- In accordance with the provisions of Section 10(2) of the Local Government Act, 1993 IT IS RECOMMENDED that the Committee resolve under the terms of Section 10(2) of the Local Government Act, 1993 that for the reason that the Staff Matter in question will impinge on the privacy of the Staff Member concerned, the press and the public be excluded from that part of the Finance Committee Meeting at which this matter is considered. That, in accordance with the provisions of Section 11(2) of the Local Government Act, 1993, the reports and correspondence relating to this matter be withheld from the press and the public.
IT IS FURTHER RECOMMENDED that the matter be referred to the Council for consideration in Committee of the Whole.

03.04 LOCAL GOVERNMENT & SHIRES ASSOCIATIONS OF NSW - REQUEST FOR ASSISTANCE TOWARDS LEGAL COSTS - SYDNEY CITY COUNCIL (L/00015)

- The following letter dated 7th April, 1995 has been received from the Local Government & Shires Associations of NSW on behalf of Sydney City Council requesting all councils to contribute towards the legal costs relating to litigation involving the rating by Sydney City Council of land leased by the Darling Harbour Authority to a private company.
- "Sydney City Council has approached the Associations for assistance with legal costs relating to litigation in which it has recently been involved.
Land in the Council's area was leased in 1987 by the Darling Harbour Authority to a private company. The document provided for a construction phase and a lease phase for a proposed hotel on Crown land at Darling Harbour. The Authority did not notify the Council of the lease until February 1991. In September 1991 the Council rated the land from the date of the lease document, and in November of that year the lessee wrote to the Council advising of the assignment of its interest in the agreement to a third party in June 1990. The lessee claimed that the land was exempt from rating under Section 132(1)(g)(i) of the Local Government Act 1919 (which applied at the time) during the construction phase, that it ceased to be liable for rates after June 1990 because it had written to the Council notifying Council had not complied with Section 139 of the Act. The lessee's initial claim was upheld by the Land and Environment Court, but on appeal the Court of Appeal held that, for the purposes of section 132(1)(g)(i), the lease document did constitute a lease for "private purposes" during the construction phase, that the lessee continued to be liable for rates on the property under section 148 of the Act because it had not given proper notice of the transfer of its interest as required under section 163, and that there was no inconsistency between section 139 of the Act and clause 24 of Ordinance 5. It ruled that the rates for 1990 and 1991 had been validly levied, but that recovery of rates for the years 1987-1989 was time barred on the basis of non-compliance with clause 24.
The case is of significance to Local Government generally because it has clarified the meaning of "private purposes" for the purposes of section 132(1)(g)(i) of the Local Government Act 1919 and, by extension, section 555(1)(a) of the 1993 Act, and has confirmed that liability for rates continues until a proper notice of transfer is given. The issue of the recovery of rates for the years 1987-1989, which the Council was unable to levy in those years because of the lateness of notice from the Darling Harbour Authority and subsequent delays in obtaining valuations for the property, is presently the subject of an appeal to the High Court of Australia.
The case has been reported in Volume 80 of the Local Government and Environmental Reports of Australia commencing at page 289.
The Executives of the two Associations have that the matter is of sufficient significance to justify support and have decided to seek contributions from all councils for the costs incurred to date by Sydney City Council in prosecuting the appeal. Based on the standard formula, your Council's contribution has been calculated at $168.00. The Associations would appreciate Council's support in the matter."
In the past Council has agreed to make contributions such as this and therefore the following recommendation is submitted for Council's consideration.

03.05 BUSINESS ENTERPRISE CENTRE - ST GEORGE & SUTHERLAND SHIRE LIMITED - INVITATION TO ATTEND B.E.C. DINNER (P/00069)

- An invitation has been received from the Business Enterprise Centre - St George & Sutherland Shire Limited for Council to be represented at a B.E.C. Dinner to be held on Tuesday, 30th May, 1995 at 6.00pm in the Ballroom of The Sydney Airport Hilton Hotel, 20 Levey Street, Arncliffe.
The cost is $40.00 per person and the Guest Speaker is Mr Warren Saunders, O.A.M.
The following information regarding Mr Saunders has been provided by the Centre.
- "Warren Saunders was awarded the Order of Australia Medal for services to cricket in 1989.
He played Sheffield Shield Cricket for N.S.W. from 1955-64 during which time he captained this team.
For 14 years he captained the St George 1st Grade and is the highest run scorer in the Club's history.
He started his own Insurance Brokerage in 1961 and currently employs 22 people.
He is Deputy Chairman of St George Bank, St George Leagues Club and Chairman of Fund Raising Committee for Calvary Hospital and Trustee of Calvary Hospital Foundation."

03.06 DICK CAINE'S SWIM, SURF AND TRIATHLON TEAM - REQUEST FOR DONATION ASSOCIATED WITH SUSIE MORONEY'S WORLD RECORD SWIM (F/00036)

- The following letter was received by Council on 19th April, 1995 from Dick Caine's Swim, Surf and Triathlon Team requesting Council to sponsor Susie Maroney in her attempt to break the 24 hour swim world record on 21st and 22nd April, 1995 to enable funds to be raised for St George and Sutherland Hospitals.
- "As the kids and myself at Carss Park have supported your company, we are now requesting that you support one of our local athletes, to raise money for this worthy cause.
Susie has offered to swim non stop for 24 hours in cold outdoor conditions, not only to break a world record, but more importantly to raise money for Sutherland and St George Hospitals.
I know at Carss Park, us "oldies" continually put children down for having life too easy and wanting everything for nothing and getting things handed to them on a platter. Well here you have a chance to support a young girl, who is prepared to swim all day and night, putting herself through hours of excessive cold, pain and personal endurance, not for herself, but for our hospitals.
Most of you people have known me for the past 26 years I have been at Carss Park and you know that I would never put my name to anything unless I honestly believe in it.
I know that times are tough, but if you could support this kid, I would greatly appreciate it.
Thanking you."
- "Thank you very much for your letter on behalf of everyone at the Council.
I am really happy that I made it but I couldn't have kept going without my coach, Dick Caine, and all my friends swimming alongside me. They were all great.
We raised almost $7,000 for the St George Hospital too, thanks to all the support from everyone.
Thank you again."
As noted above, the swim was held on 21st and 22nd April, 1995 and Mr Caine has advised that Susie completed 1,872 laps and set a new world 24 hour swimming record.
It is noted that all money raised will be forwarded to St George and Sutherland Hospitals.
With regard to previous donations to St George Hospital, Council has recently donated $10,000 towards St George Hospital's Cancer Care Lodge Appeal and agreed to contribute $8,333 per year for five (5) years towards the St George Council's Fellowship being for the employment of a specialist for cancer research purposes.
In addition, Council has for a number of years annually provided a donation of $10,000 to the Department of Cardiology in St George Hospital.
Council has made no specific provision in the 1994/95 Adopted Program Budget for a donation as requested, however due to the nature of the request, this matter is referred to Council for consideration.

03.07 ST GEORGE LIFE EDUCATION CENTRE - INVITATION TO ATTEND DINNER AND RECEPTION (P/00069) (Report by Senior Administrative Officer - Mr L Mifsud)
- The following letter dated 10th April, 1995 has been received from the St George Life Education Centre inviting Council to be represented at the Centre's 5th Birthday Celebration Dinner and the Official Reception and Birthday Party.
- "We wish to invite you to attend the 5th Birthday Celebration Dinner of the St George Life Education Centre.
The Dinner will take place at the Illawarra Catholic Club, 13-17 Woodville Street, Hurstville, on Friday, 2nd June, 1995, beginning at 7.30 pm. Cost $30 per head.
We would be honoured by your presence at this function to recognise the achievements, hard work and endeavours of our Community and loyal supporters in achieving 5 years of Community service in delivering a positive drug and alcohol prevention program to the young children of the St George area.
This Dinner is the forerunner to a weekend of Celebration and recognition of our supporters.
Subsequently we would wish to invite you to be in attendance at the Official Reception and Birthday Party to be held at the Hurstville City Civic Centre, MacMahon Street, Hurstville, on Saturday, 3rd June, 1995, commencing at 10.00 am. This Reception is to be held after the 'Celebration Street Procession' at 9.45 am.
Hoping that you can join with us in these celebrations, I would appreciate your reply to attend one/or both events by 20th May, 1995."
It is noted that the Council will be conducting its Workshop on the same day as the Reception and Birthday Party on Saturday, 3rd June, 1995 and therefore, a number of Councillors and senior officers will be unable to attend this function.
His Worship The Mayor, Councillor Bryan McDonald, has also received a similar invitation from the Centre. The Centre has been advised that the Mayor will be unable to attend the Dinner and will be represented by Councillor Lynch and his wife and also that Council will be conducting its Workshop on the same day as the Reception and Birthday.
Councillors and senior officers may be interested in attending the Dinner and/or the Reception and Birthday Party and accordingly the following recommendation is submitted for Council's consideration.

- The following letter dated 13th April, 1995 has been received from the Local Government & Shires Associations of NSW inviting representatives of Council to a farewell dinner for Mr John McSullea, Deputy Secretary of the Associations, who has announced his retirement.
- "John McSullea, Deputy Secretary of the Local Government & Shires Associations has announced his retirement from Friday July 7, 1995.
To thank John for his 10 years' service, the Associations have arranged a farewell dinner on Wednesday July 5, 1995 at the Hilton Hotel, George Street, Sydney. The function will begin at 7.00pm and you and representatives of your Council are cordially invited to attend. Tickets are $70 per person (which includes a small contribution towards a farewell gift for John). In order to finalise catering arrangements, we will need your acceptances on the attached form and cheque by June 19.
Please contact Mrs Elaine Zarins if you would like further information."
The Associations are inviting Councillors and senior staff and the cost of the tickets for the dinner are $70.00 per person.
Although the dinner is being held on the same night as a Community Services Committee meeting, there may be some Councillors and senior staff interested in attending the dinner and accordingly the following recommendation is submitted for Council's consideration.

03.09 CITY OF HOBSONS BAY - 1995 AUSTRALIAN SISTER CITIES ASSOCIATION CONFERENCE (P/00069)

- The following letter dated 14th April, 1995 has been received from the City of Hobsons Bay regarding the 1995 Australian Sister Cities Association Conference to be held in Hobsons Bay from Sunday, 5th November to Thursday, 9th November, 1995.
- "The City of Hobsons Bay was delighted to win the bid to hold the Australian Sister Cities Conference in November 1995 and would like to extend an invitation to you and/or representatives from your organisation to join us in Hobsons Bay from Sunday, 5th November to Thursday, 9th November 1995. The theme this year is "Partnerships in Friendship and Trade".
This year's conference will provide an outstanding opportunity to forge long-lasting friendships on a national and international basis enabling us to learn and share the experiences of others. We promise a full and rewarding program for all participants attending the Conference and their partners.
The Council has engaged the services of a professional conference organiser. Please note this is not a registration form. Registration forms will be sent out in June/July.

A detailed programme for the Conference is still being developed and at this stage registration and other costs are not available. Registration forms containing the relevant information will be forwarded to Council in June/July 1995.
The Divisional Manager - Business & Financial Services has advised that amounts of $29,903.86 and $30,694.16 have been expended to date from the 1994/95 Delegates' Expenses allocation of $30,000 and $31,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers and therefore a total amount of $60,598.02 will be expended this year in respect of those conferences, seminars, etc., for which Council has already authorised attendance by Councillors and/or Senior Officers at previous meetings.
As Council recently established a Sister City relationship with Shiroishi City Council, Japan, this Conference may be of interest to Councillors and senior officers.
It is noted that details regarding the program and costs are not available at this stage and accordingly, this matter is referred to Council for consideration.

03.11 HURSTVILLE AQUATIC LEISURE CENTRE

- Members will recall that at a recent site inspection of the Aquatic Centre, mention was made of a foundation stone being laid as well as additional signage for the construction sign at the corner of Forest & King Georges Roads, Penshurst.
With regard to the laying of a Foundation Stone, a plaque takes approximately four (4) weeks to prepare and therefore when selecting a date for a ceremony to take place, consideration needs to be given to this.
Accordingly the earliest date a ceremony could take place would be Saturday 17th June and therefore the matter is referred to Council to select a suitable date.
It should be noted that arrangements have been made for additional signage to be erected at the corner of Forest & King Georges Roads.

03.12 HURSTVILLE FAMILY RESEARCH GROUP - HIRE OF "GLADWYN" (O/01308)

- The following letter dated 20th April, 1995 has been received from the Hurstville Family Research Group seeking approval to use "Gladwyn" for their monthly meetings.
- "In reference to a conversation with our President and Local Studies Librarian, Margaret Murphy, may we ask for permission to make a booking in the meeting room of Gladwyn House local studies centre. The group meets on the second Wednesday of the month at nine-thirty am. till twelve thirty pm.
Meetings continue throughout the year till December and resume in February the following year.
If this request is granted it will be necessary to cancel our booking in the Wandarrah Room, Hurstville Entertainment Centre.
Our thanks to the staff who have been most helpful over the years.
In concluding, our members applaud the merits of Hurstville Council in their endeavours to establish a local studies centre."
The Research Group currently uses Council's facilities in the Entertainment Centre for their monthly meetings on the basis of Costs + 10%.

03.13 AUSTRALIAN ARMY BAND SYDNEY - SCHOOL CONCERTS - MARANA AUDITORIUM (H/00006)

- The following letter dated 28th April, 1995 has been received from the Australian Army Band Sydney requesting the use of the Marana Auditorium to conduct school concerts in October 1995.
- "As recently discussed, this letter is to confirm our booking of your theatre complex for a series of School Concerts to be presented by the Australian Army Band Sydney (AAB-S) on Monday 16 October - Friday 20 October 1995 (inclusive).
Each day the band will present two 45 minute concerts, one in the morning and one in the afternoon. Timings for these concerts have yet to be determined.
At our recent meeting with you it was discussed that following the school concerts we could present a charity concert on the Friday evening for the general public.
Once the band have initially set-up for the series of concerts on Monday, it is intended that we remain set-up until after the final concert on Friday.
At a time convenient to you, and closer to the concert dates, we should arrange a meeting to confirm final details and our requirements, eg. sound, lighting and stage requirements."
- "(a) For hire on Friday, Saturday, Sunday or Public Holidays by any organisation, the full hiring charges as fixed by Council from time to time be applied to such usage.
- (b) For hiring on days other than Friday, Saturday, Sunday or Public Holidays by charitable, non-profit making local organisations located within the City, and schools within the Cities of Hurstville and Rockdale and Municipality of Kogarah, the amount charged be the actual cost to Council for wages and direct costs plus ten (10) per cent."
As indicated, the Band is conducting school concerts during the week and in view of this, partly complies with Council's policy for reduced rental as their concerts will be for the majority of schools in the St George region.
It is mentioned that during the severe drought conditions prior to Christmas 1994, the Australian Army Band Sydney assisted the township of Manilla. Members are aware that Council has adopted the towns of Manilla and Barraba with respect to providing assistance during the drought.
Members may recall that the Mayor and General Manager were invited to Manilla recently to attend a thank you function to all of the organisations that had assisted the town and it was during this visit that the Mayor and General Manager invited the Band to possibly undertake some performances at Hurstville.
The Band has agreed to perform at this year's Mayoral Ball in addition to the School concerts abovementioned.
In the 1995/96 Draft Program Budget an amount of $5,000 has been provided for cultural events and any costs associated with the School concerts could be funded from this vote.

- As will be recalled the Divisional Manager - Engineering has previously indicated that the Staff Establishment lists shown above in respect of the Outdoor Workers are broken into some broad categories and should not be taken as being precise with only the total number of Outdoor staff being a precise figure.
It has also been indicated previously that on a daily basis changes are made to a number of positions as a result of plant breakdowns, sick leave, annual leave, etc., with this being an ongoing process but with total Outdoor staff remaining constant.

- For the information of Members it is advised that the Hurstville City Council Staff Consultative Committee has scheduled its Annual General Meeting for Tuesday, 23rd May, 1995 between 12 noon and 1.00pm in the Civic Theatre.
An invitation will be extended to all employees of Council to attend the Committee's Annual General Meeting and the Committee has also requested that a similar invitation be extended to all Members of Council.
The Annual General Meeting in 1994 was held between 12 noon and 1.00pm having changed from 1993 when the meeting commenced at 5.30pm. This change attracted considerably more staff and therefore the Committee has decided to hold this year's meeting again between 12 noon and 1.00pm.
In 1994 the Council agreed to provide appropriate light refreshments at the conclusion of the Annual General Meeting and it is again considered that it would be appropriate for Council to agree to provide light refreshments at the conclusion of the 1995 Annual General Meeting and accordingly the following recommendation is submitted for Council's consideration.
