04.04 KEEP AUSTRALIA BEAUTIFUL COUNCIL - ANNUAL AWARDS (E/00022)

Council's Environmental Officer, Julie McInnes, and Tree Inspector, Phil Da-Pra, had great pleasure in representing Council at the Keep Australia Beautiful Council Annual Award Presentations held in Finley over the weekend 5-7 December 1997.

Unfortunately Council was unsuccessful with the award applications submitted under the Metro Pride Program this year, although all projects were worthy contenders. Submissions from Councils within Sydney, Newcastle and Wollongong are accepted only once a year now, instead of twice as in recent years, and are judged across six special project categories. Awards are given in recognition of 'outstanding environmental initiatives and policies undertaken by local government in conjunction with the community'. The overall metropolitan winner of 1997 was Newcastle City Council.

The winners in the Tidy Towns Program, open to all cities and towns outside the metropolitan areas, are also announced at these awards, and often take precedence over the metropolitan awards. Winners are spread across five population categories, all of which are highly contested. The State winner of Tidy Towns for 1997 was Lithgow, and the Lithgow community now have the right to host the Awards weekend in 1998.

It was obvious that a great deal of effort from Finley Tidy Towns had been put into accommodating and entertaining visitors for the weekend. This in turn was greatly appreciated by all participants. The only disappointment was the small number of metropolitan Councils in attendance, with many of the award winning Councils not represented at all.

Due credit should got to the KABC for the pride and achievements their Programs foster in all communities. Finley Tidy Towns and Berrigan Council should be thanked for their efforts, and both Newcastle City Council and Lithgow Tidy Towns should be congratulated on their success.

A complaint has been received by Council regarding the poor condition of this section of concrete footpath.

The path contains some sunken and cracked sections, and an old trench reinstatement, running longitudinally for the full length, which has sunk and become overgrown with grass.

The only solution is to replace the affected section and this work is estimated to cost $14,400.00. This should be considered in a Future Works Program.

A letter from Mrs. Eileen Moffatt of No. 890 Forest Road, addressed to Councillor M. Smith, has been received.

The footpath on the south-west corner is earth formation with some existing large Turpentine trees. The shade from the trees, together with an existing bus stop, used by Peakhurst High School pupils, prevents grass from establishing.

An estimate of cost to provide a concrete footpath on the west side of Forest Road, between Samuel Street and Isaac Street, has been prepared, and amounts to $34,100.00.

The installation of the proposed concrete footpath would solve the present problem of the dirt footpath.

Council has received a letter from Mr Horrie Phillips of the Penshurst RSL Sub Branch to host a Charity Cricket Match between the Visually Impaired Cricket Association and Penshurst RSL Sub Branch and Club.

The Penshurst RSL Sub Branch and Club request waiving of any fees.

The park is available for the requested date and a tentative booking has been made for the Penshurst RSL Sub Branch and Club.

04.08 LIONS CLUB OF LUGARNO - REQUEST TO USE EVATT PARK (P/00029)

Council has a request from the Lions Club of Lugarno to hold a "Jazz in the Park" afternoon on Sunday, 15 March 1998 between 12 noon to 5.00pm.

The night format will be similar to that of previous years and money will be raised by public voluntary donation.

The Lions Club of Lugarno would like Council to supply additional waste bins, electricity from the power source and also some security webbing and picket posts to limit access to the stage area.

A large truck with a canopy will hold the performing Jazz band as their stage.

To cater for excess people attending the "Jazz in the Park" event, SES workers will direct parking onto the perimeter of the Oval.

The Lions Club of Oatley would also like to sell liquor on the day so they require a liquor licence.

The park is available for the requested date and a tentative booking has been made for the Lions Club of Lugarno.

"This is the final Report on the activities of the volunteers of the Hurstville SES in providing bush fire relief to the Wolondilly Shire for the period Tuesday 2 December 1997 to Saturday 3 January 1998.

Following a request from Morris Iemma, MP, acting on behalf of Mrs. A. Stephenson, Council at its meeting of 29 November 1995 considered paving for both sides of Hardwicke Street at a total estimated cost of $93,000.

Council's resolution read:

"THAT the construction of concrete paving be considered in a Future Program of Works."

Mrs. Stephenson has recently written directly to Council and her letter reads:

"I am writing to request that a concrete footpath be provided in Hardwicke Street similar to that recently provided in Shenstone Road, Riverwood.

There has been a noticeable increase in the volume of traffic in this street recently, perhaps to avoid the traffic lights in Belmore Road and the volume of traffic on that main road. In addition, the vehicles using Hardwicke Street including heavy garbage disposal trucks, seem to disregard the recently-instituted 50 KPH speed limit.

There are also instances of vehicles being parked on the footpath, even though space is available on the paved roadway. This results in pedestrians being forced to walk on the roadway thereby exposing themselves to the dangers presented by the heavy traffic flow referred to above.

Accordingly, it would be appreciated if Council could provide an allocation in its next available program to enable this work to be undertaken."

Following a request from Morris Iemma, MP, acting on behalf of the resident of 36 Hardwicke Street, Riverwood. Council at the meeting held on 29 November, 1995 considered paving for both sides of Hardwicke Street at a total estimated cost of $93,000.
Council's resolution read:

"THAT the construction of concrete paving be considered in a Future Program of Works."
The resident at 36 Hardwicke Street, Riverwood recently wrote to Council directly, the letter dated 17 December, 1997 reads:
"On 6th April, 1995, Morris Iemma, MP wrote to Council on my behalf re the above matter. In dry weather the footpath is negotiable but very rough walking. Wet weather makes it impossible to use several properties slope down to the footpath and soakage makes it a quagmire. The fact that many residents use the footpath as a car park - some with multiple vehicles - does not improve matters. The street is very dark at night - trees obscuring the lights.

Most of the residents walk on the roadway - an unsafe practice as the street carries heavy traffic.

I am 80 years of age, with no private transport, and after a residency of over 40 years, would appreciate an easier and safer walk to the shopping centre."
Another letter was received by Council from the resident at 34 Hardwicke Street, Riverwood who also writes regarding the same issue. The letter dated 2 January, 1998 reads:

The Ministry of Sport and Recreation in conjunction with the Leisure Institute of W.A. (Inc.) are holding the Annual Recreation Conference in Perth in March 1998. It contains a comprehensive program focussing on "Communities of Change" and is designed to provide delegates with an understanding of the changes that are occurring in the area of sport and recreation provision, facility development, service provision, programming and major events.

To my knowledge, Council representatives have not attended this conference in the past and it is not listed or budgeted for in the 1997/98 Budget.

The program covers a wide range of topics relating to current recreation management practices and is presented to ensure a National focus.

Council, at its meeting of 12 November 1997, resolved as follows:

"THAT Council donate $200 worth of high grade mulch to the Presbyterian Church, Hurstville ......"

A further request has now been received from the same organisation to purchase from Council an additional $50 worth of mulch for their gardens. As Council itself has to buy in this product for donation purposes, it is recommended that the Church acquire the mulch directly from an appropriate supplier.

In accordance with the provisions of Section 10(2) of the Local Government Act, 1993, IT IS RECOMMENDED that the Committee resolve, under the terms of Section 10(2) of the Local Government Act, 1993, that for the reason that the matter relates to contractual matters where Council's interests may be prejudiced by publicity, the press and the public be excluded from that part of the Works Committee Meeting at which this matter is considered. That in accordance with the provisions of Section 11(2) of the Local Government Act, the reports and correspondence relating to this matter be withheld from the press and the public.

IT IS FURTHER RECOMMENDED that the matter be referred to the Council for consideration in Committee of the Whole.

HURSTVILLE CITY COUNCIL REPORT ITEM NO: . ENGINEERING

04.14 59 LAWRENCE STREET, PEAKHURST - TREE REMOVAL REQUEST

Council last considered this matter at its meeting of 15 October 1997 and it relates to a large Lilly Pilly tree. At the above meeting, Council resolved as follows:

"THAT a report be prepared detailing the costs and practicality of relocating the tree."

Several sites were considered suitable for such a well-established, mature, indigenous tree, including Peakhurst Park and the Hurstville Natural Heritage Park.

Professional advice has subsequently been sought from various tree transplanting organisations on the feasibility of relocating this tree. Due to the tree's size, the size of the tree's rootball, and the resulting earthworks, transportation arrangements and service disconnections required, it is estimated that the cost of such a relocation would exceed $100,000, and this would not guarantee the tree's survival. It would appear that the relocation of this tree cannot be justified.

The matter is therefore referred back to Council for its consideration.

It is proposed that a small group of students will use the canoes up to 15 times per year and will need to beach them on the small beach outside the southern end of Oatley Park Baths. This activity forms part of an education program for the purposes of studying bushland, river and inter-tidal ecosystems, and assessing the degree of human impact.

They also request permission to undertake initial canoe training of the younger students within the tidal baths. Discussions with the Swimming Club have revealed that no conflict will arise out of the canoeists' use of the baths, as they will be using different areas of water.

04.17 HANNONS AVENUE, PEAKHURST - STREET TREES

At its meeting held 11th June 1997, Council considered a petition to remove the existing Tallowwoods in Hannons Avenue, Peakhurst and resolved:

"THAT the existing Eucalypts along the northern side of Hannons Avenue be removed and replaced with more suitable trees in accordance with the Street Tree Management Program."

Council considered a further report at its meeting held on 26th November 1997, on the selection of a replacement tree species and resolved:

"THAT Agonis or Melaleuca be planted as determined by Council's Street Tree Management Team."

Residents were notified of the results of the survey and Council's resolutions, and the timing of the work to be carried out. Prior to commencement of removals, several residents contacted Council regarding the possibility of retaining their trees. Although most had originally signed the petition requesting removal of the trees, the residents had by then had time to reflect on the impact the loss of the trees would have on the appearance of the street, and wanted to withdraw their support of the petition.

All residents now urging for tree retention have lodged their requests in writing, detailing the reasons why they wish the trees to remain. Briefly, these include the great visual and environmental values offered by the trees; to help maintain a sense of streetscape among increasing urban densities; the shade and wildlife habitat provided; screening of the industrial area at the eastern end of the street; and the inability of the replacement species to satisfactorily replicate these characteristics.

Requests to retain the trees have been received from residents at house numbers 6, 10 (the resident never signed the petition), 12, 18 (2 trees) and 20 Hannons Avenue, and while the other seven trees were removed on 30th December, 1997, a stop work order was placed on the above trees until the matter is referred back to Council. There is further conflict however in that one of the two trees in front of No. 18 is on the boundary of No. 16, the resident of which, strongly objects to this tree being retained.

All of the remaining trees in Hannons Avenue are in a healthy and stable condition and it appears that the main reason for recommending removal was the apparent overwhelming weight of resident support for the proposal. As this situation has now changed and the property owners still with trees wish to keep them, it is recommended that the remaining street trees on the northern side of Hannons Avenue be reviewed in accordance with Council's standard Tree Preservation policy.

Copies of all letters and previous correspondence have been distributed to the Peakhurst Ward Councillors prior to the meeting to be held on 28th January 1998 to help facilitate discussion.

04.18 ROAD TRAFFIC NOISE WORKING GROUP

Council, at its meeting held on 17 December, 1997 resolved:

"THAT Council seek to have an input at an early stage to the proposed Working Group to be established by the Local Government & Shires Association to develop a policy and procedures for implementing measures to reduce traffic noise levels on local roads, AND THAT for this purpose, a report be prepared for consideration at the next meeting of Council on 28 January, 1998, outlining -

i. Council's history of concerns, representations and formal submissions relative to traffic noise, particularly truck noise; and

ii. The controls sought by this Council to regulate the use of excessively noisy exhaust brakes;

iii. Council's record in having the local area identified as a critical zone for a pilot project for the control of excessive truck noise."

Accordingly, below is a history of this issue:

1989: Road Traffic Noise Task Force established by Minister for the Environment and Minister for Roads and Public Works and Deputy Premier.

December, 1991: F5 Freeway Traffic Impact Working Group formed with the aim of formulating an action plan for the treatment of potential traffic problems caused by the construction of this freeway. Of primary consideration was the potential impacts of the T-intersection of King Georges Road and the F5 freeway, in particular the noise generated from this area.

Resolutions from the Working Group included:

* recommendations for public advertising procedures incorporating letter drops and newspaper advertisements;
* the immediate development of a traffic management strategy for the Beverly Hills North and Stoney Creek Road Areas. (The Beverly Hills North LATM was subsequently implemented).

September, 1992: RTA Interim Noise Policy released. Contains policies and actions relating to road traffic noise, specifically in the development of new road projects.

1993-1995: RTA sets up major consultation process concerning the impacts of the M5 (East) extension, prior to its release of the initial Environmental Impact Statement for the project.

As part of this process, community groups such as the Riverwood Residents' Action Group and the Beverly Hills North Progress Association conduct regular meetings to discuss environmental issues relating to the proposal.

By the end of 1993 it is clear that the major issue to emerge from these meetings is the huge impact noise, in particular the use of exhaust brakes (Jacob's Brakes), will have on the area.

August 1994: The Road Traffic Task Force's final report is released comprising a collation of the findings of the Task Force and its 4 working groups.

September, 1994: Council's submission in response to M5 East Motorway E.I.S. confirmed by Working Party set up to review the project including the following specific responses:

"R12: That the R.T.A. be required to give a commitment to redesign the M5/King Georges Road interchange so that the M5 passes beneath King Georges Road and Cooloongatta Road.

R16: That the R.T.A. be required to give a commitment to comply with E.P.A. requirements and immediately prohibit the use of excessively noisy exhaust braking systems, not only on the M5 East and West but on surrounding residential streets and State Roads.

R17: That the R.T.A. be required to give a commitment to consult with Council's and adjacent residents regarding the provision of 5 metre high noise barriers in lieu of suggested 3.5 metre barriers throughout the length of the M5 East and the duplicated section of the M5 West."

August, 1995: Delegation sent to Hon. Michael Knight, M.P., Minister for Roads as a result of community concerns about the critical nature of the King Georges Road/M5 intersection. The necessity of an underpass at the intersection, regardless of whether or not a tunnel is to proceed all the way to General Holmes Drive, was stressed, as was the need for immediate restrictions on exhaust brakes.

November, 1996: Council considers a report detailing a Traffic Impact Working Group meeting on heavy vehicle noise in Hurstville. The meeting concluded with a recommendation which included Council seeking sanctions on road traffic noise created by Jacob's brakes and illegal exhaust modifications.

The RTA and EPA responded to the recommendations and detailed actions to address the issues raised.

December, 1996 to February, 1997: Council considers and responds to Supplement to M5 East E.I.S.

* Council's request to review and redesign the project such that the M5 and associated noise travels beneath King Georges Road including supporting longitudinal designs and calculations ultimately accepted by the Government.

* Remaining noise issues reinforced as follows:

"5. NOISE ISSUES

Council raises two aspects of concern about noise impacts of the M5 East Motorway. They are included in the following points:

5.1 THAT the RTA give a commitment to comply with Council's recent request for improved legislation and enforcement of excessive heavy vehicle noise, including consideration of the Hurstville Council area being used as a urban pilot for an extensive enforcement campaign.

5.2 THAT the RTA give a commitment to consult with Councils and adjacent residents regarding the provision of 5 metre high noise barriers in lieu of suggested 3.5 metre barriers throughout the length of the M5 East and the duplicated section of the M5 West, and that noise barriers continue through areas of non-residential development."

A request has been received from the Col Jones Swimming Club to conduct a district Swimming Carnival at the Hurstville Aquatic Leisure Centre in June or July of 1998.

Council's current policy is to restrict swimming carnivals to February or March and accordingly Council's consent would be required.

The Club has specifically requested the use of the main pool on a Sunday between the hours of 8.00am and 4.00pm. This is traditionally a quiet period and it is suggested that Council relax its current policy to permit swimming carnivals in the Winter months on a case by case basis.

04.21 THURLOW STREET, RIVERWOOD - PERIOD PARKING


Background

On 20th August 1997 a meeting was held between representatives of the Riverwood Chamber of Commerce, Peakhurst Ward Councillors, Council Officers & Traders from the Riverwood Shopping Centre. One outcome of the meeting was acceptance of the traders' recommendation that the first section of the 90 degree angle parking area on the north side of Thurlow Street east of the railway line be converted from all day to period parking.

The matter was referred the Traffic Advisory Committee and Council at its meeting held on Wednesday 24th September, 1997 accepted the Traffic Committee's recommendation and resolved:

THAT the first section of the 90 degree unrestricted angle parking area on the north side of Thurlow Street east of the railway overbridge, be converted to two disabled parking spaces and eleven 2 hour period parking spaces 8.30am - 6.00pm Monday to Friday, 8.30 am - 12.30pm Saturday.

Complaint Received

A call was received on 20th January 1998 from the office of Morris Iemma, MP regarding the matter and stating that a constituent had complained that the parking in question was reserved for commuter parking and that therefore, the period parking restrictions should be lifted.

Current Position

A search of Council's records reveals that a portion of the angle parking in question is situated on land leased from the then public transport commission of New South Wales by agreement dated 29th August, 1979.

A specific condition of the lease (number 37) states that the Lessee shall not charge any fee or impose any time limit in respect of vehicles parking on the demised premises.

A further condition (number 39) states that the Lessee shall erect a sign supplied by the Lessor indicating "Commuter Free Car Park" in accordance with the Lessor's Drawing No. 1027/7.

The sign referred to in condition 39 is not in place and has not been for some time, two deteriorated steel posts remain with what appears to be the remains of an SRA Commuter parking sign laying at the base of one post. In accordance with the current conditions of the lease, it appears the period parking conditions should be removed.

On inspection on Tuesday 20th January 1998 the newly signposted 2HR period parking spaces showed a high turnover rate with an average of nine of the eleven spaces occupied. The two disabled spaces were not occupied at the time of inspection although the disabled ramps serving these spaces have yet to be installed.

Seventeen of the remaining eighteen "commuter" spaces were occupied.

Council has 2 options

1. Remove the current period parking restrictions
2. Seek the SRA's consent to permit the period parking restrictions to remain.
