03.02 FRIENDLY TOWNS ACCORD - BARRABA SHIRE COUNCIL

Members would be aware that Council has developed a "Friendly Towns" association with Barraba and Manilla Shire Councils since 1994 when the Council and citizens of Hurstville financially assisted those towns when they were hit with a devastating drought over many, many months.

Representatives from Council have visited those towns on a number of occasions to develop this friendly association and for the past four years representatives have attended the Annual "Barrabor Festival".

As a number of Council representatives will be in attendance at this year's Barrabor Festival, it would be appropriate for Council to formalise this Friendly Towns association by signing a document to this effect.

Accordingly the following recommendation is submitted for Council's approval.

03.03 ROADS & TRAFFIC AUTHORITY (RTA) - PROPOSED COMPULSORY ACQUISITION OF A FURTHER LEASE OF PARTS OF COUNCIL'S LAND AT KINGSGROVE RE M5 EAST MOTORWAY

Members will recall that Council has given consideration to a number of reports in the past regarding a proposed Acquisition Notice served on Council under the provisions of the Land Acquisition (Just Terms Compensation) Act 1991 in relation to an area of Beverly Grove Park which the RTA intended to lease from the Council at that point in time.

Members will also recall that as a result of the valuation obtained by Council, a claim for compensation lodged by Council and a Compensation Notice received from the RTA in this regard, Council, via its solicitors, has lodged a dispute in the Land & Environment Court in relation to the level of compensation offered by the RTA in association with this acquisition.

This particular aspect of the matter is proceeding and Council as previously indicated, will be informed of developments as appropriate.

In association with the construction of the M5 East Motorway, Council recently received a letter from the RTA advising that the contractor for the Motorway was requiring the RTA to acquire additional lands in association with the project and that a further proposed Acquisition Notice would be served upon Council in the near future regarding these lands. The plan attached to this correspondence indicated that the additional land in question was adjacent to and south of the area of land subject to the previous proposed Acquisition Notice.

By letter dated 19th October, 1998 the RTA has now served the required "Proposed Acquisition Notice" in relation to that additional area of Beverly Grove Park which the RTA intends to lease from the Council at this point in time.

The correspondence from the RTA also indicates that the Minister for Roads has approved shortening the minimum period of notice under the Act from 90 days to 7 days to ensure that the RTA is entitled to possession of the land when it is required, without disruption to the construction programme.

In view of the above, the RTA also requests Council to therefore lodge its claim for compensation if it so wishes under the terms of the Act, as soon as possible.

In order to enable Council to lodge an appropriate claim, Council's valuers have once again been requested to provide a valuation to assist Council in this regard and upon receipt of this valuation it will be necessary for the appropriate claim for compensation to be lodged with the RTA as soon as possible.

Accordingly it is suggested that Council should authorise the General Manager to complete and lodge a claim in accordance with the advice received from Council's valuers, being the same course of action that was taken in respect of the previous claim once again due to the time frames involved.

Accordingly the following recommendation is now submitted for Council's consideration.

The Council, at its meeting on 14 December 1994, resolved that a record of progress of all legal matters involving court action, either awaiting to be commenced or in progress, be maintained by Divisional Managers and that a summary of that record be submitted to each Council meeting by the Divisional Manager - Community & Corporate Services.

In accordance with Council's decision, the following report is submitted for the information of Members on the basis of information received from the relevant officers of Council.

DA 180/94	Land & Environment	Matter heard on 20th and 21/4/98 and appeal upheld by the Court subject to conditions. Appellant has lodged an appeal to the Court against the conditions. On 13/8/98 the Court approved variations of conditions. Council has commenced Class 45 action for breach of conditions of approval and matter set for mention before the court on 26/11/98.
10/2/98	Appeal against refusal to grant development consent for a 3 storey commercial/residential building at 91 Mulga Road, Oatley. 03.08 HURSTVILLE MINISTERS FRATERNAL - REQUEST FOR WAIVING OF FEES FOR MARANA AUDITORIUM (H/00004)

The following letter dated 1st October, 1998 addressed to His Worship the Mayor, Clr M Frawley, has been received from the Hurstville Ministers Fraternal requesting Council to consider waiving the fees for the use of the Marana Auditorium for a cross denomination celebration on Sunday, 30th May, 1999

"At the end of May this year the Hurstville Ministers Fraternal held a cross denomination celebration in the Marana Auditorium. It was a great experience for those who attended and I believe a significant event in the Hurstville calendar.

Over 600 people attended and we raised $2,000 for the

Hope for the Children Foundation

We have booked the Marana Auditorium for Sunday 30 May 1999 for a similar celebration which we plan to be larger than the event held this year.

Therefore I am writing to ask the City Council, through you, to waive the hiring fee for the Marana Auditorium for the celebration planned for 30 May 1999."

The Council's policy in respect of matters such as this is reproduced, in part, hereunder.

"(a) For hire on Friday, Saturday, Sunday or Public Holidays by any organisation, the full hiring charges as fixed by Council from time to time be applied to such usage.

(b) For hiring on days other than Friday, Saturday, Sunday or Public Holidays by charitable, non-profit making local organisations located within the City, and schools within the Cities of Hurstville and Rockdale and Municipality of Kogarah, the amount charged be the actual cost to Council for wages and direct costs plus ten (10) per cent.

(c) For hirings at any time by profit making organisations, the full hiring charges as affixed by Council from time to time be applied to such usage.

FURTHER, THAT applications for free or reduced rental falling outside Council's policy be referred to Council for determination."

Council's Entertainment Centre Officer has advised that the normal charge for a booking such as this would be $1,170.00 and Costs + 10% would be approximately $396.00 (including costs for a lighting technician).

As Members will be note, Council has been requested to waive the rental in respect of the use of the Marana Auditorium on Sunday, 30th May, 1999, however this is not in accordance with Council's policy which requires the payment of normal rental in respect of the use of Council's facilities on a Friday, Saturday or Sunday.

In respect of the function held in May of this year and referred to in the above letter, the Council at its meeting on 24th September, 1997 gave consideration to a request from the Uniting Church in Australia for this function and resolved that the Marana Auditorium be provided free of charge.

Whilst the current request is not in accordance with Council's policy, in view of Council's previous decision in respect of the function held in May of this year, the following recommendation is submitted for Council's consideration.

03.09 CHINESE AUSTRALIAN SERVICES SOCIETY CO-OPERATIVE LTD - REQUEST FOR WAIVING OF RENTAL FOR USE OF CIVIC THEATRE (H/00006)

The following letter dated 23rd September, 1998 addressed to His Worship the Mayor, Clr M Frawley, has been received from the Chinese Australian Services Society Co-operative Ltd requesting the waiving of fees for the use of the Civic Theatre on Wednesday, 2nd December, 1998

"As you may be aware, the Chinese Australian Services Society (CASS) is a non-profit community organisation dedicated to provide settlement and welfare services, promote culture and encouraging participation in the society. Currently we run a child care centre, a playgroup and an elderly group in Hurstville. In the near future we will continue to increase services in Hurstville so as to meet the needs of the largely increased Chinese population living in the area.

We plan to conduct a Citizenship Ceremony on 2 December at the Hurstville Civic Theatre. The objective of the event is to promote Australian Citizenship in the Chinese community. It will be jointly organised by CASS and the Department of Immigration and Multicultural Affairs (DIMA). Details of the Ceremony are as follows:

Date: 2 December, 1998 (Wednesday)

Time: 2.00pm - 5.00pm - Venue Setup

5.00pm - 7.00pm - Registration

7.00pm - 9.00pm - Citizenship Ceremony

9.00pm - 10.00pm - Tidying up the venue.

As the event is non-profit making and will benefit residents of the local area, I am writing to seek your support to waive the venue hire fee incurred from the use of the Civic Theatre. We will write to you again to invite you to participate in the ceremony once the arrangement is confirmed.

Please do not hesitate to contact our Community Settlement Services Worker, Ms Grace Zheng if you have any queries regarding this matter.

I look forward to your favourably reply soon."

The Council's policy in respect of matters such as this is reproduced, in part, hereunder.

Council's Entertainment Centre Officer has advised that the normal charge for this booking is $180.00 and Costs + 10% would be approximately $86.00.

The Society is located at Campsie and therefore does not comply with the above policy for the waiving of the fees involved. However, as the Society is a non-profit community organisation and also as the event will benefit residents in the Hurstville City Council's area, Council may wish to give consideration to providing the Civic Theatre as requested for Costs + 10% at approximately $86.00.

In accordance with the above policy, this matter is referred to Council for consideration.

Members may recall that Council at its meeting on 23rd September, 1998 gave consideration to a report regarding a request from The Sydney Day Nursery and Nursery Schools Association Inc for a rate exemption on the Association's property at 155 Dora Street, Hurstville.

At that meeting Council resolved as follows.

"THAT Council not grant rate exemption to the Association in respect of property at 155 Dora Street, Hurstville. Council is of the opinion that the "Association" is not a public charity within the meaning of Section 556(h) of the Local Government Act."

The Association was subsequently advised of the above resolution.

The Association has now forwarded the following letter dated 19th October, 1998 requesting reconsideration of its request for financial assistance.

"We refer to our previous correspondence to Council and the subsequent denial by Council from the Association being exempt from paying general rates.

We are writing to request that Council reassess our application for exemption as the Association is a "Not for Profit" Community Service and a Public Company "Limited by Guarantee".

We have included for your perusal our 1997/98 Annual Report and you will see what a difficult year it has been with the abolition of Operation Subsidies by the Commonwealth Government with the Association reporting a loss of $182,235. This was prior to the application of a grant from the Commonwealth Government specifically as a contribution towards the Dora Street Long Day Care Centre.

We note that denial was because it was Council's opinion that the Association was not a public charity within the meaning of Section 556(h) of the Local Government Act, however it should be noted that the Association committed a considerable amount of its resources to this centre which was a relocation of the St George's Anglican Church Child Care Centre formerly located at the Cnr Forest Road and The Avenue, Hurstville.

This centre would otherwise have been closed due to the Church's sale of land their decision not to continue with the sponsorship of this much needed service.

We would be extremely grateful for any contribution or exemption that Council could provide given the Association's enormous financial commitment to this Hurstville service and look forward to your favourable reply."

The 1997/98 Annual Report referred to in the above letter is included in "Matters Submitted for the Information of Members -

The Association is now requesting Council to reassess its decision on 23rd September, 1998 or provide financial assistance.

Council has previously resolved that the Association's property at 155 Dora Street, Hurstville is rateable and is not eligible for a rate exemption and the Manager - Rates has once again confirmed this situation.

The Manager - Rates has also advised that the rates for 1998/99 for this property are $1,873.46 and the waste service charges are $517.00 with the total rates and waste service charges of $2,390.46 having been paid in full.

No provision has been made in the 1998/99 Adopted Program Budget for a specific donation to The Sydney Day Nursery and Nursery Schools Association Inc.

In view of the above details, the following recommendation is submitted for Council's consideration.

03.11 CAPITAL CITY COMMUNITY INVOLVEMENT IN THE SYDNEY 2000 OLYMPIC TORCH RELAY

The following letter dated 10th October, 1998 has been received from the Sydney Organising Committee for the Olympic Games updating the progress in planning for the Sydney 2000 Olympic Torch Relay.

"The purpose of this letter is to provide your Council with a further update on progress in planning for the Sydney 2000 Olympic Torch Relay prior to the 31 October, 1998 national route announcement. I have written in similar terms to each other General Manager in the metropolitan areas of every Capital City in Australia.

I am pleased to confirm the national route for the Sydney 2000 Olympic Torch Relay will be announced on Saturday, 31 October 1998 at 9am (EST). At this time SOCOG will release the details of all communities outside of Capital Cities which are included in the national route. Please note, SOCOG will not be releasing the Capital City routes to the public until March 1999. For example, on 31 October 1998 the route listing released to the media for your metropolitan area will read

Sydney and Suburbs.

Discussions with a range of Capital City councils concerning their involvement will occur later this year. Generally, these discussions/negotiations will determine the willingness of these communities to stage celebrations. These discussions will be conducted in a confidential forum to avoid premature speculation and the generation of false expectations by communities.

Again, I would also like to emphasise that the 100 day journey around Australia will be one continuous celebration as communities across Australia welcome the Olympic Flame to their community.

The following letter dated 8th October, 1998 has been received from Shiroishi City Council concerning a visit to Hurstville by the Sennan Public Management & Labourers' Council on Thursday, 26th November, 1998.

"How are you? Here in Japan, the leaves have started to change colour, and we are welcoming in the season of harvesting, culture, sports and leisure, and colourful festivals. I'm sure you are as busy as ever.

I am pleased to be able to tell you that the recent International Goodwill Swimming Carnival and the Greenleaves Mission were a great success. I must thank you for sending such excellent representatives of your country, and I must also thank you for all your hard work in helping to bring about these wonderful exchanges.

This year from 22nd to 29th October, the 3rd "Shiroishi Wings of Friendship" visit to Australia will take place. Between 24th and 25th October, the group will be visiting Hurstville City, where they will make a courtesy call to the City Council and will attend a welcome party. They are very much looking forward to visiting Hurstville, and I thank you in advance for your help with the arrangements.

There is however, one more favour which I must ask of you. It is to do with the upcoming visit by the representatives from the Sennan Public Management and Labourers' Council, during their 9th Overseas Inspection Tour.

Each year, 15 people representing administration, businesses, and workers in the Sennan area, which is the area south of Sendai, comprising 2 cities, including Shiroishi, and 7 towns, visit a city that has sister city affiliations with one of the city's or towns in the Sennan area. The purpose of the tour is to conduct an inspection tour aimed at economic growth and development. Representatives of the Sennan area last visited Hurstville in 1995.

This year the group is visiting Australia, and as you can see from the enclosed itinerary, they will be visiting Hurstville on 26th November, where they hope to carry out a study tour.

The following is the schedule for the Hurstville visit.

1. Courtesy Call to Hurstville City Council (10am).

2. Informal meeting with representatives of Hurstville City.

3. Tour of City facilities.

4. Attendance at a dinner meeting with five representatives from City Council.

I am sure that Mr Tokura will be in contact with you in regard to this visit. I will be in touch with you again in regard to where the dinner will take place, and other details.

I apologise for bothering you when you are busy, but I would be most grateful for your assistance with this matter."

As indicated, a group of 15 persons from the Sennan Public Management & Labourers' Council will visit Hurstville on Thursday, 26th November during a visit to Australia. This will be the second visit by representatives from the Sennan Public Management & Labourers' Council since Council formed a Sister City relationship with the City of Shiroishi in 1994.

Arrangements are in hand for the visit and Councillors will be contacted separately in the near future regarding their possible participation with the inspection tour of Hurstville and dinner with the group.

03.13 ENCROACHMENT ONTO ORANGE LANE, HURSTVILLE (004453 & 011264)

Members may recall that Council at its meeting on 24th June, 1998 gave consideration to a report regarding the footpath in Orange Lane, Hurstville and the encroachment onto the roadway (footpath) in this location by No.3 Orange Street and No.32 Wright Street, Hurstville.

At that meeting Council resolved as follows:-

"THAT a survey be carried out of the affected properties in the street and FURTHER, THAT a Ward Councillors meeting be convened."

Council's Surveyor prepared a survey of the affected properties showing encroachments onto Orange Lane by both subject properties.

Also, in accordance with the abovementioned resolution a meeting of Ward Councillors was held on Wednesday, 2nd September, 1998 and at that meeting it was recommended that:-

"(a) The matter be kept under constant review.

(b) Council's Engineering Division:-

(i) check the other side boundaries of No.3 Orange Street and No.32 Wright Street to see if all boundaries are out.

(ii) check the remaining boundaries that front Orange Lane including the dead-end section of the Lane.

(iii) following the inspections, a report be submitted to Ward Councillors.

(c) Notations be placed on Council's property files and computer records of the encroachments.

(d) The notations on Council's computer records be made so that any Section 149 Certificates issued on the subject properties will inform applicants of the encroachments onto Orange Lane and that Council will enforce the demolition and relocation of the side boundary fencelines on the correct alignments on the transfer of ownership.

(e) The existing owners of No.3 Orange Street and No.32 Wright Street be advised of (c) and (d) above and further that:-

(i) should the fences that encroach onto Orange Lane require replacement or repair, they must be relocated on the correct property alignments.

(ii) no further improvements will be permitted on the portions of land that has been encroached upon."

The above details are submitted for the information of Members and subsequent ratification of the above recommendation from the meeting of Ward Councillors.

03.14 SOUTHERN SOLUTIONS - REQUEST FOR FINANCIAL ASSISTANCE

The following letter dated 13th October, 1998 has been received from Southern Solutions, a business, training and employment agency, requesting Council's financial assistance in association with that organisation relocating from Kogarah to Hurstville.

"Southern Solutions - Business, Training and Employment is the only non-profit, community based organisation in the St George and Sutherland Shire that helps unemployed residents find genuine jobs under the new Job Network. For the past 18 years we have been operating in the St George area very successfully. This year we will help 750 people find employment and personally place 480 of those people into jobs.

To continue this vital service we need your help with financial assistance of $10,000 or part thereof as detailed below. With the recent restructure in government grants we now find it essential that we relocate to Hurstville from Kogarah to ensure our survival. Hurstville is the economic hub of the St George region and where our clients (jobseekers and employers) demand that we be located.

Our extensive expertise is in helping the disadvantaged and long-term unemployed into jobs. Our clients range from

- the young person, with no skills or experience and needs help getting their foot in the door;

- the mature worker who has specialist qualifications but their industry has developed new technology and does not require the client's skills anymore;

- the new migrant who needs help, not only in their ability to speak English, but also adapting their work history to suit our Australian business culture;

- the mother that has not worked for sometime but now requires income to raise her about the poverty line.

Our clients usually have a number of barriers that they must overcome before obtaining employment. We help those from different religious beliefs and cultural backgrounds. This includes training on techniques that will increase the likelihood of these clients finding employers sympathetic to their religious codes. We also work closely with other community groups to give these clients the support they require to ensure they find employment.

We are very proud of our achievements. Over the past eighteen years we have helped thousands of local jobseekers find work. We have consistently helped over 65% of our disadvantaged jobseekers into employment or further training. This is a remarkable success and the previous CES rewarded us for our outstanding results in NSW.

Unemployment is the number one issue outlined by opinion polls. Unfortunately the expectation is that the unemployment level will rise in the foreseeable future. Unemployment in St George is now 7.9%, increasing by 2.9% in the last two years. Youth unemployment is a record 29.9%, increasing by 3.5% in the past two years. This puts a heavy burden on an organisation such as ours as we struggle to help our local community grow and expand.

We recognise that the unemployment level will not decline without employers receiving support so that they may employ more people. We support local businesses in many ways such as holding bi-monthly seminars to help business owners learn marketing and sales techniques. Our job matching service is one of the few supplied in Australia FREE OF CHARGE to businesses to encourage them to employ our unemployed jobseeker clients.

There are many unfavourable social issues that stem from high unemployment. We can already measure the impact of high youth unemployment in the local area. The consequences include:

- increased street and domestic crime,

- high suicide levels and the social impact on the family unit,

- increasing strain on the family's finances as many benefits are not longer available,

- higher marriage breakdowns because of stresses and therefore more people living on the poverty line.

We are in a "Catch 22" situation where we must relocate to smaller premises in the Hurstville business district to remain financially viable, however we do not have the funds to cover the moving costs. We currently pay $55,000 in rent and by locating to smaller premises we can reduce our rent to $34,400. This is a saving per annum of $20,600 that, I'm sure that you will agree, is quite a saving and would ensure that we can continue to operate.

We are currently negotiating on premises at Level 2, 8 Crofts Street, Hurstville.

It is estimated that it will cost $10,000 for us to re-locate to Hurstville enabling us to remain economically active. I have detailed a budget below.

As indicated in the above letter Southern Solutions, whilst being a non-profit organisation, operates under the Federal Government' s new Job Network and would have been required to submit a relevant tender in association with the establishment of that network in competition with other service providers.

Whilst the services provided by this organisation on a non-profit basis are of value to the community, it is difficult to suggest that Council should financially support the organisation in relocating from Kogarah to Hurstville as requested in view of the fact that it operates within a competitive market and was successful in being awarded a contract under the Federal Government's Job Network without the inclusion of financial assistance as now being requested from the Council.

In addition, should Council agree to this request there would no doubt be a number of organisations within the community which operate on a similar basis providing valuable services to the community at large which could also lodge requests with Council for financial support.

No provision has been made within the 1998/99 Program Budget for the financial assistance as now sought. Should Council wish to provide any level of assistance it would be necessary for the proposed action to be advertised in the first instance in accordance with the requirements of Section 356(2) of the Local Government Act.

Further, in view of the comments contained within this report regarding the operations of this organisation and the fact that no provision has been made for a donation as requested, the following recommendation is submitted for Council's consideration.

On Saturday, 25th November, 1988, during the St George Great Train Festival, the Minister for Local Government, The Hon David Hay, proclaimed the Municipality of Hurstville a City.

To commemorate a decade as a City, it is proposed to hold a Special Council Meeting and Official Dinner on Tuesday, 24th November, 1998. Invitations to attend this function will be forwarded shortly to people connected with these milestones in Council's history, i.e. 1988 - 1998.

It is also proposed to seek assistance from the St George & Sutherland Shire Leader to undertake a 2 or 3 page supplement, Council to present Certificates to invited guests and arrange an official photograph to record the celebration.

03.18A HURSTVILLE CHAMBER OF COMMERCE - ANNUAL BALL

The following letter dated the 22nd October, 1998 and received by Council on the 29th October, 1998 has been submitted by the Hurstville Chamber of Commerce inviting Council to be represented at that organisations Annual Ball to be held on Friday, 20th November, 1998:-

"On Friday 20 November 1998 at 7.00 pm, we are holding our annual ball at the Conca D'oro Lounge 269 Belmore Road Riverwood. We would like to take this opportunity to invite you to attend. We are hoping that other dignitaries will also be attending.

We have been holding similar functions for many years, with presentations by special guests, and the evenings have been worthwhile and very enjoyable. This year's annual ball will include the regional business community and many invited guests.

As you may be aware, over the past year the Hurstville Chamber of Commerce has gained great momentum and a growing membership base.

The evening includes cocktails on arrival, unlimited beer, wine and soft drinks throughout the night, and a 4-course meal. Dress for the occasion is Formal Suit or Black tie, and once formalities are complete their will be dancing until midnight. If you are unable to attend you may wish to appoint a representative to attend in your place.

So that arrangements can be finalised, we ask that you respond and let us know your intentions prior to Friday 30 October by phoning Mr Robert Giunta ( Business coordinator 9546 8939). We do appreciate how busy you will be at this time of year, but hope you will be able to attend our annual ball and look forward to hearing from you."
