Citation
1. This plan may be cited as Hurstville Local Environmental Plan 1994 (Amendment No. 13)
Aims and Objectives, Etc.
2. The aims and objectives of this plan are to:
(a) restrict the height of buildings to which this plan applies to two storeys;
(b) to take into account the existing character of individual commercial precincts; and
(c) to minimise environmental impacts of commercial development.
Land to which plan applies.
3. This plan applies to all land coloured blue and edged heavy black, on the map marked "Hurstville Local Environmental Plan 1994 (Amendment No. 13)" deposited in the office of Hurstville City Council.
Relationship to other environmental planning instruments.
4. This plan amends Hurstville Local Environmental Plan 1994 in the manner set out in Clauses 5 & 6.
Amendment of Hurstville Local Environmental Plan, 1994.
5. Hurstville Local Environmental Plan, 1994 is amended by inserting at the end of the definition "the map" in Clause 5(1) the following words:

Recommendation DRAFT LOCAL ENVIRONMENTAL PLAN 1994 (AMENDMENT NO. 13) - DEVELOPMENT WITHIN GENERAL BUSINESS 3(A) ZONE (T/01281) RECOMMENDATIONTHAT Council resolve pursuant to Section 54 of the Environmental Planning and Assessment Act, 1979 to support the preparation of a draft LEP to introduce a two storey height limit within 3(a) General Business Zones in Peakhurst Ward (excluding Riverwood) as shown edged heavy black on the attached plan.
FURTHER, THAT the Department of Urban Affairs and Planning be notified of the resolution within twenty-eight days.

07.03 COUNCILS AND RESIDENTS AGAINST THE SELECTION OF HOLSWORTHY (CRASH) (A/00017) Hurstville City Council continues active representation on the main working party of CRASH, as well as the 'technical' and 'financial' sub-committees.
As the campaign begins to climax in expectation of the EIS for Sydney's second international airport, it is important that Council is kept up to date with the main issues and strategies relating to the campaign. To this end, the relevant components of the Minutes of the monthly CRASH meetings will be included on the Council paper for your interest.

Clr Lorraine Rodden occupied the chair and declared the meeting open at 6.15pm with welcome to new members on the Committee.
Wollongong City Council represented by Clr K Christian; Campbelltown Aboriginal Advisory Committee represented by Mr Danny Thorne, and the Community Co-ordinator Mr Phil Smith.
1. Confirmation of Minutes of meeting held on 7 November 1996 at Bankstown.
Resolved that the minutes of the CRASH meeting held on 7 November 1996 as circulated, be confirmed.
2. Report from the Finance Sub-Committee meeting of 6 February 1997.
MATTERS RAISED
* Budget status is tight but reasonable for the provision of tasks and strategies set.
* Consideration was given to the Community Co-ordinator position.
* Community awareness: Craig Knowles raised last year and will be raised later in meeting.
* Discussed contacting all Councils and in particular Auburn, Canterbury and Parramatta Councils asking them to put finance towards the CRASH campaign. To be discussed later in meeting.
* The proposal to find $12,000 for the Community Co-ordinator and office equipment was to be discussed later in the meeting.
3. Technical Sub-committee meeting of 3 February 1997.
MATTERS RAISED
* The hiring of consultants to critique the EIS has been done.
* Video is well and truly under way. Russell Winlaw noted that all the footage has been shot and text has been prepared and recorded. Likely to be complete within a couple of weeks. Good quality film running for about fourteen minutes.
Further consideration should be given to the distribution of the video. Target audience is Canberra, Macquarie Street and the community. Sub-committee should be formed (using core of Technical Sub-committee and Sharon Cullis as well as Federal and State MPs and other experts as need be).
Discussion held as to the emphasis of the video.
Resolved that the video be shown at the next meeting.
* Consultation with other groups late March. Minister cannot attend but gave name of Mike Conway of DUAP's Airport Monitoring Unit to critique the EIS. Will be contacting Councils.
* Position Paper No. 2 on the emerging environmental record of the current Federal Government. Draft to all members for comment. To use when visiting Canberra.
* Newsletter: First one very well done. Thanks to Tim Stewart of HCC.
Question raised as to input from people in the gallery. Participation in the CRASH meetings was by invitation only. Minutes show that it is a select Committee from the Councils. To be discussed in General Business.
4. Community Co-ordination Sub-committee meeting of 30 January 1997.
* Community groups have been active in their communities.
* New signs have been distributed and posted around. Also posters, postcards, sausage sizzles are planned. Meetings with Rust PPK and Snowy Mountains Engineering Corporation (SMEC) are proposed. All invited to 'Edge of the Runway" garden party - money raiser.
* Communications through CRASH will help new groups find their feet quickly.
* Question raised as to how Community Co-ordination Sub-committee relates to CRASH when it comes to resolutions. To be discussed later in meeting.
* The venue for the Community Co-ordinator was discussed.
* Request that Community Co-ordination Sub-committee meet with the Finance Sub-committee to discuss commitments.
* Have formulated a port folio to present to politicians and prominent people. Eight pages of colour photocopied photo's inciting comment about Holsworthy and appendices giving supporting information for each picture. To give their point of view and trying to find another way of addressing each issue to politicians. Finalisation of port folio will coincide with Canberra visit in May.
Resolved:
1. That the Community Co-ordination Sub-committee accept Bankstown City Council's offer to help with the copying of port folios. All activities should be done as one campaign and need to work out best way to do it.
2. That the Community Co-ordinator provide CRASH with a Concept Paper and, report regularly to CRASH just as the other Sub-committees, so issues of Community Co-ordination Sub-committee are directly addressed at the CRASH meetings.
3. That all Councils are in agreeance for the Community Co-ordinator, Phil Smith to be located in Sutherland and community groups are happy that he is based at Sutherland but will move around in his work.
4. That CRASH write to member Councils seeking their support by way of providing the Community Co-ordinator with desks; chairs; telephone lines, computer; printer; photocopier; signs etc.
5. That a special meeting of the Finance Sub-committee be held to discuss the distribution of Wollong City Council's contribution.
6. That previous CRASH minutes be forwarded to Wollongong City Council for their perusal.
7. That in regard to National Media coverage, it was noted that the ABC is building a major story; they are not interested in small articles.
5. Release of Flight Zones
Resolved that CRASH support the following proposals:
A: That following the release of the flight zone proposals for the Holsworthy options, there be major public meetings held in each local government area affected by Holsworthy airport just as there were for the proposed new flight paths for KSA:
B: That such meetings be conducted in the following matter:
* convened and chaired by CRASH or council representatives from the affected LGA;
* Cabinet members be invited to represent the government;
* held in conjunction with Rust PPK as a formal part of the environmental assessment process;
* attended by the panel of experts working with Rust PPK on the EIS as well as representatives from the Commonwealth Department of Transport and Environment Protection Agency;
* each local council ensure that comprehensive information about the local impacts of proposed flight paths be disseminated in its LGA, should Rust PPK fail to do so;
* each local council be requested to advance this agenda with Rust PPK, SMEC and the media.
6. FOI Application
Refused access to information on Holsworthy from the Government. After all avenues have been exhausted, will follow legal action. Administrative Appeals Tribunal.
7. Future Rallies
There will be a CRASH rally but should be organised by the community. $6,000 has been budgeted for the public rally and is planned to coincide with the release of the EIS. Phil Smith to produce a timetable. To be treated as a matter of urgency so that it is all ready to go when it is needed.
8. Delegation to Canberra
Clr Rodden reported that a delegation went to Canberra and there was no good news. Badgerys Creek was on the bottom of the list and there was no thought that Holsworthy would be wiped off. Phil Smith reported similar responses and contradictory messages.
Suggested that CRASH arrange a bus with all Mayors, Federal and State MP's to go to Canberra with the video with the aim of speaking to the Prime Minister, also advising the media of the trip. Also suggested that Community Group members of CRASH follow behind in their cars with banners to draw more attention to the trip.
1. Resolved that CRASH write to each State and Government MP and each council Mayor telling them of CRASH's plan, and ask if they would be willing to participate in a bus to Canberra at the same time taking the video.
2. Resolved that the matter be referred to the Technical Sub-committee and Clearing House who will report back to CRASH.
3. Resolved that the Technical Sub-committee assess dates quickly (mid march) considering when Parliament is sitting and obtain a larger list of all MP's and ascertain what their position is in relation to Holsworthy.
9. Community Awareness Approach
* Feedback from Member Councils on Generic Brochure
Councils should be aware that when communicating with Creative Image Printing, they can put their name on the brochure. Councils are encouraged to still consider using the brochure.
* Preparation of Next Brochure
Are currently pulling together the information for the next brochure. A generic brochure with heavy technical information from the experts. Good images of pristine environment etc. There is more funding available for this brochure. Will bring quotes back to CRASH. May be able to produce enough for all Councils to distribute.
* Message on Council Envelopes
Some Council's have printed envelopes with message against Holsworthy proposal.
10. Correspondence

Letter from Alliance for Airport Location Outside Sydney Inc, who have formed an alliance against Badgery's Creek.
1. Resolved that CRASH re-endorse the original charter ie against Holsworthy.
2. Resolved that CRASH write to the Alliance for Airport Location Outside Sydney Inc on its stand ie against Holsworthy with no action being taken against Badgery's Creek.
10. General Business
Community Co-ordinator to liaise with Tim Stewart re newsletter. The newsletter is an information source for members of CRASH and all are invited to pass on relevant information for the newsletter which is finalised around the 20th of each month.
This meeting notes with concern that even in February, the Federal Government has not contracted the Auditor (SMEC) though its role as Auditor was publicly announced last year. We believe the Auditor should have been fully engaged in monitoring the entire EIS process of Rust PPK. We therefore, urge that the time for the EIS be extended and that the Auditor be contracted at once.
1. Resolved that a letter be sent to the Minister for the Environment to this effect.
2. Resolved that the independent auditor be invited to address CRASH.
* Mr Thorne from the Campbelltown Aboriginal Advisory Committee expressed the Group's concerns that there are aboriginal sites in the Holsworthy area. They would like these aboriginal sites identified so they can be protected.
1. Resolved that the Community Co-ordinator liaise with the two local Aboriginal Land Councils.
2. Resolved that CRASH write to Aboriginal Affairs and request any information that may be helpful to the Holsworthy issue.
3. Resolved that CRASH get access to the aboriginal reports submitted to Rust PPK with the view to getting access to the information.
* Further discussion on who can attend the meeting. A motion was put that members of CRASH, interested residents who belong to CRASH, members of Parliament, and groups opposing Holsworthy who live within the vicinity of the Local Government horseshoe area be allowed to attend the meetings.
Resolved that this matter be deferred to the next meeting.
* Issue of who can speak to the meeting from the gallery.

07.04 FORESHORE BUILDING ADJUSTMENT - 170 LUGARNO PARADE, LUGARNO (004127)

(See Item 7.01 of the Divisional Manager's No. 2 Report to the Development, Health & Planning Committee) In accordance with the provisions of Section 10(2) of the Local Government Act, 1993 IT IS RECOMMENDED that the Committee resolve under the terms of Section 10(2) of the Local Government Act, 1993 that for the reason that the matter relates to legal proceedings where Council's interests may be prejudiced by publicity, the press and the public be excluded from that part of the Finance Committee Meeting at which this matter is considered. That in accordance with the provisions of Section 11(2) of the Local Government Act, 1993, the reports and correspondence relating to this matter be withheld from the press and the public.
IT IS FURTHER RECOMMENDED that the matter be referred to the Council for consideration in Committee of the Whole.

ADDENDUM
07.05A DISPENSARY BUILDING - 17 MACMAHON STREET, HURSTVILLE A letter was received by the National Trust dated 10th March, 1997 which requested that Council take urgent action in relation to conserving the dispensary building at 17 MacMahon Street, Hurstville.
Specifically the letter notes:
"The Trust strongly urges that Council place this building and its interiors and fittings on the Schedule of Items of Environmental Heritage accompanying the Hurstville Local Environmental Plan.
To afford the building proper interim protection during this process the Trust urges Council to apply to the Heritage Office of New South Wales for the making of an Order under Section 130 of the Heritage Act on the building and its interiors and fittings. This is a standard procedure to provide temporary protection while listing on Council's own Heritage Schedule is being processed."
In this regard, discussions have been held with Council officers and the Senior Conservation Officer of the National Trust who essentially advised that the making of an Order under section 130 of the Heritage Act should protect the subject property until it can be placed on Council's own list within the LEP. An Order under section 130 of the Heritage Act has a life of 12 months only, and for this reason, a draft local environmental plan should be initiated as soon as possible. This draft plan could also involve the placement of several other sites onto Council's List of Heritage Items (Schedule 2 - Hurstville LEP 1994); this is far more efficient than placing sites on the schedule one at a time. Council could, at this point, take the opportunity to carry out a review of numerous properties with a view to updating the list of heritage properties presently protected under the provisions of the LEP.
The application forms and documentation to accompany the Order under section 130 of the Heritage Act has been obtained and will be completed subject to Council's resolution.
Significance of the Building
The Heritage Study 1988 noted that the building was an "early Edwardian style with some Federation influence - first floor brickwork and render main elements of value. Important building in the growth of Hurstville."
The National Trust Classification Card outlines the following in its statement of significance:
"The Hurstville and Districts United Friendly Societies' Dispensary building is an outstanding example of an early twentieth century combined dispensary/lodge room with interiors largely intact. The MacMahon Street dispensary is the earliest, principal and sole survivor of an original group of four H.A.D.U.F.S. dispensaries in Southern Sydney. H.A.D.U.F.S. became the second largest dispensary in New South Wales. The MacMahon Street Dispensary is the only known example of an institution/commercial building designed by noted local Hurstville architect Charles H. Halstead. The building, its fittings, lodge artefacts and historic pharmaceutical collection provide evidence of the social and cultural significance of the various Friendly Societies and Lodges, their operation, civic role, contribution to the development and well being of the Southern Sydney Region and the technical operation of an early twentieth century dispensary. The dispensary together with the adjoining Doctor's House, Fire Station and Police Station form an important civic group in the streetscape opposite the Hurstville Civic Centre."
The building is considered to be of Local, Regional and State significance by the National Trust and for this reason it is recommended that moves be made toward retaining this building and its fittings.

. Recommendation DISPENSARY BUILDING - 17 MACMAHON STREET, HURSTVILLE RECOMMENDATIONTHAT Council resolve to make application for an Order pursuant to Section 130 of the Heritage Act with respect to property 17 MacMahon Street, Hurstville being the old dispensary building.
FURTHER THAT Council review the current list of properties on Council's 1988 Heritage Study with a view to determining what additional properties may be added to Schedule 2 of Hurstville Local Environmental Plan 1994.
