HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.01 ENGINEERING

04.03.01 PARK STREET AT FOREST ROAD, PEAKHURST (T/00979)

At the last Traffic Advisory Committee meeting concerns raised by Councillor G. Stoddart regarding the safety of the marked footcrossing on Forest Road at Park Street were considered. Councillor Stoddart had indicated that northbound buses on Forest Road block the vision of pedestrians at the crossing, while on the east side of Forest Road, patrons of the Australia Post mail box caused other sight distance obstructions to pedestrians.

At the meeting it was agreed that the volume of pedestrians using this marked footcrossing was low and that as the combination of a refuge and zebra crossing often led to confusion for both motorists and pedestrians, the safest course of action was to remove the zebra crossing at the time of installation of the pedestrian refuge. The matter was then deferred for consideration of appropriate pedestrian and traffic counts to be prepared for the next Traffic Advisory Committee meeting. The following results have been prepared from the pedestrian survey undertaken at this marked foot crossing:

In addition to these concerns, Council has begun setting out the channelisation proposal for this intersection. It is proposed to install formal Bus Zones on both sides of Forest Road, south of the crossing at Park Street, to eliminate the problem of buses stopping on the crossing.

Since setting out the proposed channelisation, several shopkeepers became concerned regarding Council's proposed channelisation, and raised the issue of lack of parking for the Park Street shopping centre. Council has indicated to these shopkeepers that it will consider offsetting any loss of kerbside parking by introduction of One Hour period parking restrictions. The restrictions proposed are for the north side of Park Street from Forest Road to the end of the commercial premises, covering nine (9) parking spaces, and on the south side of Park Street, from Forest Road to the second driveway in Park Street, covering five (5) parking spaces.

At the time of preparation of this Agenda, insufficient responses have been received from Council's consultation program to determine the adjacent residents' and shopkeepers' attitudes to these proposals. More details will be available on the day of the meeting.

* Accordingly, this matter is referred to the Committee for its consideration.

The R.T.A. representative advised that there was no objection to retaining the marked footcrossing with the proposed installation of the proposed pedestrian refuge. Councillor Giegerl indicated that the bus zone restrictions should be implemented as soon as possible to eliminate the problem of buses stopping on the pedestrian crossing.

TRAFFIC COMMITTEE'S RECOMMENDATION

THAT the marked footcrossing not be removed at the time of installation of the pedestrian refuge and FURTHER THAT one hour period parking restrictions be implemented on the north and south side of Park Street, east of Forest Road, and that bus zone signs be installed in Forest Road south of Park Street as soon as possible.

04.03.01A PARK STREET AT FOREST ROAD, PEAKHURST (T/00979)

As indicated in Item 04.03.01 of this Works Committee Business Paper, a letterbox drop survey of residents and shop keepers in the Park Street area has been undertaken by Council in relation to proposals for channelisation, period parking and landscaping in the shopping centre. However, insufficient time was available in preparation of the Business Paper for a report on the results of the letterbox drop survey.

Eight responses were received, which is a disappointing result considering that reply paid mail envelopes were supplied. Only 26% of issued letterbox drop surveys were returned. The main channelisation proposal drew 5 objections in the survey. However, it is clear from the comments received in the responses that most of these respondents did not either understand or agree with Council's contention that the parking effect of the channelisation is the loss of only one space.

The suggestion for landscaping, footpaving and improved seating received only one (1) response in favour and two (2) in opposition. This gives no strong indication either way regarding this matter.

In relation to the proposed construction of angle parking on the north side of Park Street, four (4) responses were received in favour, with none opposed. Considering the expenses involved in this provision, this is also not a strong level of justification for the suggestion.

In relation to One Hour period parking, three (3) responses were in favour, with three (3) opposed. It is interesting to quote one resident/shop keeper who indicates that "I do not have anywhere to park other than in front of the shops and to lose one parking space as you say .... could be my parking space. To have One Hour parking what's going to happen to the shop owners, do they have to run out every hour to move their cars."

The proposed channelisation has been committed by Council to the R.T.A. for construction in the 1994/95 program. As previously indicated, this proposal has an negligible detrimental effect on the shopping centre, which can be offset by provision of period parking and possible angle parking. However, in view of the disappointing response from Council's letterbox drop survey, it is suggested that a meeting be arranged between Councillors, relevant officers and interested shop keepers regarding the issues of period parking, landscaping and angle parking.

04.03.01a Recommendation PARK STREET AT FOREST ROAD, PEAKHURST (T/00979)


RECOMMENDATION

THAT Council arrange a meeting with interested Councillors, relevant Council officers, and interested shop keepers to clarify their desires for the possible provision of:

* Period Parking.
* Landscaping/paving/seating.
* Angle parking.

FURTHER THAT Council proceed with the channelisation construction as agreed between Council and the R.T.A. FURTHER, THAT the respondents and all shop keepers be advised in writing of Council's recommendation, including supplying a copy of a plan showing the actual effect on parking caused by the channelisation.

04.03.02 COMMERCIAL ROAD AT KINGSGROVE ROAD, KINGSGROVE (T/00731)

At the last Traffic Advisory Committee Meeting representations concerning delays at this intersection were considered.

At the meeting the Roads & Traffic Authority supplied advice via facsimile that the proposed reconstruction of these traffic signals, including provision of right turn phases, would be carried out in June, 1995.

The Committee recommended:-

"THAT Council note the R.T.A's. advice and FURTHER, THAT No Standing be extended on the north side of Commercial Road, west of Kingsgrove Road, in the AM peak period only, for approximately 40 metres."

However, following completion of the Traffic Committee, further contact with the R.T.A. was made concerning the proposed new signal arrangements. The R.T.A. now indicates that a right turn phase will not be provided from Commercial Road, but rather a right turn phase for southbound traffic in Kingsgrove Road turning into Commercial Road will be provided. Officers of Council have made representations concerning the ongoing accident record, and traffic delays, of the right turn from Commercial Road into Kingsgrove Road.

At the Council Meeting held on 26th April, 1995, Council resolved:-

"THAT the Divisional Manager's recommendation be adopted and FURTHER, THAT representations be made to the R.T.A. to ensure right turn phases from both Commercial Road and Kingsgrove Road are provided in the proposed traffic signal works."

* Accordingly, this matter is referred to the Committee for its notation.

04.03.02 Recommendation COMMERCIAL ROAD AT KINGSGROVE ROAD, KINGSGROVE (T/00731)

04.03.03 ILLAWARRA RETIREMENT VILLAGE (HANNONS PADDOCK DEVELOPMENT)
AT PRITCHARD PLACE, PEAKHURST (T/00996)

At the last Traffic Advisory Committee Meeting, Councillor B. Giegerl passed on concerns regarding traffic, from the President of the Illawarra Retirement Village Trust.

Council officers have investigated these concerns and they relate to two traffic problems:
1. The T junction where Pritchard Place separates into its two cul-de-sacs, apparently is the site of regular confusion as to which movement should give way. It is suggested that consideration be given to clarifying priority by implementation of a Give Way sign.

2. At the intersection of Stanley Street and Lorraine Street, motorists often cross the double white centrelines, causing concern to residents turning in and out of the retirement village driveway. It is suggested that raised pavement markers be implemented on the double white centreline.

* Accordingly, this matter is referred to the Committee for its consideration.

TRAFFIC COMMITTEE'S RECOMMENDATION

THAT Council implement a Give Way sign and linemarking controlling the eastern arm of Pritchard Place and FURTHER, THAT reflective raised pavement markers be implemented on the centreline at the corner of Stanley Street and Lorraine Street.

04.03.03 Recommendation ILLAWARRA RETIREMENT VILLAGE (HANNONS PADDOCK DEVELOPMENT)

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.04 ENGINEERING

04.03.04 CHAMBERLAIN STREET, NARWEE (T/00714)

At the last Traffic Committee Meeting, consideration was given to concerns from residents of Chamberlain Street regarding traffic congestion in Chamberlain Street, the lack of 40 km/h School Zones and the impact of teachers and students parking in the street.

Council adopted the Traffic Committee recommendation at its meeting held on 26th April, 1995:-

"THAT Council approve the following actions, and further information be considered at the next Traffic Advisory Committee Meeting.

1. Investigate the options for traffic calming in Chamberlain Street, including a wombat crossing, 40 km/h School Zone, angle parking and one way traffic flows and their impact on Narwee Shopping Centre improvements.

2. Liaise with Narwee High School regarding the possible increase in on site parking for teachers and students, and also seek the school's co-operation in sharing the parking load between Chamberlain Street and Mountview Avenue.

3. That in conjunction with Canterbury Council, warning signposting for the two schools and the pedestrian signals on Broadarrow Road be reviewed."

At the time of preparation of this agenda, pedestrian and traffic counts are being undertaken. Also, a meeting with the Principal of Narwee High School in order to progress item 2 above is being arranged prior to the Traffic Committee. Results of the survey and meeting with the school principal will be available on the day of the meeting.
* Accordingly, this matter is referred to the Committee for its consideration.
Traffic and pedestrian counts tabled at the meeting showed justification for a wombat crossing to be implemented in Chamberlain Street, with a 40 kmp School Zone. The counts did not support a pedestrian crossing being installed on either Mountview Avenue or Broadarrow Road. Also, at the meeting with the Principal of Narwee High School, discussion regarding item No. 2 above resulted in the school advising that they propose to provide a security fence on the southern, western and northern boundaries of the school. This would prevent the possibility of student or teacher parking in Mountview Avenue as suggested.
TRAFFIC COMMITTEE'S RECOMMENDATION
THAT Council approach the Department of Education with the following package of proposals:

1. That the proposed security fence for Narwee High School be the subject of a Development Application to Council;

2. That the proposed security fence for Narwee High School incorporate a new vehicular access from Mountview Avenue to the school car park;

3. That this driveway be used for both vehicular and student access to and from the school;

4. That Council install a raised wombat crossing in Chamberlain Street together with a 40 kmh School Zone;

5. That Council review, in consultation with the bus proprietor, the location and length of bus zones in Mountview Avenue;

6. That Council install supplementary school warning signs in Broadarrow Road; and

7. That angle parking and one way traffic in Chamberlain Street be deferred for further consideration in conjunction with plans for enhancement of Narwee Shopping Centre.

FURTHER, THAT this package of treatments is to be seen as a complementary group of interlinking proposals, as such it is not possible to delete any item without also negating agreement to the other items.

HURSTVILLE CITY COUNCIL RECOMMENDATION NO: 04.03.04 ENGINEERING

04.03.04 Recommendation CHAMBERLAIN STREET, NARWEE (T/00714)


RECOMMENDATION

THAT the Traffic Advisory Committee's recommendation be adopted.

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.05 ENGINEERING

04.03.05 KIMBERLEY ROAD, HURSTVILLE - BUS STOPS (T/00859)

At the last Traffic Committee Meeting, representations received from Clr. Stoddart concerning the location and number of bus stops in Kimberley Road, between Croydon Road and Wellington Road, were considered. It was suggested that the bus stops in the middle of this block on both sides of the road could be deleted due to lack of use, and their proximity to other bus stops.
The Department of Transport investigated this matter and found that the bus company advised that patronage from passengers is received from all bus stops in the section of Kimberley Road. Also, the bus stops have been in existence for several decades. The Department, therefore, requested that no alteration be made to the bus stops. The Traffic Committee recommended:-
"THAT the Department of Transport's advice be noted."
Council, at its meeting held on 26th April, 1995, resolved:-
"THAT Council make further representations to the Department of Transport to seek removal or relocation of midblock bus stops in the section of Kimberley Road."
It was indicated by Clr. Stoddart that on the north side of Kimberley Road, the midblock bus stop could easily be relocated to the eastern end of the block, to be located alongside the side boundary of a property fronting Croydon Road. This would involve relocating the bus stop approximately 80 metres, which should not inconvenience passengers at this location. Clr. Stoddart also reiterated advice that the three (3) bus stops on the south side of Kimberley Road, between Croydon Road and Wellington Road, were excessive and little used. It is suggested that a detailed survey of passenger activity at this bus stop be sought from the Department of Transport.
* Accordingly, this matter is referred to the Committee for its consideration.

TRAFFIC COMMITTEE'S RECOMMENDATION
THAT Council take no further action on this issue at this time, as this issue is the result of a dispute between the resident and the bus company.

HURSTVILLE CITY COUNCIL RECOMMENDATION NO: 04.03.05 ENGINEERING

04.03.05 Recommendation KIMBERLEY ROAD, HURSTVILLE - BUS STOPS (T/00859)


RECOMMENDATION

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.06 ENGINEERING

04.03.06 PONDEROSA PLACE, LUGARNO (T/00993)

A resident of Ponderosa Place has requested implementation of No Standing signs in Ponderosa Place, following completion of the roundabout at the intersection of Forest Road and Old Forest Road, Lugarno.

The resident indicates that parking on both sides of Ponderosa Place is prevalent throughout the week, due to the activities of the Baptist Church on the corner of Ponderosa Place and Forest Road. It is suggested that Council consider implementation of No Standing signs on both sides of Ponderosa Place, from the boundary of properties No's 4 and 6 , to Forest Road.

* Accordingly, this matter is referred to the Committee for its consideration.

TRAFFIC COMMITTEE'S RECOMMENDATION

THAT due to very low traffic volumes in Ponderosa Place, and that the roundabout construction at Old Forest Road and Forest Road has not disadvantaged Ponderosa Place in any way, that no action be taken.

HURSTVILLE CITY COUNCIL RECOMMENDATION NO: 04.03.06 ENGINEERING

04.03.06 Recommendation PONDEROSA PLACE, LUGARNO (T/00993)


RECOMMENDATION

THAT the Traffic Advisory Committee's recommendation be adopted.

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.07 ENGINEERING

04.03.07 BOUNDARY ROAD AT WORONORA PARADE, OATLEY (T/00681)

Clr. M. Ficarra, M.P. has passed on representations from a resident concerning pedestrian safety on Boundary Road near Woronora Parade. The resident indicates that a pedestrian crossing or traffic signals should be implemented at this location, due to the amount of traffic on Boundary Road.

This site is already facilitated with a central pedestrian refuge in Boundary Road. Council is presently undertaking traffic volume and speed surveys at this location. The results of these surveys will be available on the day of the meeting.

* Accordingly, this matter is referred to the Committee for its consideration.

Traffic counts were tabled which showed that traffic volumes on this section of Boundary Road had not altered significantly before and after the construction of the new Boundary Road railway overbridge. Also, heavy vehicle counts taken showed that there was no change in the use of truck traffic in this location. This average varied between 5% to 10% of heavy vehicles along Boundary Road. However, Council's survey showed that the 85th%ile speed in this section of Boundary Road was 66 km/h.

TRAFFIC COMMITTEE'S RECOMMENDATION

THAT as pedestrian volumes are light at this location, the existing pedestrian refuge was the most appropriate pedestrian facility. FURTHER, THAT the existing refuge be enhanced by replacement with modern bollards and FURTHER, THAT the speed survey results be forwarded to the Police Service for their appropriate attention.

04.03.07 Recommendation BOUNDARY ROAD AT WORONORA PARADE, OATLEY (T/00681)

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.08 ENGINEERING

04.03.08 PARK STREET AT BELMORE ROAD, PEAKHURST (T/00979)

A resident of Park Street has written seeking consideration of problems in Park Street at the intersection of Belmore Road.

The resident indicates that cars are frequently parked on both sides of Park Street in close proximity to Belmore Road, leaving only one lane of traffic in Park Street. This leads to numerous head on confrontations and near misses, particularly as motorists enter Park Street from Belmore Road too quickly due to the speed of traffic flow in Belmore Road. The resident suggests that parking restrictions be implemented for approximately 25 metres from Belmore Road, or that a centreline needs to be implemented.

Further, the resident suggests Council consider treatments undertaken by Kogarah Council in narrow streets on the east side of Kogarah Bay. Kogarah Council has implemented on-footpath paved parking bays, which provide the same number of parking spaces in the street as previously existed, but leave the full carriageway of the street for through traffic.

* Accordingly, this matter is referred to the Committee for its consideration.

TRAFFIC COMMITTEE'S RECOMMENDATION

THAT No Standing, for standard school finishing and starting times only, be installed on both sides of Park Street, for approximately 25 metres from Belmore Road.

04.03.08 Recommendation PARK STREET AT BELMORE ROAD, PEAKHURST (T/00979)

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.09 ENGINEERING

04.03.09 MACQUARIE PLACE AT MORTS ROAD, MORTDALE (T/00901)

Council has received representations concerning traffic problems in Macquarie Place at Morts Road. The complainant requests installation of centreline markings in order to prevent the practice of motorists turning left from the right hand side of the road, and motorists turning right from the left side of the road. The complainant further suggests implementation of left arrows in the left lane and right arrows in the right lane.

Macquarie Place at the intersection of Morts Road is narrowed by kerb blisters, to be 8 metres wide. This enables two vehicles to enter Morts Road at a time, but due to the swept path for buses and other large vehicles, such vehicles may need to make their manoeuvre from the incorrect side of the road. In this regard, the Motor Traffic regulations indicate that a motorist should make a left turn from the furthest practicable left side of the carriageway, and similarly their right turns. Due to the large swept path of buses and delivery trucks, such vehicles may legally turn left from the right side of this one way street or right from the left side of this one way street. Therefore, it may be confusing to provide centreline markings and turn arrows.

* Accordingly, this matter is referred to the Committee for its consideration.
TRAFFIC COMMITTEE'S RECOMMENDATION

THAT as the Motor Traffic Act already required motorists to turn left and right from the corresponding side of the carriageway, linemarking was not appropriate.

HURSTVILLE CITY COUNCIL RECOMMENDATION NO: 04.03.09 ENGINEERING

04.03.09 Recommendation MACQUARIE PLACE AT MORTS ROAD, MORTDALE (T/00901)


RECOMMENDATION

THAT the Traffic Advisory Committee's recommendation be adopted.

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.10 ENGINEERING

04.03.10 BAUMANS ROAD AT MEADOWLANDS ROAD PEAKHURST (T/00652)

Council has received correspondence from a resident of Baumans Road concerning a recent pedestrian accident at this intersection.
The resident advises that this intersection is at the crest of a hill and that traffic should be slowed by speed humps, signs or some other facility.

THAT due to recorded low traffic volumes and speeds in both Baumans Road and Meadowlands Road, no action be taken.

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 04.03.11 ENGINEERING

04.03.11 TRAFALGAR STREET, PEAKHURST (T/01075)

Mr M. Iemma, M.P. has passed on representations from a resident of Trafalgar Street who is concerned about traffic congestion and safety on weekends during the football season.
The representations indicate that there is concern about illegal parking when Peakhurst Park is in use, and the difficulties this causes for residents in manoeuvring in and out of their driveways.
* Accordingly, this matter is referred to the Committee for its consideration.

Mr M. Iemma, M.P. has forwarded on two letters from residents of Napper Avenue concerning parking problems in the street. The letters also comment on traffic issues in Erskine, Littleton and Thurlow Streets, which are to be the subject of consideration in the Riverwood L.A.T.M. Scheme.
The specific concerns related to parking in Napper Avenue, are due to commuters using the street for all day parking. This causes difficulty for many residents in accessing their driveways.

Council has received correspondence from a resident on the corner of Pallamana Parade and Cooloongatta Road concerning vehicles cutting the corner.
This matter was considered approximately 12 months ago when Council included this intersection in its submission for minor intersection sign treatment programs to be funded by the R.T.A. This program involved implementation of short sections of central median at cross intersections, which eliminate corner cutting. Unfortunately, the R.T.A. did not fund any such treatments in the Hurstville area this financial year.
The resident has been advised of this, but indicates that the problem is severe, particularly for southbound traffic in Cooloongatta Road turning right into Pallamana Parade. This movement is increasing due to traffic congestion on King Georges Road at the M5 intersection.
Council could at this stage consider implementation of a traffic dome, or implementation of the central median as proposed by the R.T.A.'s program.
* Accordingly, this matter is referred to the Committee for its consideration.

The Principal of Hurstville Adventist Primary School has written seeking implementation of Bus Zone signposting during school hours, 8.15 am to 3.00 pm in front of the school and church.
It is indicated that the school is concerned with the safety aspects of their mini buses on school property. It is considered to be safer to park the buses in Wright Street to allow children to access the buses from the footpath.
The request also raises the issue of whether or not the school's vehicles should be parked on street throughout the day.

Council has received representations from the Highway Safety Action Group of New South Wales, concerning pending State Government regulations to give self regulation to the road transport industry.
The Highway Safety Action Group is concerned about this issue due to the potential for trucks to be able to load to any limit causing damage to local roads, costing Councils increased maintenance funds, and also in particular that bigger, heavier trucks pose a greater threat to community road safety.
The Highway Safety Action Group seeks Council's support in making political representations to prevent self regulation in the road transport industry from being permitted.

04.03.16 R.T.A. ROAD NETWORK STRATEGY

At the Traffic Committee Meeting held on 2nd February, 1995, consideration was given to the State Road Network Strategy which sought the community's consultation regarding the aims, goals and priorities for the Roads & Traffic Authority's activities.
Council subsequently considered a detailed report concerning the proposals behind the State Road Network Strategy. Council resolved to consider at a future Traffic Advisory Committee Meeting, a report detailing the implications of the State Road Network Strategy for Hurstville Council.
The State Road Network Strategy has the following implications for this area:
1. M5 East. The Strategy indicates that priority will be given to this link, which will create an effective freight and traffic route from Sydney's south west to the central industrial area. Hurstville Council has conditionally supported construction of the M5 East, so this priority is considered to be appropriate.

2. King Georges Road. The State Road Network Strategy indicates that King Georges Road, as part of Met Road 3, is an important Sydney circumferential route. However, the R.T.A. have indicated that the widening of King Georges Road between Beverly Hills and South Hurstville from its present four lane configuration to a six lane divided carriageway is not in its present five year plan. Council could consider making representations to the Authority regarding this low priority.

3. Stoney Creek Road. This road has a low role in the State Road Network Strategy, due partially to the fact that the M5 East is parallel to it, and also that it is not part of Sydney's Met Road system. The present R.T.A. five year rolling works program does include reconstruction of the intersection of Stoney Creek Road and King Georges Road. However, given the uncertainty regarding the future construction of the M5 East, Council could consider making further representations regarding the M5 East and the condition of Stoney Creek Road. In particular, concern is raised at the on-going use by high volumes of heavy transport freighters through the residential areas surrounding Stoney Creek Road .

The R.T.A. State Road Network Strategy has a statewide perspective and accordingly, there is no other direct effect upon the Hurstville Council area in it. However, another issue which could be considered is the R.T.A.'s focus on its "core business" of the State Road network system. The R.T.A. has been consistently moving away from its role as a traffic authority relating to traffic conditions on the majority of the State's roads, the local road network. Council may wish to consider making representations to the Authority regarding this future direction.

* Accordingly, this matter is referred to the Committee for its consideration.

TRAFFIC COMMITTEE'S RECOMMENDATION

THAT Council make a submission to the R.T.A. as follows:

1. Reiterating Council's conditional support for construction of the M5 East;

2. Increasing the priority of completion of construction of widening of King Georges Road south of Beverly Hills;

3. Stoney Creek Road and the local precincts surrounding Beverly Hills be treated for the ongoing use by high volumes of heavy transport traffic (identified in Council's submission to the R.T.A. regarding the M5 East).

FURTHER, THAT Council indicate that the Authority's focus on its "core business" of the State Road network is reducing the Authority's effectiveness in traffic issues on the majority of the State's network, Local Roads.

04.05 SYDNEY OLYMPICS 2000 - STRATEGIC TRANSPORT PLAN (C/00103)

At the Executive Committee Meeting held on 26th April, 1995, Mr. Jock Murray, the Project Director - Olympic Transport, attended to give Council officers a briefing on the development to date on the transport plan for the Sydney Olympics.

Mr. Murray attended Council as part of an ongoing commitment for consultation with local authorities. Mr. Murray also indicated that he would be available to give presentations to a full meeting of Council if desired.

Mr. Murray indicated that three (3) client groups of attendees at the Olympics' venues have been identified. These were:-

* The Olympic Family, which comprises Olympic Committees, International Federations, I.O.C. Secretariat, athletes, judges, media, top sponsors and their guests, organising committees for future Olympic Games venues. This family is expected to number 65,000 people.

* Spectators. The Olympic Games are to be held during school holidays. It is anticipated that up to 400,000 spectators will attend the Olympic Games venues on any one day.

* Workforce. It is anticipated that between 30,000 and 80,000 people will be working at the Olympics venues on any one day.

The transport for the Sydney Olympics will have a strong public transport emphasis. A new high capacity rail station is to be constructed at Homebush. Also, direct free bus services will be provided. The Games' organisers have the intention of encouraging a single mode of transport from as far from the village as possible. Their aim is to achieve 85% of people attending the venues using public transport.

Plans for facilities and infrastructure around the Olympic site are in terms of Sydney's long term objectives. The Games' venues themselves are expected to draw crowds of over 60,000 people on 60 days per year in the years after the Olympics. This is a new magnitude of public facility provision in Sydney. The total number of car spaces provided is 10,000, which roughly equates to those presently available in Moore Park, near Sydney Showground.

The Department of Transport will therefore continue to promote public transport as the preferred method of access to the Homebush site.

Major road proposals to be completed by the time of the Olympics include an extension to Silverwater Road, with grade separation of at Victoria Road; upgrading a series of intersections along the existing Silverwater Road.; accesses to and from the Olympic venues from the M4 Motorway; grade separation of the intersection of Homebush Drive and Australia Road; grade separation of the intersection of Ryde Road and Victoria Road; completion of the M2 Motorway.

Major road infrastructure projects that are hopeful of being completed by the Olympics, but are not yet committed, include the M5 East Motorway, the intersection of Roberts Road, Hume Highway and Centenary Drive, and the Eastern Distributor. Considerable concern was expressed over the possibility that the M5 East would not be completed in time for the major transport role it will play in facilitating the Olympic Games.

Major implications for the Hurstville City Council area include the following points:-

1. Should the M5 East not proceed, major traffic flows will increase along Stoney Creek Road and King Georges Road in the years preceding the Olympics and particularly during the event.

2. Immediately prior to and during the Olympics, heavy vehicles from the Airport, Central Industrial Area and Port Botany will be diverted away from the Marrickville/Canterbury areas, through the Rockdale and Hurstville Council areas, to avoid disrupting general traffic around the Olympics.

3. During and immediately preceding the Olympics, routes between Hurstville and Sydney City will be subjected to severe traffic disruptions.

4. Hurstville City centre is seen as a major rail/bus interchange. It is possible that some transference of Olympic bound passengers will occur at this point, possibly with express bus services shuttling between Hurstville and the Olympic Village.

5. The possibility exists for development of a major car park on S.R.A. land between Hurstville and King Georges Road which could be used as a rail/car/bus interchange for access to the Olympic venues.

6. Beverly Hills rail station could be the site of interchange between rail and bus passengers generated by the Olympics, suggesting the possibility of enhancement of the existing poor interchange facilities presently provided at this location.

Mr. Murray advised Council officers that the present time was the appropriate moment to approach the State Government regarding road and public transport infrastructure in and around Hurstville, with the aim of facilitating operation of the Olympics. In this regard, Council should consider making representations regarding the following issues:-

1. M5 East Extension.

2. Development of surplus S.R.A. land between Hurstville and King Georges Road as a major commuter car park.

3. Seek the State Government's commitment to increase the level of rail freight transport of goods between Port Botany and Chullora.

4. Seek further information on the possibility of Beverly Hills rail station being used as a bus/rail interchange for access to the Olympic site, and if so, seek improved bus/rail facilities there.

Following a complaint from a resident, Sydney Electricity was requested to investigate the level of lighting in Simmons Road, Kingsgrove.

Although spacing of lighting standards is acceptable, due to the rise in the road at the end of the cul-de-sac, the level of illumination is inadequate and one (1) additional 50 watt mercury vapour lantern is recommended.

04.07 MASTER LOCKSMITHS ACCESS KEY SYSTEM (M.L.A.K.)

On Tuesday evening, 2nd May, 1995, I attended the Annual General Meeting of the Hurstville Access Committee chaired by the then Acting Mayor, Clr. Olah.

Of great interest to all present was an address given by Ms. Kylie Frazer, Community Services Planner, Pittwater Council, on the Master Locksmith Access Key System. The M.L.A.K. is a master key that fits into specially designed locks. Both the lock and they key have been developed by the M.L.A.A. to ensure that access to disabled toilets is available for use by persons who can obtain a key with a written authority from:-

* A doctor or hospital
* A disability organisation
* A local council or community health department
* The centre management or owner of a building with an accessible toilet on site
* Any other authorised person

The M.L.A.K. restricted access key system will ensure that only bona-fide people have access to a key. And as each key is numbered it will provide the maximum opportunity for lost keys being returned to the original owner via the locksmith.

All locks assembled, supplied or installed will be treated as a fully restricted system and will have standard installation requirements to facilitate easy opening.

The group in general and Clr. Olah in particular were very keen to see this system extended to Hurstville Council's toilet blocks and the disabled toilet in Barratt Street, Hurstville offers an excellent opportunity to trial the system.

The following letter has been received from Mrs. F.E. Wrighter, A.O.M., B.E.M., President of the St. George Women's Amateur Athletic Club:-

"It is with much regret that we advise that the St. George Women's Athletic Club has disbanded and we will no longer need the use of Hurstville Oval.

Over the past five years we have been struggling to keep up our membership and despite our efforts in advertising, handing our circulars to schools and Westfield Shopping Centre, visiting school sports etc. in an endeavour to enrol members we had very little response to our efforts, and we were unable to enrol more members. Also we had very little response from parents to assist with officiating. Without athletes and officials it was not possible to carry on

This is very sad for our remaining members as we have been in existence for 68 years and have had many champions as members of our Club, including the very first woman to represent Australia at an Olympic Games. So to have to disband the Club after so many years was indeed a very hard decision to make.

We wish to sincerely thank Hurstville Council for the tremendous help and co-operation given to us over so many years, as a foundation member of the Club I know just how much you assisted us, and this help is greatly appreciated. Many thanks."

04.11 FOOTPATH CONSTRUCTION PROGRAM 1995/96

His Worship the Mayor has received a request for a concrete footpath to be constructed in the vicinity of No. 12 Roberts Avenue, Mortdale. This request has been reviewed by Clrs. Stewart and Bailey who have, in turn, requested that it receive a high priority in the 1995/96 Program of Works.

Clrs. Stewart and Bailey have also requested that the provision of footpaths in Boundary Road to link the new pedestrian footway on the railway overbridge with existing paths in Pitt Street and Woronora Parade receive high priority.

It will also be recalled that Clr. Lynch, at Council's meeting held to consider the 1995/96 budget, requested that footpath works in Dudley Street, Hurstville, be included and it has also been resolved that other footpath projects which could not be accommodated in the 1994/95 budget be included in the 1995/96 Program.

As was detailed in Item 4.20 of the Divisional Manager - Engineering's report to Works Committee dated 18th January, 1995, an application for financial assistance was recently submitted to the Department of Employment, Education and Training (D.E.E.T.) for the upgrading of Mortdale Park.

"Operation Restoration" is designed to assist the restoration of many of Australia's aging war memorials, remembrance driveways and memorial parks, and D.E.E.T. have recently offered Council $56,100 towards the cost of the project. This will pay for wages, training, and construction materials used in the project, which was an estimated total cost of approximately $102,000.

The closure would be between MacMahon Street and the Palm Court car park.

The closure will involve a parade on Sunday morning which would be marshalled in MacMahon Street, therefore requiring closure of MacMahon Street between Dora Street and Park Road on Sunday morning.

Two (2) complaints have recently been received by Council regarding the collection of fees for the use of public carparks at Olds Park. Both parties object to being requested to pay to park on weekends while they watch their sons/daughters play sport.

It is understood those collecting the fees are linked to the St. George Australian Rules Football Club who currently have a lease agreement on the Park. It is also understood that the lease agreement does not cover the issue of car parking fees, and for this reason, both complainants have been told that they are quite within their rights to refuse payment.

Council, at its meeting of 26th April, 1995 considered a report which contained the following:

"....All the above issues have been resolved to the satisfaction of myself and the Association with the exception of the fees imposed on the Association for the use of Smith Park for training.

The normal fees imposed on the Association for the 1994 winter season were $32/court/season. This allowed for competition games on weekends as well as midweek training. However, the Association play no competition games on the two (2) courts at Smith Park but do use them for midweek training. It is proposed that courts used for purely training purposes be hired out at a rate of 50% of the normal court charges (i.e. in this case $16/court/season)."
Council subsequently resolved:-

"THAT the information be noted and FURTHER , THAT no further action be taken at this stage pending a review of courts being used for training purposes only."
There are four (4) venues used for netball competition and/or training in the city area. They are Olds Park, Penshurst Park, Jubilee Park, and Smith Park. Smith Park is the only one used purely for training purposes and contains two hard courts with night lighting but attracts no income, because in the past, income has only been drawn where competition occurs. The two (2) clubs currently training at Smith Park are the Baptist Women's Netball Club and Hurstville United Netball Club. In the interests of fairness and recouping some costs associated with the maintenance and night lighting of the Smith Park Netball Courts, it is suggested a nominal fee be imposed as detailed above.

A request has recently been received fromthe owner of 164 Penshurst Street, Penshurst, for a contribution toward the replacement of the boundary fence, which adjoins Gifford Park.

Council's policy in regard to this matter is as follows:

"(a) Major Public Damage

Where fence has been broken by public, such as cars using Council carparks, and life of fence has been greatly reduced, a contribution of 1/4 to 1/2 cost is recommended."

In this instance, ball games within Gifford Park have certainly contributed to the poor condition of the fence and its life has clearly been reduced.

The owner wishes to replace the existing fence with a colourbond steel fence. This will result in a more private boundary fence at a reduced cost.( Councils' Policy extends to meeting half cost of an equivalent 1.8m paling fence)

2. Recommendation: That the application be deferred for inspection and report by the Ward Councillors.

3. Eight (8) letters and a petition containing 33 names were received as objections from neighbours.

4. Letter of explanation received from applicant.

This application was initially considered by Council at its meeting of 18th January, 1995. Initial application was to subdivide this existing large battleaxe lot into three (3) battleaxe lots and was refused by Council. A copy of this Council report for that meeting follows:-

"Precis of Report:
1. Application is to subdivide an existing battleaxe lot into three (3) battleaxe lots.

2. Recommendation: Refusal

3. Seven (7) letters of objection received from neighbours.

Initial Application

Application is to subdivide an existing battleaxe lot with water frontage into three (3) battleaxe lots, with one of these lots containing the existing residence and swimming pool.

Section 90

The site has been inspected and the proposal examined in accordance with the provisions of Section 90 of the Environmental Planning & Assessment Act, 1979, and the following comments are submitted for consideration.

In accordance with Council's policy, the adjacent neighbours were notified of the subdivision application and, at the expiry of the 14-day notification period, seven (7) letters of objection have been received by Council. Copies of these letters are attached as Appendix C to this report.

These objections range from:-

1. Environmental impact on local area;

Comment: The site is in a very prominent position when viewed from the river and is heavily treed and in parts steeply sloping. Should the subdivision be approved then future applications to erect dwellings on the three allotments created would be likely to remove an excessive number of trees and result in scarring of the landscape to provide suitable building platforms.

2. Danger of damage to adjoining properties during excavation;

Comment: This objection may not be valid subject to the use of suitable building techniques under adequate building/engineering supervision.

3. Access to Southern Street, creating traffic nuisance;

Comment: This objection has some validity as possible dual dwellings on the new lots created could result in an additional four (4) such dwellings all sharing a 2.44 metre wide access handle as opposed to Council's code requirement of 6 metres wide (or at least 3 metres wide with appropriate passing bays). Although the subdivision of the existing allotment was originally approved in 1959 incorporating the now "undersized" access handle this approval was granted prior to the adoption of Council's code and was granted for the purpose of one (1) allotment and therefore one (1) dwelling only. The gradient of the access also appears to exceed Council's requirements.
4. Overloading of main sewerage line;

Comment: There is no evidence to support this claim.

5. Traffic and parking problems in Southern Street;

Comment: Due to the difficulties relating to access to the site outlined above it is very likely that visitors and indeed residents may park in the street as opposed to on site thereby exacerbating parking problems in the street.

6. The high density housing which will result.

Comment: As indicated above if the subdivision is approved applications could indeed be submitted for medium density dual dwellings on each of the three allotments.

Further Information Sought

This subdivision application was initially received by Council on 23rd August, 1994 and, as there were several obvious points why it would not be approved, a meeting was held between the Divisional Manager - Engineering, Mr. Chris Little, Manager - Planning Services, Mr. Michael Buckley, and myself to discuss these points. The following letter was then posted to the applicant:-

"As was agreed at your meeting on 6th October, 1994 with Mr. Jack Kavanagh, Council's Manager - Development Advice, an additional meeting was held on 10th October, 1994 between senior staff of Council to discuss your proposed Subdivision application at the above address.

At this second meeting, several points were discussed, and these must be addressed by you before your application can be submitted to a Council meeting, otherwise I would have no alternative but to recommend that the present application, if submitted, be refused.

These points are:-

1. Each lot must have a minimum area of 550m² exclusive of permissive occupancy area and the access handle areas.

2. Each lot must have an area of 18m x 15m where the dwellings are to be located.

3. The combined access handle width to be 6.0m as required by Council's Subdivision Code or, if approved by Council, 3.0m with a suitably located passing bay of size 6.0m x 3.0m with 45^o splays at each end.

4. The grade of the access handle ramps is to be no steeper than 1:5, and three (3) copies of a profile drawing of the proposed access ramps from the garage to the centreline of the roadway, on a scale of 1:20 natural, is to be submitted for each access ramp. These profiles to be prepared by a competent Engineer/Surveyor.

5. Each lot must have a turning area to allow all vehicles to enter and exit in a forward direction.

6. The Foreshore Building Line is to be shown on the proposed subdivision plans and it is located 15.24 metres from the "old" High Water Mark.

7. No habitable building can be constructed between the Foreshore Building Line and the "old" High water Mark.

It was noted that the first 17.374m length of the combined access handle measured from Llewellyn Street is only 2.44m in width and does not meet Council's Code width of 3.0m minimum.

As this 2.44m width access handle was initially approved by Council in 1959, it is felt that Council may deem it to be acceptable, particularly as Southern Street is not a very busy street with regard to through traffic. However, I would stress that this would be a determination by a full Council and not its officers.

If you would now resubmit to Council three (3) sketch plans and profile drawings of the access ramps, all having satisfied the above seven (7) points, your subdivision application can then be tabled at the following Council meeting.

A copy of Council's present Subdivision Code is enclosed for your information.

Should you have further enquiries regarding the above please do not hesitate to telephone Jack Kavanagh on 330-6216."

It should also be noted that there presently exists a strip of land approximately 18m wide adjacent to the Georges River which is presently held by the applicant as permissive occupancy. This strip of land is leased from C. A. L. M. and cannot be included in any area calculations.

The applicant has now submitted some information in response to the above correspondence attached as appendix "D"

Included with this information is a request to alter the foreshore building alignment which is not supported by Council officers particularly given the current
C. A. L. M. policy not to enter into Special Purchase Arrangements.

A further two (2) alternative subdivision layouts have also been submitted for Councils consideration .

Second Alternative

On 28th November, 1994, three (3) copies of sketch plans were submitted to Council by surveyor B.H. Burgess & Associates showing three (3) lots, two (2) of which do not have vehicular access or positive frontage to Southern Street and the areas of these lots are 510.6m² which is much less than Council's required 550m². If access was available to each lot, then the areas would only be in the vicinity of 450m², which is 18% undersized.

Third Alternative

A further set of plans was submitted to Council on 6th December, 1994 by Watt-Smith & Partners showing a similar layout of three (3) lots, two (2) without vehicular access or positive frontage to Southern Street. This alternative also makes provision for parking of six (6) vehicles including two (2) stack parked in the access handle and four (4) stack parked on top of the existing building.

Request for Determination

When lodging the third alternative for consideration Mr. Watt-Smith was advised at the counter by myself that I could not recommend any of the subdivision proposals for approval and that in my opinion there was little point in submitting them to Council . However, Mr. Watt-Smith insisted that they be submitted to Council for approval or refusal.

Although this report including Notification to Adjoining Owners deals specifically with the Initial Application the following recommendation for refusal, which is supported by the Divisional Manager Policy Planning & Environment, is valid for all three alternative proposals submitted.

RECOMMENDATION:

Initial Application

THAT the subdivision application be refused due to the following reasons:-


1. The battleaxe lot sizes do not comply with Clause 11(2) of Part 3, Special Provisions in Hurstville Local Environmental Plan, 1994.

2. Each lot does not have satisfactory vehicular access to Southern Street.

3. Each vehicular access must comply with Council requirements and have grades no steeper than 1:5, i.e. vertical to horizontal.

4. The combined access handle width does not comply with the 6.0 metre minimum as required by Council's Subdivision Code or, if approved by Council, 3.0m with a suitably located passing bay of size 6.0m x 3.0m with 45^o splays at each end.

5. The adverse environmental impact on the local area.

6. Inadequate parking and access.

7. The proposal is not in the public interest.

Alternative Proposals::

It is also recommended THAT the alternative proposals submitted for consideration be refused for the reasons outlined above together with the following additional reasons :
8. The lack of a positive frontage to Southern Street for the two rear lots.

9. The lack of vehicular access to Southern Street for the two rear lots.

Application to Vary Foreshore Building Line

It is further recommended THAT the application to vary the foreshore building line also be refused.

Advisory Note:

IF APPROVED the following conditions would also apply:

I. Submission of proper plans including necessary easements and Rights of Ways.

ii. Each lot must have a turning area to allow all vehicles to enter and exit in a forward direction.

iii. The Foreshore Building Line must be shown on the proposed subdivision plans and it is located 15.24 metres from the "old" High Water Mark.

iv. No habitable building can be constructed between the Foreshore Building Line and the "old" High Water Mark.

v. Part of the existing building must be removed to Council approved plans, such that it does not encroach onto the access handle width.

vi. Payment to Council of $12,714.00 in lieu of Parks & Gardens & Recreation Space Contribution.

vii. Payment to Council of $1,418.00 for Community Services and Facilities.

The areas of the access handles and the area of the "Permissive Occupancy" section are not to be included in the area calculation for each individual lot, and also, each lot must have a minimum area of 550m²."

Council resolved:-

"THAT the application be refused."

Following this refusal, Mrs. Graham contacted me to arrange a site meeting to discuss the problems with the initial submission and be advised on what should be their next step. A copy of the letter forwarded to Mr. & Mrs. Graham by the Divisional Manager - Engineering, following the site meeting is as follows:-

"Re: Proposed Subdivision

I refer to the site meeting between yourselves, Jack Kavanagh and I regarding the proposed subdivision of your property.

I would confirm that, as indicated in Council's letter to Watt-Smith Partners dated 20th January, 1995, a three (3) lot subdivision of the property could not be approved under Council's subdivision code due to insufficient area.

It appears that it might be possible to design a two (2) lot subdivision to satisfy Council's code with regard to area, however, several issues would appear to breach Council's code provisions and would need to be favourably considered by Council in order for an application to succeed.

Prior to incurring additional expense by engaging a consultant or surveyor to prepare further plans and as previously suggested you may wish to write to Council to seek clarification on the following issues.

Foreshore Building Line

It appears that a satisfactory two (2) lot subdivision design would require the second dwelling to be constructed beneath the existing retaining wall. This may further require a slight encroachment of the foreshore building line. Council may take into account the fact that the two neighbouring properties appear to have habitable structures well below the anticipated site of the possible second dwelling.

Access Handle Width

The application previously considered by Council was deficient in the width of access handle at the street frontage being 2.44m compared to the code requirement of 3.0 metres, although it is noted that the access handle splays to a maximum width of 8.09 metres which could provide adequate turning/passing room.

Parking

You may wish to seek Council's views as to whether parking for two (2) additional vehicles for the proposed second lot would be permissible in the access handle at its widest point and if so under what conditions.

or

You may wish to seek Council's views as to whether parking for two (2) additional vehicles would be permissible on the roof of the existing building and if so under what conditions.

Access to Proposed Second Allotment

It is assumed that in either of the above alternatives access to the lower proposed allotment would be via the existing or modified inclinator which would also provide the access handle for services to the proposed new lot and possibly, by reciprocal rights, access to the existing dwelling to the boat shed at the water level. You may wish to seek Council's views on these issues.

Services

It is assumed that the access handle would also be used for provision of services to the second allotment. You may also wish to seek advice from Sydney Water at Princes Highway, Rockdale as to the minimum widths and requirements of the access handle which would be shared by the proposed inclinator.

Public Interest

As you are aware the application has generated considerable interest in the neighbourhood and a site visit by Councillors may be advisable.

Dual Occupancy

By way of comment you should also be aware that if Council were to approve the creation of an additional allotment any proposal to create a dual occupancy on either lot would be strongly resisted due to the constraints referred to above.

I would again stress that the final determination of the application is one to be made by Council and this letter should not be taken as an indication that any application would ultimately be approved.

Current Application

Subsequently, and notwithstanding the suggestion to seek Councils' views on certain aspects of the site prior to preparation of a revised plan of subdivision this fresh application was submitted to Council and on advertising to the immediate four (4) neighbours, eight (8) letters of objection have been received together with one (1) petition consisting of 33 neighbours' names, all objecting to this subdivision application. Copies of these letters and petition have subsequently been forwarded to the Peakhurst Ward Councillors.

The area of the two (2) lots are 550.00m² and 967.60m² which are well above Council's code requirement of 550m².

Manager - Planning Services

The matter was referred to the Manager - Planning Services for comment. The following advice has been submitted:-

"The application before Council seeks consent for the creation of an additional allotment. At present the subject property is a battle-axe lot having an area of 1720 sqm, serviced by a variable width access handle. The site is bounded by dwellings and structures situated below the Foreshore Building Line.

The amended proposal complies with clause 11(2) of Council's LEP 1994. The existing allotment accommodates a single three (3) level dwelling and pool, together with a number of mature trees and scattered rock ledges located on the lower level of the site. It is possible to build a single dwelling on each proposed new allotment, subject to the existing Foreshore Building Line being relocated approximately 16.33 m closer to the Georges River, as proposed, to improve the building area.

The Development and Health Division recommend: that the matter be referred to the Ward Councillors for an inspection and report."

The application has three (3) major objections:-

1. Whether there is room to provide two (2) off street car parking spaces for each dwelling plus providing ample manoeuvring area.

2. Whether the narrow inclinator is sufficient to provide pedestrian access to this new lot at the water front and also whether the present inclinator is wholly within this lot or whether it does actually project over the boundary as advised by the neighbour's letter.

This matter has been addressed by the applicant in a letter of explanation which has been circulated to Ward Councillors.

3. The foreshore building line would have to be moved closer to the Georges River to provide a suitable area for building on this new proposed battleaxe lot.

An application to subdivide a regular lot into one (1) normal lot facing Woodcliff Parade and a very large irregular lot which would have frontage to Woodcliff Parade by a 6m wide access handle was considered at Council's meetings held on 12th December, 1990 and 14th October, 1992 wherein Council approved the subdivision subject to conditions including the following:-

"1. Submission of proper survey plan showing the area of the normal lot to be 530.41m² and not 512.12m² as secondly requested.

2. Create and register a 1m wide stormwater drainage easement through to Bayside Drive in favour of the proposed normal lot, i.e. Lot 5."

A subsequent application to create the necessary easement was initially approved by Council at its' meeting held on 3rd August, 1994. However, it was found that this easement was in fact across Community Land.

A further application to subdivide the same land into a normal lot facing Woodcliff Parade and two (2) battleaxe lots at the rear with separate access handles was also approved at Council's meeting of 20th November, 1991 again subject to conditions including a requirement to create and register a drainage easement.
Subsequent approval and registration of an appropriate easement(s) has been unable to proceed until a Plan of Management for Community Land was approved including conditions adopted at Council's Policy Review, Forward Planning & Staff Committee Meeting held on 15th February, 1995. As follows:-

"1. Applicants to prepay the legal, survey, valuation and administrative costs and subsequently to pay just term compensation for the creation of an easement over the community land.

2. Each application to be considered on its merits and the Plan of Management not to be considered as an indication of such an application will be approved.

3. Easements will only be permitted adjacent to the boundary lines or along such routes so as to minimise any adverse impact on the future potential for development for recreation and other purposes of Council's land.

4. The cost of installation of drainage systems to be borne by the applicant or the work carried out under Council's supervision in accordance with standard conditions."

Council, at its Meeting held on 3rd May, 1995, approved of the Draft Interim Plan of Management for Community Land including provision for disposal of stormwater and/or creation of easements and the proposed easement(s) can now be approved.

It should also be noted that permanent vehicular access across the same Council owned land was also requested and it is recommended that this be refused.

At Council's Meeting held on 26th April, 1995 Councillor Stewart expressed concern at the damage caused by the Australian Gas Company's heavy equipment and requested that the Company be alerted to its responsibility to avoid further damage as the work proceeds.

I have been in contact with A.G.L's representative, Mr Gary Charlwood, and a subsequent site meeting was arranged between Council's Tree Preservation Officer, Mr Rob Casey and Mr Charlwood on Monday, 1st May. Minor pruning had indeed been undertaken by A.G.L. on one particular tree, however, this was not considered significant.

Council has recently removed a large dead limb interfering with overhead wires from an adjacent tree at this location.

Mr Casey was satisfied that A.G.L. were taking considerable care not to damage any trees and an agreement was made whereby he would be contacted by A.G.L. where any pruning of limbs with a diameter exceeding three (3) inches (75mm) was required.

At Council's meeting held on 26th April, 1995 Councillor Stewart referred to previous requests to have the resident of Linden Crescent reinstate the area of Evatt Park damaged as a result of work to his property advising that an inspection of the area revealed further dumping of soil at the rear of the property, and that it appeared little had been done to make good the damage.

Further that complaints from residents regarding other damage, i.e. barriers, pipework and uprooted trees thrown into the creek, etc. be investigated. Also, could Council staff be requested to take note and report acts of vandalism of this nature immediately so that appropriate action can be taken.

The Divisional Manager - Engineering stated that he would investigate the issues raised and asked that any Councillor having similar concerns with regard to Evatt Park advise him accordingly. The Divisional Manager - Development & Health advised that action had been taken - the matter was raised with the builder who removed the soil and cleared up the area; it appears he has now brought in more soil.

An on site meeting was subsequently arranged on Friday 5th May, 1995 with Mr Chris Little, Geoff Deehan, Councillor Stewart and myself attending.

A notice for removal of the spoil was issued on 15th February, 1995, and it appears the owner of No. 13 Linden Crescent complied by removing the material from the Council Reserve. He has once again dumped spoil in this area and a please explain letter has now been issued.

The other issues detailed above have been dealt with and a more proactive approach has been requested of the employees stationed at Evatt Park.
