Hereunder is my report No.01 to be submitted to the Development, Health & Planning Committee:-
07.01 HURSTVILLE "VIP" LOUNGE (T/01348)
- Background
Councillors will be aware that Council had undertaken to design and build a VIP lounge for Hurstville Oval.
During development assessment of the original design by Kevin Casey, concerns were raised regarding the Federation building style proposed which, although submitted in accordance with guidance given to the designer, was considered to be out of character with the historical significance of the Oval and surrounds.
Accordingly Development Approval was not granted and the Hurstville Ward Councillors requested that a detailed draft design brief be prepared for Council's approval and another architect appointed.
A written brief was prepared and endorsed by Council on 22.4.98.
The Divisional Manager of Engineering and Policy, Planning & Environment interviewed five architects and the combination of Andrea Wilson and Neil Durbach were the successful team. Council appointed them to do the work.
Work to Date
The fee proposal for the work was 10% of the cost of construction with sketch design at 20% of the total cost. The work to date has incurred fees of $5,400 being 90% of 20% of $300,000 plus the cost of the perspective, $800. Wilson/Durbach have prepared sketch designs for two options together with a coloured perspective as requested by Council.
Following the Ward Councillors' meeting on 25 August 1998, Council resolved to have both the Kevin Casey scheme and the Wilson/Durbach scheme costed by an independent Quantity Surveyor, WT Partnership. These estimates have been prepared and forwarded to Ward Councillors for consideration but Council has not yet determined future direction.
An original budget of $5,000 was set for fees but this was used to pay Kevin Casey. There was no additional budget for the Wilson/Durbach consultancy or the Quantity Surveyor, so it is recommended that $20,000 be voted from surplus working funds to cover the cost of the fees. If the work does not proceed, the funds can be reimbursed. To date $5,400 is due to the Architect together with fees from the Quantity Surveyor.

BUSINESS ARISING FROM THE MINUTES
Hurstville City Council to clarify whether the median strip wall in Beverly Hills was cleaned and sealed in July. Clr Griffin raised the issue of a hole in the wall which needed attention.
Section 94 Plan
The Divisional Manager - Policy, Planning & Environment confirmed that the resolution by the Committee for a Section 94 Plan for car parking and traffic management for Beverly Hills, had been addressed in a report to Council on 15.7.98. Council resolved that it would form part of the Section 94 Plan review which is due for completion in August 1999.
Sign Code
The Divisional Manager - Policy, Planning & Environment confirmed that the Sign Code was sent to all commercial property owners on 14.9.98.
GENERAL BUSINESS
Sydney Water Land
MOTION: Moved Clr Frawley and seconded Clr Dominelli
THAT: Hurstville City Council investigate the possibility of leasing the land owned by Sydney Water to be developed as Open Space.
Median Strip
MOTION: Moved by Clr Dominelli and seconded Clr Griffin
THAT: the Divisional Manager - Engineering investigate whether plants which flower can be incorporated in the median strip. The Manager - Parks and Recreation to attend the next meeting.
Open Space
Morris Iemma asked about the status of the Sketch Design for the Open Space.
MOTION: Moved Clr Griffin and seconded Clr Dominelli
THAT: Plans and cost estimates of the design for Open Space be submitted to the next meeting.
Paving
There was a general discussion about various types of paving. Clr Dominelli favoured the bitumen and trachyte being used in the City of Sydney.

THAT: the Divisional Managers of Engineering and Policy, Planning & Environment investigate by the next meeting, alternative paving options, and type and arrangement of the planter boxes in Crows Nest.

07.03 MELVIN STREET SOUTH, HAMPDEN STREET AND EDGBASTON ROAD
- In response to Council's request that as a matter of utmost urgency, a report be put to Council on Melvin Street South, the issues relating to Melvin Street South are outlined below.
Background
Council is aware that a draft Development Control Plan (the Plan) for Beverly Hills Town Centre was on exhibition from 15.6.98-3.8.98. Council received approximately 220 submissions and in addition to this a petition signed by 830 people. Most of the submissions related to the increase in density on the east side of Beverly Hills and to urban consolidation generally. There were twenty four submissions which related to the western side of Beverly Hills in which the Melvin Street precinct is located.
In response to the concerns of residents, Hurstville City Council undertook to hold a poll and have now resolved to hold a survey to establish the direction which residents wish Council to take in the future as regard higher densities. This survey puts on hold the DCP for Beverly Hills.
This is a cause for concern for a particular group of residents in Beverly Hills who are in a disadvantaged position because of development from the current DCP. They have requested that Council reclassify their street, Melvin Street, with an appropriate building envelope to allow them to sell their properties. This request was refused by Council at the meeting on 26.8.98 because of concerns that it conflicted with the proposed poll.
Below is an extract from the report to Council of 26.8.98 which outlined the process and outcome of the draft Beverly Hills DCP as it related to Melvin Street.
"Draft DCP Melvin Street South/Hampden Street - History
During the course of the development of the DCP, Council had four meetings with residents. One was with Melvin Street residents only. This was due to the specific problems relating to Melvin Street residents. On the eastern side of the street three/four storey unit blocks in Hampden Street sited close to the lane boundary overlook the backyards of their properties and they have lost all privacy.
Consequently residents on the east side want their side of the street to be reclassified to allow higher densities. The residents on the western side opposed the increase in density and do not want units in their street.
Hampden Street residents - those who remain - had originally opposed the reclassification of the area to units. However due to the fact that they are now surrounded by units, they requested that their unit classification remain.
The DCP attempted to meet the concerns of residents from both sides of the street in Melvin Street and to create better building envelopes for Hampden Street, by the following:
* Access for parking in Melvin Street and Hampden Street from the laneway at the rear of the site.
* A three storey building envelope which forms small courtyards on the Melvin Street frontage to relate better to the detached houses opposite.
* A "build-to-the-boundary" scenario on part of the site so that a terrace house form of development is developed in Melvin Street.
* A minimum twelve metres wide open space to the lane between Hampden Street and Melvin Street to create a green corridor between the development on Hampden Street and Melvin Street.
* Melvin Street uninterrupted by street crossing so that visitor car parking can occur in the street and security parking under the buildings as well as the landscape zone.
* Two and three storey building envelopes in Hampden Street which are located across the site facing the street and lane allowing a twelve metre open space between the buildings.
* A designated zone for deep soil planting which is not over a car parking basement.
Submissions
There were twenty four submissions received on the Beverly Hills DCP relating only to the west side of Beverly Hills. Of those, eighteen submissions fully supported the Plan. The support came from the residents who live on the east side and of the street whose homes had been overlooked by the Hampden Street development. The submissions fairly unanimously considered that the use of the lane for vehicle access and the almost terrace style building envelope a reasonable compromise.
There were three submissions from the west side of Beverly Hills which strongly opposed the Plan.
Issues Raised
Issues raised by Residents who did not support the draft DCP include:
Garbage: Bins are not put out or collected properly in unit developments.
Crime: There have been increases in crime in the area since units were built.
Noise: "Noise is a very real issue for people living in close proximity" - (comment from a resident in a unit).
Traffic: The increase in traffic will make it difficult to access King Georges Road and Stoney Creek Road.
Character: The character of the suburb will change for the worse.
Property Value: The new development will reduce the property values of adjacent dwellings.
Additional Issues
The following issues were raised by supporters of the Plan but wanted these issues to be taken into consideration.
Amalgamation
Three submissions raised the issue of amalgamations.
One supported the concept of individual site envelopes but was part of an amalgamated site in which the owner of the adjacent site did not wish to develop. The others were not part of an amalgamation and did not want to be left in isolation.
Widening the Lane: The proposal called for the widening of the lane as the development proceeded. Its current narrowness was seen to be an asset in that it discouraged speeding, was already adequate in capacity. With an increased width there was the danger of speeding.
A phone call also alerted Council to a notable Jacaranda tree at the rear boundary of one of the properties.
The intention of the DCP for the laneway was that a roadway/landscape design be prepared which retained all vegetation and added soft landscape etc. Council considers it is essential that any substantial trees should form part of the design.
The laneway is to be designed to accommodate slow traffic and to retain substantial and appropriate vegetation. Widening will only address issues of vehicle safety and pedestrian amenity.
Height of Building on King Georges Road: One submission considered that the eight storey "landmark" building in Beverly Hills was inappropriate. This is one of many submissions on this particular building envelope and will be considered if and when the whole Plan is considered."
Draft DCP for Melvin Street South, Hampden Street and Edgbaston Road
A new draft DCP has been prepared for the Melvin Street South, Hampden Street and Edgbaston Road precinct. The draft DCP is restricted purely to this precinct. Given the level of detailing of analysis and consultation, the basic building envelopes, car access, deep soil planting zones etc, remain the same but the development along Hampden Street lane has been altered from three to two storeys.
A copy of the draft DCP has been distributed to Councillors.
Architectural Guidelines
In order to obtain the best architectural outcome and because the building envelopes allow side boundary walls, the DCP should be accompanied by Architectural Guidelines. Funds for this have been set aside in the PP&E Budget.
Consultation/Exhibition Process
The proposed consultation and exhibition process is outlined:
1. Letter (reproduced below) to:
- a. All affected residents and neighbouring residents (100-150);
b. Resident's Action Groups and all stakeholders.
2. Exhibition period - four weeks. Location Hurstville City Council, Hurstville House and the Hurstville Library.
3. Price of DCP to Community Groups - free. To individuals - $3.00. Copies can be borrowed from the Library.
4. Public meeting - two weeks after start of exhibition and noted in letter with an Independent Facilitator.
5. Advertising in the St George Leader - one article per week.

The objective of the draft DCP is to:
* address as a matter of urgency, the issue of privacy and life style for the Melvin Street South residents on the eastern side of the street;
* create building envelopes which increase densities to sufficiently buffer Hampden Street properties and provide a suitable outcome for residents on the western side of Melvin Street South.
The proposed draft DCP allows:
* Three storey units to be designed in accordance with the building envelope for the particular site.
* Density: approximately six units per twelve metre width site (two units per floor per site).
* Vehicular access from laneway to Melvin Street and Hampden Street.
* Deep soil planting zone twelve metres by the width of the site (sufficient soil for tree growth).

Options
Council can resolve to prepare and exhibit the draft DCP or, if Council require more time, can resolve to prepare a draft DCP in which case the DCP will come back to Council on 25.11.98.
Conclusion
A copy of the draft DCP has been circulated to Councillors in hard copy.
This matter is now before Council for re-consideration as a matter of urgency.
Recommendation
That Council resolve to prepare and exhibit a draft DCP for Melvin Street South, Hampden Street and Edgbaston Road.
Given the nature of the draft DCP, it is considered appropriate that architectural guidelines are prepared.
