARGES, SENIOR CITIZENS' CENTRE (H/00009)
(Report by Manager - Corporate Services, Mr W Park)The Council at its meeting on 14th July, 1999 considered a report in relation to a request from the International Community Fellowship (ICF) to continue to use the Senior Citizens' Centre at a reduced cost.
The Council subsequently resolved that the ICF continue to pay the existing rental fee for the use of the Senior Citizens' Centre on Sundays with a review of the charges being made in twelve months.
The report considered by Council is reproduced below.
"The following letter has been received from the International Community Fellowship requesting Council to maintain their existing rental fee for the use of the Senior Citizens' Centre on Sundays to conduct Church Services and Sunday School Programs.
'I understand that the Council is currently reviewing the rental arrangements of the Senior Citizens' Hall and wish to make the following request.
We use the Senior Citizens' Hall on Sunday to hold our community Sunday School program and Worship Service. While the growth is slow we feel that this is a very worthwhile work since we live in a day when there is virtually no moral or spiritual instruction given to our youth.
For our other community projects ICF also uses Gladwyn House for a ladies craft and conversational English class each Monday, and for our community youth work we use The Av Youth Facility each Friday of the year.
We are greatly indebted to the Hurstville Council for the use of the Senior Citizens' Hall. We would ask for your special consideration to keep the present rental cost because it is the same small core group that has to fund these projects. Further we hire these facilities on an annual basis which ensures continuous use of your facilities.'
International Community Fellowship currently pay $100 (Costs + 10%) for the use of the Senior Citizens' Centre on each Sunday. With increases over the past year and the review of the schedule of fees and charges for the year 1999/2000, the Entertainment Centre Officer advises that the normal costs to hire the Centre would be $180 whilst Costs + 10% would be $125.
Notwithstanding the nature of the booking and the worthwhile cause of conducting Sunday School programs and Church Services on a regular basis throughout the year, Council must ensure that its costs are met. To engage staff to clean the Centre before the Sunday services, particularly after a Saturday night function and to open and close the Centre before and after use, Council must pay the appropriate award rates of pay and therefore could not consider anything less than Costs + 10%.
As International Community Fellowship has utilised the Senior Citizens' Centre since June 1996 and prior to that the Kanyana Room for their services on the basis of Costs + 10%, the following recommendation is submitted for the Council's consideration."
The Entertainment Centre Officer advises that the Council's Costs + 10% are still approximately $125. The International Community Fellowship have had use of the Senior Citizens' Centre over the past twelve months on the basis of less than Council's Costs + 10%.
Council's fees for various facilities have not increased for the year 2000/2001 due to the implementation of the GST and also the competitive nature of surrounding facilities.
The current cost to hire the Senior Citizens' Centre on a Sunday is $184 + GST after 1st July, 2000.
Notwithstanding the above the Council must ensure that its costs are met and as the International Community Fellowship are receiving a substantial reduction in fees, the following recommendation is submitted for the Council's consideration.

(Report by Manager - Corporate Services, Mr W Park) RECOMMENDATIONTHAT the International Community Fellowship be advised that Council can no longer subsidise their use of the Senior Citizens' Centre on Sundays less than the Council's Costs + 10% and therefore from 1st July, 2000 the cost to hire the Centre will be $125. A further amount of $12.50 will also be payable to meet the Government's Goods & Services Tax (GST).
FURTHER, THAT the International Community Fellowship be advised that this fee will be reviewed annually.

03.04 NEW SOUTH WALES CENTENARY OF FEDERATION COMMITTEE HISTORY GRANTS

03.06 COUNTRY PUBLIC LIBRARIES ASSOCIATION OF NSW CONFERENCE 2000 - 18 JULY - 21 JULY
(Report by Manager - Library and Information Service, Mr L. Urane)The aim of this conference, which is being held at Cessnock, is Cultural Connection, libraries connecting communities. The speakers include Ramona Koval presenter of Radio National’s Books and Writing programme from the Australian Broadcasting Commission, Professor John Levett and Susan Locke of Electronic Strategic Projects Office of Information Technology. Registration cost is $357.50.
I would like to take John MacRitchie, the exchange Serials Librarian, to this conference as it would be his only chance to meet other Librarians, particularly those who work in similar environments to where he works. Fiona Gordon, who is currently in Scotland, has had a similar arrangement made for her.
The Divisional Manager - Business & Financial Services has advised that the amounts of $51,368.55 and $46,018.34 have been expended to date from the 1998/99 Delegates' Expenses allocation of $60,000 and $40,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers and therefore a total amount of $97,386.89 will be expended this year in respect of those conferences, seminars, etc., for which Council has already authorised attendance by Councillors and/or Senior Officers at previous meetings.

03.09 ST GEORGE EISTEDDFOD - REQUEST FOR REDUCED RENTAL FOR USE OF MARANA AUDITORIUM (H/00006)
(Report by Senior Administrative Officer, Mr L Mifsud)The following letter dated 23rd May, 2000 has been received from the St George Eisteddfod requesting a reduction in the rental for the use of the Marana Auditorium on Wednesday, 21st June, 2000.
“I write to confirm our booking of Hurstville Civic Centre for the morning of Wednesday, June 21, 9am to 1pm, for the running of the St George Eisteddfod Choral Verse Speaking Choirs.
We expect some seven hundred children to participate this year and would appreciate having the aluminium forms needed to arrange the choirs in tiers on the stage.
We would be grateful to have the use of the Civic Centre at the usual minimum rate and wish to thank Council for this assistance in support of our efforts on behalf of children.”
Council’s Entertainment Centre Officer has advised that the normal rent for the use of the Marana Auditorium as requested would be $550.00 and that Council’s Costs + 10% for this booking would be approximately $88.00.
The Council's policy in respect of matters such as this is reproduced, in part, hereunder.
"(a) For hire on Friday, Saturday, Sunday or Public Holidays by any organisation, the full hiring charges as fixed by Council from time to time be applied to such usage.
(b) For hiring on days other than Friday, Saturday, Sunday or Public Holidays by charitable, non-profit making local organisations located within the City, and schools within the Cities of Hurstville and Rockdale and Municipality of Kogarah, the amount charged be the actual cost to Council for wages and direct costs plus ten (10) per cent.
(c) For hirings at any time by profit making organisations, the full hiring charges as affixed by Council from time to time be applied to such usage."Council’s policy also allows for the Marana Auditorium to be made available to the St George Eisteddfod for its Dance Eisteddfod on the basis of a charge at Council’s Costs + 10%.
It is noted that this request is for the Choral Verse Speaking Choirs and not the Dance Eisteddfod and is therefore not covered in Council’s policy. However, as the St George Eisteddfod is a non-profit voluntary organization and due to the worthwhile nature of this request, Council may wish to provide the Marana Auditorium as requested, for a fee of Council’s Costs + 10%.
Also, Council at its meeting on 29th September, 1999 considered a similar request from the St George District Eisteddfod for the staging of this event in 1999. Council subsequently resolved as follows.
“THAT the Marana Auditorium be made available on Wednesday, 15th September, 1999 to the St George District Eisteddfod for its Choral Verse School Choirs Eisteddfod on the basis of a charge of Council’s Costs + 10%.
Accordingly the following recommendation is submitted for Council’s consideration.

03.10 INSTITUTE OF MUNICIPAL MANAGEMENT, NSW DIVISION - 2000 ANNUAL CONFERENCE (P/00260)
(Report by Senior Administrative Officer, Mr L Mifsud)An Advance Notice has been received from the Institute of Municipal Management, NSW Division, advising that the 2000 Annual Conference will be held at the Novotel Opal Cove Resort, Coffs Harbour from Wednesday, 2nd August to Friday, 4th August, 2000.
Information from the Advice Notice regarding the Conference is as follows.
“The NSW Division of the Institute of Municipal Management is pleased to join with Coffs Harbour City Council to provide the Division’s 2000 Annual Conference at the Novotel Opal Cove Resort from 2nd - 5th August, 2000.
This is the first time that the Annual Conference has been held outside the Sydney Metropolitan area and the Coffs Harbour venue will provide a “Wild and Native” ambience for delegates to explore the challenges they face in “Management 2000”.
This year, also for the first time the Conference sessions will be provided over 2 full days with the Conference being moved to the latter part of the week.
The 2000 Conference will address current management issues for the new millennium and will include sessions on Knowledge Management, Customer Service, IT for The Future of Local Government, Working with GST, International Trends, Legal Pot Pourri, The Future of Local Government Management and Performance. The popular Concurrent Sessions will feature on both days of the Conference and the conference will conclude with a high profile moderated panel session.
The AGM will be held in conjunction with the Conference and it holds added interest for members as this year features the Divisional Council election nominations.
Keynote speakers for the Conference include Chris Koch, Allan Pease, Peter Couchman and a high profile Olympic gold medallist. Respected industry speakers will also be featured at the Conference.
An excellent social program is being arranged in conjunction with Coffs Harbour City Council which will include a Welcoming Function, Happy Hours, Conference Dinner, the Sanderson Dinner, a Saturday sports Day and a program to meet partners needs.
The 2000 “The Sydney Morning Herald”/IMM Management Excellence Awards will again feature at the Annual Dinner on the Thursday night of the Conference.
The Institute’s Annual Conference provides an excellent opportunity for delegates to be both enlightened and entertained; and the social program has been developed to facilitate networking opportunities for delegates and partners.”
There are different Conference packages available commencing from $852.50 for Members and $1,034.00 for non-Members. These prices include registration costs, two (2) nights’ accommodation and breakfasts, Welcome Function and Annual Dinner. Other Conference packages are available involving three (3) and four (4) nights’ accommodation and there are also corporate, partner and daily packages available.
The Advance Notice outlining the details and costs for the Conference has been included in “Matters Submitted for the Information of Members” _ See Item A(i)(a).
The Institute has advised that a more detailed Conference brochure incorporating the full program will be available in mid-June, 2000.
As this Conference will be held in August 2000, any costs associated with the Conference will be expended from the 2000/2001 Delegates’ Expenses allocation.
The Divisional Manager - Business & Financial Services has advised that no amounts have been expended to date from the 2000/2001 Delegates' Expenses allocations of $60,000 and $40,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers respectively.
As indicated above this is the first time this Conference has been held outside the Sydney metropolitan area with Conferences being held at the Sydney Convention and Exhibition Centre, Darling Harbour in recent years.
This Conference is usually very informative and important and therefore the following recommendation is submitted for Council’s consideration.

. Recommendation INSTITUTE OF MUNICIPAL MANAGEMENT, NSW DIVISION - 2000 ANNUAL CONFERENCE (P/00260)
(Report by Senior Administrative Officer, Mr L Mifsud) RECOMMENDATIONTHAT any interested Councillors, the General Manager and relevant staff, approved by the General Manager, be permitted to attend the 2000 Annual Conference of the Institute of Municipal Management, NSW Division, being held at Coffs Harbour from 2nd to 5th August, 2000.

(Report by Administrative Officer, Mr T Hopwood)The following letter dated 29th May, 2000 has been received from the Local Government & Shires Associations of NSW regarding the holding of various workshops associated with the Councillor Professional Development Program.
“The Associations are very pleased to advise that the Councillor Professional Development Program for the July-December 2000 period has been launched.
The new program includes thirteen half and full day modules which will be presented at metropolitan and non-metropolitan centres. Due to the interest shown by councillors, the CPDP also includes the new module “Development Approvals - The Heritage Perspective” which will be presented by David Logan of Godden Mackay Logan and explores a range of heritage and development planning issues of interest to councillors.
Copies of the new program are enclosed in this week’s bulk mail. Could you please distribute them to each councillor and senior staff member, and encourage them to attend relevant workshops.

The workshops will be held from July to December 2000 at various locations throughout New South Wales with a number of workshops being held in Sydney and also in metropolitan Sydney.
Registration fees are $245.00 per person for each one-day workshop and $165.00 per person for each half-day workshop. The fees include a comprehensive manual for each participate, certificate of attendance, morning tea, a light lunch or supper and afternoon tea in some cases.
The Divisional Manager - Business & Financial Services has advised that no amounts have been expended to date from the 2000/2001 Delegates' Expenses allocations of $60,000 and $40,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers.
These workshops may be of interest to Councillors and senior staff and accordingly the following recommendation is submitted for Council’s consideration.

The Divisional Manager - Business & Financial Services has advised that amounts of $51,368.55 and $46,018.34 have been expended to date from the 1999/00 Delegates' Expenses allocations of $60,000 and $40,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers respectively and therefore a total amount of $97,386.89 will be expended this year in respect of those conferences, seminars, etc., for which Council has already authorised attendance by Councillors and/or Senior Officers at previous meetings.
In view of the nature of the themes and the location of the seminar in Sydney, this seminar may be of interest to Councillors and staff.

As will be recalled the Divisional Manager - Engineering has previously indicated that the Staff Establishment lists shown above in respect of the Outdoor Workers are broken into some broad categories and should not be taken as being precise with only the total number of Outdoor staff being a precise figure.
It has also been indicated previously that on a daily basis changes are made to a number of positions as a result of plant breakdowns, sick leave, annual leave, etc., with this being an ongoing process but with total Outdoor staff remaining constant.

03.16 LOCAL GOVERNMENT & SHIRES ASSOCIATIONS OF NSW - STATE ASSEMBLY OF LOCAL GOVERNMENT
(Report by Senior Administrative Officer, Mr L Mifsud)The following item appeared within a recent edition of the Weekly Circular from the Local Government & Shires Associations of NSW regarding the State Assembly of Local Government to be held in Sydney on Monday, 24th and Tuesday, 25th July, 2000.
“The State Assembly of Local Government will be held on 24 and 25 July 2000, at the Wentworth Hotel, Sydney. The Assembly will consider proposals to arrest problems of Sydney’s growth and encourage balanced development in country NSW.
Following the 1999 State Assembly, a Whole of State Development Task Force was set up to consider the problems caused by unprecedented growth in Sydney and propose solutions which would encourage balanced development in country NSW.
A challenging group of speakers has been invited to address the gathering on day one including NSW Premier Bob Carr, Mark Latham MP, Head of the European Union Delegation in Australia, Aneurin Hughes, Minister for Small Business Sandra Nori, Director-General of the Department of State and Regional Development Loftus Harris and Australian Business representative Narelle Kennedy.
NSW mayors and council staff have also been invited to make presentations.
The focus of the second day will be the presentation of the Whole of State Development Task Force Report, followed by extensive discussion, consideration of motions arising from the report, and an Assembly communiqué which will encapsulate the action agenda to be taken forward as a result of the Assembly.
This unique event has been arranged to analyse Sydney’s growth problems with the aim of limiting that growth through balanced economic development in country NSW.
Councils from across the state are strongly encouraged to take part.
An information package comprising details about speakers, registration forms, and accommodation bookings, will soon be sent to councils.

The Associations have advised that the registration costs for the State Assembly will not be finalised until mid-June 2000. As a guide, the registration cost per person for last year’s State Assembly was $375.00 which did not include the Goods and Services Tax.
As the State Assembly will be held in July 2000, any costs associated with the Assembly will be expended from the 2000/2001 Delegates Expenses’ allocation.

03.17 AMENDMENT TO COUNCIL'S POLICY ON CIVIC OFFICE EXPENSES AND FACILITIESMembers will recall that at the meeting of Council held on 12th April, 2000, the Council adopted a recommendation from the meeting of the Policy Review, Forward Planning & Staff Committee held on 29th March, 2000 in relation to Council’s Sister City relationships, with part of that recommendation providing for Council advertising its intention to amend its Policy on Civic Office Expenses and Facilities to incorporate provisions in connection meeting some of the expenses of nominated Councillors participating in a Sister City exchange.
In accordance with Council’s resolution, appropriate amendments were made to Council’s policy in this regard and were advertising for a period of twenty-eight (28) days from Tuesday, 2nd May, 2000 to Wednesday, 31st May, 2000.
During and subsequent to this period of advertisement, no submissions have been received in respect of Council’s proposal to amend the Policy to incorporate provisions in relation to participation by Councillors in Sister City exchange programmes.
A copy of the Council’s Policy on Civic Office Expenses and Facilities, incorporating appropriate amendments to give effect to the terms of Council’s resolution in relation to this matter, is attached as Appendix “D” to this report, it being noted that the suggested amendments are shown in italics as Item 2 of the Section dealing with expenses within the Policy.
In view of the Council’s previous resolution in this regard and as no submissions have been received to the proposed amendment to the Policy, the following recommendation is now submitted for Council’s consideration.

03.18 RIVERWOOD COMMUNITY CENTRE (INC) - REQUEST FOR FINANCIAL ASSISTANCE - RIVERWOOD COMMUNITY FESTIVAL (F/00036)
(Report by Administrative Officer, Mr T Hopwood)The following letter addressed to His Worship the Mayor, Clr Sansom, dated 25th May, 2000 has been received from Riverwood Community Centre Inc requesting financial assistance from Council towards the 2000 Riverwood Community Festival which will be held on Saturday, 21st October, 2000.
“Once again Riverwood Community Centre is seeking the help of local businesses and Service Clubs. This is to raise much-needed funds for services, which are highly needed in Riverwood and surrounding areas. Large proportions of the local community are financially disadvantaged and rely upon services, which the Centre provides.
Our fundraising activity takes place at the Riverwood Community Festival as an annual celebration. It is supported by local organizations and Service Clubs.
We are seeking your support by donating a sum of $1000.00 to go towards hiring one of the rides to be provided on the day of the Festival.
All donations will be acknowledged in the Festival Program.
If you request any further information please contact me on 9584 2811. Thanking you.”
No provision has been made in the 1999/2000 or 2000/2001 Adopted Program Budgets for a specific donation as requested.
In regard to previous Festivals, Council has assisted by way of providing barricades, rubbish bins, etc., however a request in this regard has now been received for this year’s Festival.
Also, with regard to last year’s Festival, Council at its meeting on 23rd June, 1999 gave consideration to a request from Riverwood Community Centre (Inc) for financial assistance towards the 1999 Festival and resolved as follows.
“THAT Council make a donation of $500.00 to the Riverwood Community Centre (Inc) under the provisions of Section 356 of the Local Government Act 1993, to be used towards the cost of operating the 1999 Riverwood Community Festival being held on Saturday, 23rd October, 1999.
FURTHER, THAT the Rotary Club of Riverwood be advised of Council’s action.”
This matter was referred to the Divisional Manager - Business & Financial Services who has commented as follows.
”The contribution sought of $1000 would fall under Section 356 funding and in this regard would be covered by Hurstville City Council's 1999/2000 Sub-Program 1-014.
Currently this Sub-Program is over-committed in the amount of $1,585.
Alternatively, the Riverwood Community Centre (Inc) could apply for a Grant in the 2000/2001 financial period pursuant to the Council's Community Grants Program."

I know this is early warning, however we do invite you and your friends to this excellent evening’s entertainment and suggest that note the date in your diary and that you book a table (or two).
We would love to see you on October 13.”
The Gala Concert Night will be held on Friday, 13th October, 2000 at the Riverwood Legion and Community Club, Littleton Street, Riverwood. Tickets are at a cost of $10.00 each and tables of 16 persons are available for early booking.
As the Gala Concert is not being held until October 13, 2000, the cost involved could be met from the Delegates Expenses’ allocation for the 2000/2001 financial year.
The Divisional Manager - Business & Financial Services has advised that no amounts have been expended to date from the 1999/00 Delegates' Expenses allocations of $60,000 and $40,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers respectively.

03.20 BACKSTOP FAMILY SUPPORT SERVICE INC. - REQUEST FOR FINANCIAL SUPPORT

The St George Backstop Family Support Service Inc. (Backstop) has been housed in premises owned by Rockdale City Council since its inception in 1987. Rockdale Council has recently advised Backstop that its premises at Brighton have been sold and the service must vacate the premises by 16 June 2000. Rockdale Council and the NSW Department of Community Services have each agreed to contribute $30,000 towards the purchase of a suitable house for Backstop. The following report is provided in response to a written request to Council from Backstop seeking a financial contribution and possible in-kind support towards their purchase and maintenance of accommodation.
Background
Backstop provides the only Family Support Service of its kind in the St George region. It is funded by the NSW Department of Community Services, and since its inception in 1987 Rockdale Council made a commitment to provide accommodation for the service. Initially in shared premises, the service expanded and in 1991 moved into a Rockdale Council owned house in Princess Street, Brighton on the understanding that Rockdale Council would provide a more permanent space for Backstop in a new high rise commercial / residential development located in Moate Avenue, Brighton-Le-Sands. Unfortunately the space that was eventually offered to Backstop was on the third (3rd) floor, and in their view inappropriate for families with children. The outdoor area they had requested for child care and children’s play was given instead to another group, and Backstop finally concluded that they could not safely and effectively operate their service from the premises offered by Rockdale Council in the Moate Avenue development.
Services Provided by Backstop
The Backstop Family Support Service has operated from two centres, one at Brighton-Le-Sands, and the other as an outreach service based at Georges River Community Services at Mortdale. Backstop is an independent community based service providing support to parents of children aged 0-5 years living in the St George Area. Support is provided in the following areas:
* Family conflict
* Child protection
* Domestic violence
* Trauma, grief and loss
* Homelessness
* Physical or mental health
* Poverty
* Physical or sexual assault
Priority is given to families in greater need due to financial disadvantage; social isolation; ethnicity/race/culture; gender; sexuality
The service operates in three ways :
1. Workers can visit people at their homes
2. Families can visit one of the two centres the service operates. The centres offer activities for children as well as parents. They provide a meeting place for support, relaxation, programmes and discussion groups.
3. Connect families with other professionals and community organisations as required.
Accommodation Options Investigated
No suitable accommodation was owned by any of the St George councils or available for lease to Backstop. Nor did the Department of Housing have any available accommodation, due to the extensive waiting list (8 years) for accommodation in the St George region. Backstop therefore investigated the option of purchase of a suitable property so as to establish secure, safe and appropriate premises for the long-term future of the service.
Following negotiations with Rockdale Council and the Department of Community Services, Rockdale Council agreed to contribute $30,000 towards such a purchase, and the Department of Community Services has approved the use of $30,000 of Backstop’s recurrent funding, accumulated during 1999 through salary savings made from a vacant Family Worker position. Backstop also has applied to Kogarah Council for a maximum $5,000 grant under its Community Grants Program. This was the only option made available for funding from Kogarah Council.
On investigating the private rental and housing purchase markets, Backstop was advised that, for an additional $100 per week over and above an average rental, they could repay a mortgage and thus provide long-term security for the service and its families. Backstop secured loan approval from Bendigo Bank, a community bank that works in conjunction with the Ethical Investment Trust in Victoria.
The Manager – Community Services also made preliminary investigations in regard to the option of Backstop sharing the premises at the (previous) Beverly Hills Early Childhood Centre on a short-term basis with the St George Family Network. The Network was willing to try to accommodate staff from Backstop, but the available space meant that the services that could be provided by Backstop would be considerably less than optimal.
Current Position
Backstop initially wrote to the Mayor in March 2000 seeking financial support from Hurstville Council, and members of the Backstop Management Committee and staff met with the Mayor and relevant Council officers on 27 March 2000 to discuss Backstop’s circumstances and request for assistance. At that time Backstop had not been given notice to vacate their Brighton premises. Since that meeting Backstop’s predicament has worsened, having received advice that they have to vacate their premises by 16 June 2000. Backstop’s situation became more urgent and, as of 25 May, Backstop had accepted the offer from Rockdale Council of premises located in the Bexley Rest Centre, which had been temporarily closed.
Backstop again wrote to Council on 24 May 2000, stating:
"Since we met with the Mayor, Councillor Philip Sansom, Rockdale City Council has given approval for us to locate anywhere within the St George area. We are particularly interested in residing within the Hurstville City Council (HCC) Local Government Area (LGA) because the conditions for gaining approval for Development Applications seem more flexible than those of Rockdale City Council.
We have approval from Bendigo Bank to secure a mortgage. A condition of the mortgage is that it has to be a residential property.
We are now considering purchasing a property and we are currently interested in premises situated in Beverly Hills.
At this stage we are hesitant to make an offer on this property due to the uncertainty of zoning and because we need to feel more secure about the amount of money we can contribute towards the purchase price.
We have been offered temporary use of a property owned by Rockdale City Council on Forest Road Bexley. Ideally we would like to be in a situation that only involves one move. The Beverly Hills property is vacant and it may be possible to rent the premises until the usual contracts of sale transpire and clarifications about the Development Applications are made.
To give us added security we would like to request that Hurstville City Council give consideration to a combination of the following:
* making a contribution of at least $15,000 to help us with the purchase of premises within the St George area;
* allow backstop rate rebates if we reside within HCC LGA;
* provide us with a commitment for the ongoing maintenance of premises if we purchase property in HCC LGA;
* help with minor modifications to the property if we purchase in the area."
Support Requested from Council
As noted in Backstop’s letter, they are seeking both a grant of $15,000 towards the purchase of a house in the St George region, with a preference for the Hurstville LGA; rate rebates and assistance with maintenance costs if they purchase a property in the Hurstville LGA; and assistance with minor modifications to the property if required, if the property is located in Hurstville.
Whilst Backstop knows it can safely commit to a mortgage with the funds available from Rockdale Council and the Department of Community Services, if they could secure a larger deposit through additional funds from Hurstville Council then they will be able to reduce their mortgage repayments and thereby release increased Family Worker hours to directly support families under stress and in crisis.
Funding Options Available
No funds have been set aside for the Backstop Family Support Service in either the current Program Budget or the 2000/01 Program Budget. In addition, as Members would be aware, Council has recently adopted Policy Guidelines for a Community Grants Program to be implemented in the 2000/01 financial year, which is about to be advertised. Backstop will be advised to submit an application under this program. They may be eligible for a grant under the Financial Subsidies category, which is identified to assist in ensuring the viability of a priority service to the community.
It is not in dispute that Backstop is a priority community service, and provides services identified in Council’s recent Social Plans and community consultations as an area of increasing demand and need. Under the Community Grants policy guidelines, Backstop would be eligible to apply for either a small (under $5,500) or larger grant (over $5,500). Their success in receiving approval for a grant would depend on the relative priority their service was given as compared to other applications received.
Should Council resolve to advise Backstop to apply for a grant under this program, then Backstop will not receive advice as to their success, nor receive any funds if successful, until the end of September 2000. There is no guarantee that they will be approved for receipt of a grant from Council, and it is unlikely that it would be in the order of $15,000.
Comments have been sought from the Divisional Manager – Business & Financial Services as to other sources of funds to meet Backstop’s requests, including the possible grant of a rate rebate, and assistance with minor maintenance works should they purchase in the Hurstville LGA.
Comments from the Divisional Manager – Business & Financial Services
“The funding requirements as specified in the submission can in fact be grouped for the purposes of assessment and comment. In this regard the contribution of $15,000 towards the acquisition cost as well as the ongoing maintenance and assistance with minor modifications to the property in question would all fall under a Section 356 contribution and funded accordingly from Program 1-014.
Currently this Sub Program is over committed in the amount of $1,585 for the financial period 1999/2000
As indicated in the report, Backstop could apply for a Grant in the 2000/2001 financial period pursuant to the Council’s Community Grants Program and this would in fact cover all the above items. As pointed out however there is no certainty of success in this process and timing appears to be an issue in relation to the funding proposal.
The issue of rate subsidies is a possibility which would need to be determined by Council having regard to the precedent which this may set in relation to other community based groups. Full or partial rebates would need to be considered. However, depending on the structure of the St. George Backstop Family Support Service Inc., there may be a GST issue in relation to such a subsidy as the provision of rate rebates would be defined as a taxable supply. I believe however that the provision of rate relief on its own may not be sufficient and based on the details provided, would need to be part of an overall package. Their ability to commit to the property in the first instance appears the key issue.
I have also been asked to comment on possible alternative funding sources and given the nature of the functions performed by the organisation in question a possibility exists to perhaps review funding from Program 4-004 being Community Development Services & Administration. In the current 1999/2000 financial period, this Program is estimated to be underspent in the amount of $10,500. However this is in the context of an overall Council Net expenditure deficit of $356,920 over the Adjusted Budget for this period.”
Comments from Divisional Manager – Community & Corporate Services
“The comments submitted by the Manager – Community Services and Divisional Manager – Business & Financial Services in association with this request are noted and need to be assessed by the Council when considering this request, particularly in the light of the many similar requests which the Council receives regularly from many worthwhile community organizations.
It is also noted that the funding by Council does not appear crucial to the quest for premises, as the $15,000 is requested to reduce loan repayments.
With regard to the request for the Council to maintain a property if purchased within Council’s area by the group this matter has been discussed with the Acting Divisional Manager – Engineering who has expressed some concerns in this regard and suggests that it may not be appropriate for Council to undertake this role.
Initially, if Council were to undertake this maintenance role it would essentially be carrying out “work on private property” in the terms of the Act which would need to be considered and authorised by Council on each occasion the work was to take place with subsequent details reported in Council’s Annual Report.
In addition, Council does not undertake maintenance of properties owned by any other service organization within the area and if it were to agree to this particular aspect of the request it is highly likely that this would set a precedent which would result in similar requests being received from other organizations. It is also unlikely that the issue of ongoing maintenance costs for a building purchased by Backstop would be covered as an eligible category under the Community Grants program.”

03.22 RECORDS MANAGEMENT ASSOCIATION 17TH NATIONAL CONVENTION - 3RD - 6TH DECEMBER, 2000
(Report by Manager - Corporate Services, Mr W Park)Advice has been received from the Records Management Association concerning early bird registrations for their 17th National Convention to be held in Sydney between 3rd and 6th December, 2000.
Attendance at Records Management Association Conventions has been at irregular intervals with the last attendances being in 1999, 1998 and 1994.
With the legislation of the new State Records Act 1998, (effective 1/1/99 and its transition requirements) the introduction in the not too distant future of imaging for records and currently the widespread use of electronic mail, the importance placed on the management of records has not been at a higher level.
Some of the topics to be discussed at this Convention include -
* Emergency Technology and Records Management;
* Record Keeping in the new e-conomy;
* Record Keeping and the Challenge of Globalisation;
* Bridging the Gap;
* Theory of Change Management;
* Where Does Records Management fit into Knowledge Management;
* Keynote addresses from -

. Regional Commissioner NSW, Australian Securities & Investment Commission
. Senior Consultant, Pricewaterhousecoopers.
All of the topics are pertinent to the future direction and management of records at Hurstville. There will be prominent international, national and local speakers addressing the theme "Bridging the Gap".
The Convention will be supplemented by a comprehensive trade exhibition showcasing the latest products and state of the art technology available in the Records Management industry.
The dynamics of technology, the culture of privatisation, accountability and access to information are forcing managers to develop new strategies to capture and retain corporate and intellectual knowledge of organisations.
The State Records Act 1998 acknowledges the technological advances made and is requiring all government authorities, including local government, to comply with improved record keeping practices and the attached accountability for public records.
In view of the integral nature of electronic record keeping and with the other technological advances Council has and will introduce in the future, Council at its meeting on 10th March, 1999 resolved to include the Records Management Association's Conventions into the key list of conferences approved by Council (Policy Committee 7th May, 1997).
Early bird registrations for members is $715.00 and $825 for non-members with an increase in registrations in both categories after the 30th June, 2000. Daily registrations are available at a cost of $275 per person prior to 30th June, 2000 with increases up to $330 after this date. The Convention Dinner is an additional cost. All prices include GST. The Senior Records Officer, Records Manager and Manager - Corporate Services are corporate members.
As the National Convention is not being held until December, 2000 the cost involved could be met from the Delegates Expenses’ allocation for the 2000/2001 financial year.
The Divisional Manager - Business & Financial Services has advised that no amounts have been expended to date from the 1999/00 Delegates' Expenses allocations of $60,000 and $40,000 for Councillors and Senior Officers respectively. 03.23 SSROC ANNUAL AWARDS PRESENTATION DINNERAs Members will be aware, SSROC has recently introduced an Annual Awards Programme within the Region in order to recognise and promote outstanding activities undertaken by member councils.
Submissions for the awards have recently closed and the following letter dated 1st June, 2000 has now been received from SSROC regarding an Awards Presentation Dinner.
"I write to formally advise that the inaugural SSROC awards presentation dinner will be held on Thursday evening, 17 August, 2000 at the Holiday Inn, Coogee.
I would be grateful if you would put this date in your Council's official diary, your own diary, and advise councillors and staff accordingly. In setting the dinner date, we took into account each Council's meeting schedule and known commitments, so I would appreciate you doing all you can to keep the date clear. I have advised all SSROC mayors of the date.
You will recall it has been agreed to recover the costs of the dinner by all councils purchasing a minimum number of tickets. I will be in touch shortly with costings and further details about the dinner.
Awards Nominations
I am delighted to report that we received 56 awards nominations in all. Every member council submitted at least one nomination, some as many as nine. A short summary of all projects will soon be posted on SSROC's website, so you'll be able to check out the competition in each award category. The web address is www.ssroc.com. Judging will take place in June and early July.
The awards program is shaping up to be a tremendous success, and I thank you for your support so far in encouraging staff and others to submit nominations. I have been really impressed with the diversity and quality of the projects submitted and the awards dinner will present an important opportunity to showcase the talent and innovation that clearly resides in our region."
It is considered that the annual awards are an excellent process to recognise the activities of councils within the region and Council should be represented at the Awards Presentation Dinner. It should be noted that Council has submitted a number of entries for the Awards.

03.26A DEPARTMENT OF COMMUNITY SERVICES - FUNDING FOR 2000/2001 FINANCIAL YEAR

Advice has been received from the Department of Community Services (DoCS) regarding annual funding for the 2000/2001 financial year. A Funding and Performance Agreement also has been issued for Council’s execution under the Common Seal.
Funding Advice
Advice has been received from DoCS regarding annual funding to be provided to Council for the 2000/2001 financial year, as follows:
Hurstville Occasional Care Centre $33,454
Penshurst Long Day Care Centre $31,734
Local Government Salary Subsidy – Community Worker $10,123
Local Government Salary Subsidy – Youth Worker $10,123
This represents an increase on 1999/2000 funding, based on CPI. Further indexation of these grants and an arrears payment for the current financial year will be made prior to June 30, and these increases will be incorporated into the base funding levels set out above, to be paid from 1 July 2000.
Funding & Performance Agreement
Provision of funding by DoCS is conditional upon Council’s signing of, and compliance with the Funding and Performance Agreement, which requires Council to operate its services in accordance with the terms and conditions of that Agreement. The Annual Service Plans setting out the objectives for each service for 2000/2001 also are attached to, and form part of the Agreement and are binding on the services and Council.
This Agreement has been revised by DoCS and differs from previous Agreements signed by Council, and the Manager – Community Services has two concerns about certain terms of the Agreement, as follows:
A. A Special Condition has been inserted requiring services to collect data appropriate to the service type on the religion of its clients.
It is recommended that Council respond to DoCS by advising that collection of data on religion is not appropriate to each of the services funded. All child care services collect data on country of birth and language/s spoken, and this data is collected by Council’s community development services as appropriate for individual projects undertaken. Data on religion is not seen as appropriate or relevant for any of these services. Whilst ethno-religious data is relevant and specified in the NSW Anti-Discrimination Act as grounds for discrimination, ‘religion’ of itself is not specified, and religion is not seen as an appropriate indicator of access and equity. In addition, many people would be offended by services seeking to record data about their religion, and very possibly would view that as discrimination.
Migrant Resource Centres do not collect data about religion, and are writing to the Minister to lodge a complaint about this requirement. It is recommended that Council cross out and initial this requirement on the Agreement, noting that collection of data on religion is not appropriate to the services funded by DoCS. A covering letter will explain Council’s reasons for this notation.
B. An additional clause 1.3 has been included in the Agreement as a contingency clause to deal with uncertainty about the administrative arrangements for the payment of GST and the funds that will be made available to DoCS.
This clause states:
1.3 Notwithstanding clause 1.2, DoCS can alter the total funding paid to you (rather than funding for a particular project) under this Agreement in a manner which is consistent with alterations to the funding available to DoCS for the respective programs. This alteration will be notified to you by letter and revised schedules will not be issued.
This clause is effectively a contradiction of the Agreement by DoCS to provide specified amounts of funding for an agreed Service Plan and set of performance indicators which are binding on Council.
Since DoCS issued the Agreements for execution by funded organisations, the Minister for Finance, Michael Egan, announced on 7 June that the NSW Treasury will “gross up” grants provided to human services by the full 10% to compensate for the GST payable on grants.
Clause 1.3 should more appropriately refer to the commitment by DoCS to gross up grants. However, if Council were to cross out this clause, it is most likely that DoCS would not agree to forward the grant monies subject to that Agreement on 1 July 2000. It is therefore recommended that Council make a note next to that clause, and refer to the covering letter to express Council’s disagreement and expectation that the grants will be grossed up by 10%, in accordance with the NSW Treasurer’s media announcement on 7 June 2000.
The Council of Social Service of New South Wales (NCOSS) is the peak agency representing the community and non-profit sector in NSW, and has been negotiating with Treasury in relation to grossing up of grants. NCOSS has advised community organisations funded by DoCS to sign and return the Agreements, and that DoCS will be issuing an additional set of clauses, via a letter, which will override the current clause 1.3 As soon as DoCS finalises the wording of the new GST clause.

03.27A THE GEORGES RIVER COMBINED COUNCILS COMMITTEE INC - REQUEST FOR CONTRIBUTION (R/00540)
(Report by Administrative Officer, Mr T Hopwood)Council has recently received a request from the Georges River Combined Councils Committee Inc. for Council to provide a contribution of $20,000 to the Riverkeeper Program for 2000.
As members would be aware, the Georges River Combined Councils Committee Inc. consists of Councillors from Bankstown, Campbelltown, Hurstville, Kogarah, Liverpool, Rockdale, Sutherland and Wollondilly Councils. Hurstville Council is heavily involved with the Committee with Council being represented by His Worship the Mayor, Councillor Sansom and Councillors Morris and Pickering. Council has previously provided substantial secretarial and administrative support when former Councillor John Griffin was the President of the Committee.
The Committee established the Riverkeeper Program in 1997 to try to create an informed and participating community in efforts to restore the Georges River to its former state. Hurstville Council, together with Bankstown, Kogarah, Rockdale and Sutherland Councils provided $20,000 each to the Program in 1997 to facilitate its establishment.
Council at its meeting held on 10th March, 1999, considered a similar request from the Georges River Combined Councils Committee Inc. for a contribution of $20,000 for the 1998/99 financial year. Council subsequently resolved as follows:
“THAT a contribution of $20,000 for 1999 be provided from the 1998/99 Adopted Program Budget to the Georges River Combined Committee Inc for the Riverkeeper Program under the provisions of Section 356(1) of the Local Government Act, 1993.”
The Committee, through the Riverkeeper Program, has raised the awareness of the Community to the Georges River and has achieved positive results for local residents and users of the Georges River.
Provision has been made in Council’s 1999/2000 Adopted Program Budget for a further contribution of $20,000 to the Riverkeeper Program. The Divisional Manager – Business & Financial Services has advised that the $20,000 allocation is still available in 1999/2000 Adopted Program Budget.
In view of the above details, the following recommendation is submitted for Council’s consideration.

CIVIC OFFICE EXPENSES
AND FACILITIES
INTRODUCTIONIn accordance with the provisions of Section 252 of the Local Government Act 1993 the Council is required to adopt a policy concerning the payment of expenses incurred by and the provision of facilities to the Mayor, Deputy Mayor and other Councillors in relation to their roles in discharging the functions of Civic Office.
LEGISLATIVE PROVISIONSSection 252(1) and (2) of the Local Government Act 1993 provides that a Council must adopt a policy concerning the payment of expenses incurred or to be incurred by, and the provision of facilities to, the Mayor, the Deputy Mayor (if there is one) and the other Councillors and the policy may provide for fees payable to be reduced by an amount representing the private benefit to the Mayor or a Councillor of a facility provided by the Council to the Mayor or Councillor.
In addition, Sections 253 and 254 of the Local Government At 1993 also provide that before adopting a policy for the payment of expenses or provision of facilities, the Council must give at least 28 days' public notice of the proposal and that the Council or a Council Committee all the members of which are Councillors must not close to the public that part of its meeting at which a policy for the payment of expenses or provision of facilities is adopted or at which any proposal concerning those matters is discussed or considered.
OBJECTIVESIn applying the provisions of the legislation to Hurstville City Council, it is considered that Council's policy should provide for the payment of appropriate expenses and the provision of the necessary facilities to ensure that:
1. The Mayor, as the first citizen of the Council's area, as the leader of the governing body of the Council and as the principal spokesperson on Council policy is provided with a standard and range of facilities appropriate to the importance of the office.
2. The Councillors of Hurstville in their roles as members of the governing body of the Council and as elected persons are reimbursed for expenses reasonably incurred in the performance of the role and are provided with a standard and range of facilities to assist in discharging the functions of civic office.
In order to ensure that the above objectives are met, Council considers the following to be a reasonable basis for the payment of Civic Office expenses and the provision of facilities.
EXPENSES1.
Conferences and Seminars - payment or reimbursement of costs associated with:
* Registration - including official functions, luncheons, dinners and in relation to the attendee's partner, the cost of the official dinner.
* Travel - by Council vehicle, private and hire vehicle (with fuel costs to be borne by Council), rail or air, Cabcharge facilities to be also provided for use, if necessary. Travel by air will be by economy class. Should other means of travel be required, Council to meet the cost up to the equivalent cost of air travel. With all travel arrangements due consideration is to be given to the physical condition of the Councillor and any variation to these arrangements shall only occur with the approval of the Mayor or the Council where such arrangements relate to the Mayor.
* Accommodation - the costs of double room only accommodation, including the night before and after the conference where necessary, to be met by the Council.
* Delegates Accompanied by Spouses/Partners - other than the cost of the official dinner and the provision of double room accommodation, other costs, particularly air and rail travel, to be met by the delegate.
* Expenses - the payment to Councillors of a daily subsistence allowance or
reimbursement of actual expenses, the level of which is to be determined by Council from time to time, to meet other costs incurred in attending conferences and seminars.
2. Sister City Relationships - in respect of Councillors nominated by Council to represent Council as part of Council’s official delegation in accordance with the policy adopted by Council in this regard. * Payment or reimbursement of costs associated with the cost of air (economy class) and ground travel and accommodation expenses (including meals) for the official itinerary and visit only
* That a daily allowance not be paid.
* That Council meet the cost for the Head Representative of Council for hosting one reciprocal Official Dinner in the host city during the visit.
* That out of pocket expenses for official expenditure be refunded to delegates upon production of documents and receipts.
2.
Training in Word Processing/Computer Use - training course registration fees for software packages to be utilised in association with Council, to be borne by the Council.
3.
Telephone Line Rental - in the event of such being considered appropriate by the Council, payment for the installation of line rental and charges for one (1) home telephone line for use in association with the provision by Council of a Fax/Answering Machine and Laptop Computer.
FACILITIES1.
CouncillorsAll Councillors are to receive the benefit of the following Council facilities:
(a) Stationery - use of Councillor letterhead, envelops, business cards, question books, snap memo pads and provision of name badges and copies of relevant books and legislation.
(b) Secretarial Assistance - typing of official Councillor correspondence on the basis of submission of a draft and is confined to letters of reply to constituents concerning Council matters and reports for Council's consideration.
(c) Computers - provision of appropriate laptop computers and printers and associated software and consumables in conjunction with Council's electronic business paper system such to remain the property of the Council.
(d) Facsimile/Telephone Answering Machines - purchase and maintenance of facsimile/telephone answering machines and provision of consumables, such to remain the property of the Council.
(e) Mobile Telephones - provision of a mobile telephone of a type and model to be determined at the relevant time together on the basis of Council meeting the cost of calls up to $100.00 per month plus access fees.
(f) Meetings, Meals and Refreshments - provision of meals and refreshments associated with Council, Committee and Task Group/Special Committee/Working Party meetings and other functions arranged by Council.
(g) Transportation - provision of Council motor vehicle transportation (when available) for travel to conferences, seminars, etc. and when on official Council business in accordance with Council's policy in this regard. Provision of Cabcharge facilities for use when on Council business as authorised by the Council or the Mayor or when performing the role of Councillor in accordance with Council's policy in this regard.
(h) Meeting Rooms - provision of meeting facilities in the Civic Centre for the purpose of Council, Committee and Task Group/Special Committee/Working Party meetings and an interview room for meeting with constituents and Councillors' room with individual lockers.
(i) Parking Facilities - provision of limited parking in the basement car park of the Civic Centre.
(j) Corporate Uniform - provision of Council's corporate uniform (as available to staff) to Councillors, if requested.
(k) Office Storage - provision of filing cabinets for home storage of Council business papers, reports, documentation, etc., such to remain the property of the Council.
(l) Child Care - Reimbursement of reasonable costs of facilities and/or services incurred by a Councillor while attending Council and/or Committee meetings.
(m) Acquisition of Equipment by Councillors - Upon ceasing to be a Councillor, either by resignation, retirement or not being re-elected, a former Councillor shall be permitted to purchase from Council the facsimile machine and filling cabinets provided by Council under this policy on the basis of a purchase price of the items current written down value according to Councils accounting records.
In addition, in the event of Council disposing of the laptop computer and/or printer allocated to a Councillor during his/her term of office the Councillor will be offered the opportunity to purchase such laptop computer from the Council at either the trade-in value or the price which could be obtained by Council by any other means of disposal, whichever is the higher.

MayorIn addition to those facilities provided to the Councillors the Mayor is to receive the benefit of:
(a) Council Vehicle - of a standard as specified by the Council (currently a Ford Fairlane Ghia or equivalent) with mobile phone. The vehicle to be used at the discretion of the Mayor in accordance with Council's adopted policy in this regard.
(b) Secretarial Services - word processing, photocopying, administrative and personal secretarial support.
(c) Administrative Support - assistance with functions, organisations, meetings, and the like by the Mayor's Secretary and other appropriate staff.
(d) Office Refreshments - as provided in the Mayoral Office for entertainment purposes.
(e) Stationery - Mayoral letterhead, envelopes and stationery generally.
(f) Office Equipment - Provision of appropriate office equipment such as a desktop computer, facsimile machine, copier, etc., within the Mayoral Office.
REDUCTION OF FEES1. That Council acknowledges that some minor private benefit may be derived by Members from the facilities provided by the Council; however, Council is of the opinion that such benefit is not significant and therefore considers the fees payable to the Mayor and Councillors under the Act should not be reduced.
