Note: - The Entertainment Centre Office has advised that there have been no negotiated charges for the use of Council's facilities since the last meeting of Council.

In addition, a schedule showing details of concessional rentals granted by Council to date, during 1995, for the Entertainment Centre facilities is attached as Appendix "B".

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 03.03 CORPORATE & COMMUNITY SERVICES

03.03 CLASSIFICATION OF LAND - NO.19 CONNELLY STREET, PENSHURST (O/01054)

Members will recall that at the meeting of Council held on 15th March, 1995 consideration was given to a report concerning the possible acquisition by Council of No.19 Connelly Street, Penshurst.

Subsequently in connection with this matter, the Council resolved, in part, as follows.

"THAT as required by Section 34 of the Local Government Act 1993 the Council place an appropriate public notice in the Public Notices section of the St George & Sutherland Shire Leader, being the manner of giving public notice determined by Council in accordance with Section 705(3) of the Act advising of Council's intention to resolve to classify land at No,.19 Connelly Street, Penshurst as operational land in the terms of Section 25 of the Act and advising that submissions will be received by Council regarding the proposed classification for a period of twenty-eight (28) days from the date of publication of the notice.

FURTHER, THAT following the close of the publication period a further report be submitted to Council concerning any submissions received, the proposed classification of the land and further action to be taken in this regard."

Contracts for the acquisition of the above property by Council were subsequently exchanged and in accordance with the abovementioned resolution, an appropriate advertisement was placed in the St George & Sutherland Shire Leader on 23rd March, 1995 advising of Council's intention to classify the property as "operational land" and advising that submissions regarding the classifying could be forwarded to Council within 28 days.

Following the expiration of the 28-day period, no submissions have been received in regard to this matter.

Accordingly the following recommendation is submitted for the Council's consideration.

HURSTVILLE CITY COUNCIL RECOMMENDATION NO: 03.03 CORPORATE & COMMUNITY SERVICES

03.03 Recommendation CLASSIFICATION OF LAND - NO.19 CONNELLY STREET, PENSHURST (O/01054)


RECOMMENDATION

THAT in accordance with the requirements of Section 34 of the Local Government Act 1993, Council resolved that the land known as No.19 Connelly Street, Penshurst be and is hereby classified as "operational land" pursuant to Chapter 6, Section 25 of the Local Government Act 1993.

HURSTVILLE CITY COUNCIL REPORT ITEM NO: 03.04 CORPORATE & COMMUNITY SERVICES

03.04 TCS USER FORUM - 5TH TO 8TH JUNE, 1995

As Members would be aware, the Council currently utilises the TCS Software product provided by Stowe Computing Australia and has subsequently been a member of the TCS User Forum for a considerable number of years.

In the past the TCS User Forum has conducted two main meetings per year with the location of these meetings being rotated between States in view of the fact that a considerable number of Members of the Forum and users of the product are based in States other than NSW.

Following a review of the types of meetings held by the Forum in the past, the Forum decided to alter the form of its meetings to still provide for two (2) meetings to be held each year with both meetings addressing the general use of the software products and enhancement and development from a management and operational point of view, with one of such meetings also being directed towards technical issues of the system and software products for the benefit of technical staff.

Advice has now been received from the TCS User Forum indicating that the first Forum Meeting to be held in 1995, incorporating the technical aspects as referred to above, will be held in Adelaide from 5th to 8th June, 1995, with various technical aspects of the computer system and software products being addressed.

In view of the nature of this meeting, it is considered that it would be desirable for Council's MIS Manager to attend this particular meeting to gain benefit from the technical aspects and to also enable the Manager and Council to be kept fully informed of developments.

As part of the membership fee of the TCS User Forum, Council is entitled to a refund equivalent to the cost of one return air fare to a Forum Meeting each year and therefore the Council would be reimbursed for the cost of the airfare for Council's MIS Manager and the only costs involved would be accommodation and expenses.

The Divisional Manager - Business & Financial Services has advised that amounts of $26,533.86 and $27,742.16 have been expended to date from the 1994/95 Delegates' Expenses allocation of $30,000 and $31,000 for Councillors and Senior Officers respectively. The Divisional Manager - Business & Financial Services further advises that no additional amounts have been committed for Councillors and Senior Officers and therefore a total amount of $54,276.02 will be expended this year in respect of those conferences, seminars, etc., for which Council has already authorised attendance by Councillors and/or Senior Officers at previous meetings.

Accordingly the following recommendation is submitted for Council's consideration.

03.04 Recommendation TCS USER FORUM - 5TH TO 8TH JUNE, 1995


RECOMMENDATION

THAT Council's MIS Manager be authorised to attend the conference of the TCS User Forum to be held in Adelaide from 5th to 8th June, 1995 and that Council meet any costs and expenses involved in such attendance.

03.05 MISS D NELSON - REQUEST FOR FINANCIAL ASSISTANCE

Members will recall that Council at its meeting held on 22nd February, 1995 considered a request from Debbie Nelson to provide a donation to assist her with expenses associated with the Combined High Schools Girls' Cricket Team's tour of England in June 1995.

Accordingly, Council resolved as follows.

"THAT as required by Section 356(2) of the Local Government Act 1993, the Council place an appropriate public notice in the Public Notice Section of the St George and Sutherland Shire Leader, being the manner determined by Council in accordance with Section 705(3) of the Act, advising of Council's intention to consider granting financial assistance to Miss Debbie Nelson and advising that submissions will be received by the Council for a period of 28 days from the date of the public notice.

FURTHER, THAT Miss Nelson be advised of Council's actions in the matter and that the request will be further considered at the conclusion of the advertising period."

At the meeting of the Policy Review, Forward Planning and Staff Committee held on 15th February, 1995, consideration was given to a report in relation to the manner determined by Council in accordance with Section 704(3) of the Act. The following recommendation from the Committee was subsequently adopted by Council at its meeting held on 22nd February, 1995.

"THAT to comply with Section 356(2) of the Local Government Act 1993, in respect of proposed donations to eligible young people requesting financial assistance for sporting, cultural or academic activities, Council advertise the proposed donations in the first available edition of "Council Comment", this being the manner of 'public notice' determined by Council for such purposes in accordance with Section 705(3) of the Act, advising of Council's intention and inviting submissions for a period of 28 days from the date of the publication."

A public notice detailing the proposal was circulated to households in the Hurstville City area in the March 1995 edition of "Council Comment". No submissions were received.

In view of Council's policy to grant assistance to eligible young people for sporting, cultural or academic activities, the following recommendation is submitted.

03.05 Recommendation MISS D NELSON - REQUEST FOR FINANCIAL ASSISTANCE

THAT Council provide a grant of $200 under the provisions of Section 356 of the Local Government Act to Miss Debbie Nelson to assist her with expenses associated with the Combined High Schools Girls' Cricket Team's tour of England in June 1995.

FURTHER, THAT Miss Nelson be requested to submit a report on her results achieved on the tour.

03.06 LOCAL GOVERNMENT & SHIRES ASSOCIATIONS OF NSW - REQUEST FOR ASSISTANCE WITH LEGAL COSTS - BLAYNEY SHIRE COUNCIL (L/00015)

The following letter dated 15th March, 1995 has been received from the Local Government & Shires Associations of NSW on behalf of Blayney Shire Council requesting all councils to contribute towards the legal costs relating to litigation involving the rating by Blayney Council of two gold mines operated within its area.

"Blayney Shire Council has approached the Associations for assistance with legal costs relating to litigation in which it has recently been involved.

The action involved an objection by a company to the 1993 rating by the Council of two gold mines operated by the company, on the basis that the method used (rating based on output) amounted to the imposition of an "excise" within the meaning of section 90 of the Australian Constitution, and so was invalid. The action had ramifications both for the Council itself, for other Councils with active mines in their areas which were rated on the same basis, and for any other Council found to have levied rates without proper legal basis, because of the amounts of rates which might have had to be refunded.

The action was resolved in favour of the company, but only on the basis of a refund of the rates for 1993 and without any adverse finding on the Constitution-based challenge. It is not seen as having established a precedent, and substantial claims for refunds have been avoided.

The Executives of the two Associations have decided to seek support from all councils for the costs which Blayney Shire Council has incurred. Based on the standard formula, your Council's contribution has been calculated at $114.00. The Associations would appreciate Council's support in the matter."

All councils have been requested to contribute an amount based on a standard formula. This Council's contribution has been calculated at $114.00.

In the past Council has agreed to make contributions such as this and therefore the following recommendation is submitted for Council's consideration.

03.08 COUNCIL YOUTH GAMES (C/00101)

For the information of Members it is advised that following Council's resolution of 22nd February 1995 to again host the Council Youth Games, invitations to all Local Government Authorities to compete in the Games were extended on 9th March, 1995.

To date nine (9) councils have accepted the invitation and a further nine (9) have advised that the proposal is currently being considered. If this trend continues the Youth Games will certainly be another great event for Hurstville.

With regard to the cost of conducting the Youth Games, approval has been sought to obtain sponsors for each of the events, i.e. Sanitarium High Jump, Caltex 100, Hurstville Cup, etc.

The Local Government & Shires Associations have been approached and have no objections. The Associations have requested that they be considered as one of the sponsors.

Subject to obtaining appropriate sponsors for the Youth Games events, i.e. no alcohol or cigarette companies, etc., no objections can be foreseen in allowing sponsorships. Further, this is another avenue to offset operating costs, particularly if more and more councils from the country participate.

03.09 PAYNEHAM CITY COUNCIL - SRI CHINMOY PEACE RUN '95 (C/00044)

The following letter addressed to His Worship the Mayor, Clr B McDonald, has been received from the Mayor of the City of Payneham regarding the forthcoming Sri Chinmoy Oneness-Home Peace Run '95.

"I would like to inform you about a major international event - the biennial Sri Chinmoy Oneness-Home Peace Run '95 which will be travelling through all states on a five thousand kilometre journey during May and June.

As Honorary Chairperson of the Australian Mayor's Council for Peace Run '95 I have been asked by the event organisers, the Sri Chinmoy Peace Foundation, to invite yourself and the citizens of the City of Hurstville to participate in this unique event.

The Sri Chinmoy Oneness-Home Peace Run is an Olympic style torch relay that will circle the world. Runners in all seven continents - passing a Peace Torch from hand to hand - will join the Peace Run as it travels through their nations. Peace Run '95, reaching more than 70 countries, will be the longest running event ever held.

The idea behind the Peace Run is simple - world peace begins with each individual's quest for peace. If people from all nations can run side by side in harmony, then it's but a small step for all peoples to live in harmony. Peace Run '95 coincides with The Year of Remembrance 1945-1995 and celebrates the 50th anniversary of the formation of the United Nations.

The Peace Run is, however, much more than an athletic event of unprecedented proportions. "Peace Festivals" will be held as the runners pass through cities and towns, giving all Australians the chance to express their dreams for peace through music, art, literature, dance and other sporting events. Participation is the aim of the Peace Run. There will be many opportunities for countless thousands of Australians to be involved. Expressions of the Australian public's aspirations for peace (through art work, writings, etc.) will be selected to become part of the "Peace Submission" to be presented to Prime Minister Paul Keating at the close of Peace Run '95.

I was proud to hold the torch during Peace Run '93 and to help generate participation in my city. When the runners passed through the City of Payneham I was joined by school children, representatives from community groups and local citizens in welcoming them. Council also declared City of Payneham a Sri Chinmoy Peace City - joining over 2000 significant landmarks worldwide dedicated as "Peace Blossoms" to world peace.

The National Patron of the Sri Chinmoy Oneness-Home Peace Run is Prime Minister, Paul Keating, whose statement of support declares:

'This Peace Run demonstrates most clearly that the search for peace is not a static dream, but a dynamic commitment paving the way to a brighter future for all people of the world.'

Internationally the Sri Chinmoy Oneness-Home Peace run is supported by a remarkable group of world leaders, elected officials and celebrities, among them: former Soviet President Mikhail Gorbachev, Pope John Paul 11, Mother Teresa, Rev. Jesse Jackson, Archbishop Desmond Tutu and athlete Carl Lewis. Australians supporting the Peace Run include: Leader of the Opposition, John Howard, Dawn Fraser, Cathy Freeman, Mandawuy Yunupingu, Mrs Anita Keating, Alan Border, Gareth Evans and Robert DeCastella.

Join Peace Run '95

Peace Run '95 will pass through the City of Hurstville on Sunday 12th June, 1995. Support this innovative and interactive program for peace.

* Join the Australian Mayor's Council for Peace Run '95. This council will suggest ways in which our citizens can participate in Peace Run activities as the runners pass through our cities and towns.

* Offer a letter of support for the Sri Chinmoy Oneness-Home Peace Run to be shared with your citizens. In his message to Peace Run '95, the Lord Mayor of Brisbane, Hon. Jim Soorley, proclaims: "The Peace Run is designed for ordinary citizens to participate in an extraordinary event - a highly visible demonstration of our quest for peace."

* Complete the attached Response Form so that Peace Run '95 co-ordinators can organise your city's involvement.

I look forward to hearing from you by way of the enclosed response form and thank you, in advance, for your participation in the Sri Chinmoy Oneness-Home Peace Run '95."

The response form referred to in the correspondence outlines a number of ways Council could be involved. They are:-

1. I support Peace Run '95 and would like my name included in the Australian Mayor's Council for the Peace Run.

2. I would like to offer a "Letter of Support" for the Sri Chinmoy Oneness-Home Peace Run. Please find it attached.

3. I would like to greet the Peace Runners and carry the torch as they pass through my city.

4. I want to arrange for publicity photos to be taken holding the Peace Torch.

5. I wish to speak with the Sri Chinmoy Oneness-Home Peace Run organisers. Please ask their representatives to contact me.

6. I would like to dedicate my city as a "Sri Chinmoy Peace City."

Members would be aware that on two previous occasions Council has supported the Peace Run by unveiling plaques and dedicating a tree. The locations of the trees are:-

1. In the vicinity of the steps to the Civic Centre (27/5/91).
2. Penshurst Park at the side of Blackshaw Pavilion (22/3/93).

It has been indicated that the Peace runners will pass through Hurstville on Sunday, 11th June, however no times have been given. Monday, 12th June is the Queen's Birthday Public Holiday.

In view of Council's previous participation by dedicating trees and the limited number of persons who may be able to attend a ceremony on a Sunday, particularly on a long weekend, it is suggested that Council support Peace Run '95 by providing a letter of support.

As will be recalled the Divisional Manager - Engineering has previously indicated that the Staff Establishment lists shown above in respect of the Outdoor Workers are broken into some broad categories and should not be taken as being precise with only the total number of Outdoor staff being a precise figure.

It has also been indicated previously that on a daily basis changes are made to a number of positions as a result of plant breakdowns, sick leave, annual leave, etc., with this being an ongoing process but with total Outdoor staff remaining constant.

The following letter dated 6th April, 1995 has been received from Sunnyhurst Special Services Inc. requesting Council to consider making a donation to assist with the purchase of a wheelchair.

"Sunnyhurst Special Services Inc. is a charitable organisation (No.CC29601) that cares for adults with moderate to severe intellectual and physical disabilities. Sunnyhurst cares for 30 adults in a training centre and a residential programme with the aim of improving the quality of each individual's life.

Due to financial restraints imposed by both the Federal and State Governments, Sunnyhurst survives on a shoe string budget, with minimal staff, supported by a core of volunteers. Since our inception as a school some 40 years ago Sunnyhurst has battled to provide quality service on this basis.

Sunnyhurst is presently in desperate need of a new wheel chair and due to our limited financial resources we are asking for assistance in financing or donating said wheel chair. All donations to Sunnyhurst are tax deductible and therefore our gain will not result in your loss.

We respectfully request your Council to consider this request for assistance. By assisting with a wheel chair, or donation to be applied to the purchase of a wheel chair, you will be helping to provide a better quality of life to those in our service.

If you would like any further information regarding Sunnyhurst please do not hesitate to contact the undersigned on 580-5260 or 570-2463."

No provision has been made in the 1994/95 Adopted Program Budget for a specific donation for this purpose and notwithstanding the importance of this organisation's contribution to the community, the following recommendation is submitted for Council's consideration.

03.13 NSW WILDLIFE INFORMATION & RESCUE SERVICE (WIRES) - REQUEST FOR DONATION (F/00036)

The following letter dated 24th March, 1995 has been received from NSW Wildlife Information & Rescue Service (WIRES) requesting Council to consider making a donation to assist with the operation of the WIRES Sydney Regional Office.

"I am writing to you on behalf of the Sydney Region of the NSW wildlife Information & Rescue Service (WIRES).

WIRES is a non profit, non-political, voluntary organisation operating across NSW who rescue, rehabilitate and release native injured or orphaned Australian wildlife. WIRES Incorporated was recently granted charity status and tax deductibility, for all its branches and regions.

In the Sydney region WIRES operates from a modest office in the grounds of Forestville Primary School. WIRES Sydney has been operating for almost 10 years and numbers of calls have reached a staggering 20,000 annually.

The Sydney Region has approximately 600 members and is the largest volunteer wildlife rescue network of its kind in Australia and possibly the world. In the year to date, WIRES volunteers have responded to 30% more calls than in 1993-94 (in which they received 11,680 rescue calls and approximately 4,000 enquiry calls). WIRES operates from 10am - 4pm, 7 days a week, 365 days a year, and receives up to 200 calls daily, as well as up to a further 85 calls during their after hours service from 4pm - 10pm.

All WIRES foster-carers receive formal training and are licensed to care for native wildlife in their home. The typical WIRES volunteer is a woman in her thirties, who works - usually full-time - and cares for a family, as well as providing foster care for injured native animals. She does this all from her own pocket.

WIRES itself receives no formal government funding, except for a small amount of assistance towards the annual phone bill from the National Parks & Wildlife Service (NPWS). The dedicated Sydney volunteers could not function without the Office who receive the publics' distress call, coordinate the rescue and arrange the foster-care of the injured animal concerned. The office volunteers also record and process the paperwork associated with every animal and produce annual statistics for both the public and the NPWS as part of the licensing requirements.

As you will appreciate, running such an office, particularly now that the volume of calls from the public is so large, is an expensive business.

Our main need is money, but we are also desperate for basic office equipment and furniture so that the volunteers can work more efficiently and effectively; computers and printers, so we can keep track of rescue work and provide reliable statistics to NPWS; fax machines so that co-ordination between the seven Sydney Branches and the rescue office is more effective; a larger PABX system to replace the existing one, which is now inadequate due to the ever increasing number of calls for help and information.

WIRES Sydney cares for many species of native animals including Ringtail and Brushtail Possums, Sugar and Feathertail Gliders, Pygmy Possums, Wombats, Flying Foxes, many species of reptiles and a very large range of birds. Some of Sydney's native animals are under threat of extinction unless WIRES, the organisation most concerned with their welfare can raise urgently needed funds. Recent history proves the community wants this service to continue to help care for our native animals but unless WIRES Sydney receives funding soon to keep its office running, it will not be able to function and animal rescues simply won't happen. Where will the public turn then for assistance?

As we do not receive funding from any level of government, we implore you, on behalf of your local community and wildlife, to seriously consider our financial plight and assist where you can. Even a donation of $500 would greatly assist our organisation to continue its very important work.

No provision has been made in the 1994/95 Adopted Program Budget for a specific donation for this purpose and notwithstanding the importance of this organisation's contribution to the community, the following recommendation is submitted for Council's consideration.

The following letter has been received regarding the inaugural Smith Family Day.

"I would like to introduce you to the inaugural Smith Family Day.

The United Nations Day of Families is held each year on May 15 and The Smith Family has decided to make this day our own national day.

The theme for the day is 'THE PASS to a better Australia".

On The Smith Family Day, corporations, clubs, school students and the general public are asked to purchase and wear THE PASS to a better Australia".

THE PASS is created along the lines of a backstage concert pass and will give access to a free Thank You concert to be held at Tumbalong Park Darling Harbour on May 14.

Hoyts Cinemas have offered $5 tickets to all wearers of THE PASS on May 14 and Australia's many families and individuals who are struggling to break free from the cycle of poverty. Council does not provide an annual donation to the Smith Family under Schedules "B" or "C" nor has an amount been provided within the 1994/95 Program Budget.

However in view of the very worthwhile nature of the organisation and no doubt the benefit that residents within the City of Hurstville receive, Council may wish to participate by contributing the Corporate donation of $300.

03.15 VOLUNTARY EUTHANASIA SOCIETY OF NEW SOUTH WALES (INCORPORATED) - REQUESTING WAIVING OR REDUCTION OF RENTAL FOR USE OF KANYANA ROOM (H/00007)

The following letter has been received from the Voluntary Euthanasia Society of New South Wales (Incorporated) requesting the reduction or waiving of the rental for the use of the Kanyana Room on Sunday; 26th November, 1995.

"We wish to hire the Kanyana Room on Sunday 26 November 1995, for the purpose of an informal meeting. As we would require set-up time before our meeting at 2pm, we would need to have access to the hall from 1pm until 4 or 4.30pm.

I understand that the usual charge is $35 per hour. However as we are a non-profit organisation, it would be greatly appreciated if this charge were to be reduced or waived. We will, of course, be responsible for leaving the space as we find it.

Could you please tell me what facilities are available for serving light refreshments, and the maximum number of chairs the Kanyana Room can hold - as this is the first time the Voluntary Euthanasia Society has held a meeting in the southern suburbs, we could well have a large turn-out of members and visitors. The exact location of the Kanyana Room is also needed."

The Council's policy in respect of matters such as this is reproduced, in part, hereunder.

"(a) For hire on Friday, Saturday, Sunday or Public Holidays by any organisation, the full hiring charges as fixed by Council from time to time be applied to such usage.

(b) For hirings on days other than Friday, Saturday, Sunday or Public Holidays by charitable, non-profit making local organisations located within the City, and schools within the City of Hurstville and Municipalities of Kogarah and Rockdale, the amount charged be the actual cost to Council for wages and direct costs plus ten (10) per cent."

Council's Entertainment Centre Officer has advised that the normal charge for this booking is $105.00 and that Council's Cost + 10% is $97.00.

It is noted that the Society has requested the use of the Kanyana Room on Sunday, 26th November, 1995 and therefore in accordance with Part (a) of the above policy, full hiring charges should apply.

Also it is noted that the Society is located at Ultimo which is outside the City area.

Accordingly, as the request does not comply with Council's policy the following recommendation is submitted for Council's consideration.

The following letter dated 11th April, 1995 has been received from Georges River Community Service Inc. requesting financial support from Council for 1995.

"I have pleasure in enclosing our Annual Report for the year ended 31st December, 1994 which was adopted at our Annual General Meeting held on 20th February, 1995. Included in the Annual Report are our financial statements.

As you are aware, Council has been a consistent financial supporter of our activities for some time and such assistance has proved invaluable in maintaining our services to the needy in our community.

The Management Committee of the Georges River Community Service Inc. has asked me to approach you with a view to Council considering the continuation of its financial support in 1995.

Your Council's continued help and support of GRCS Inc is greatly appreciated."

The 1994 Annual Report referred to in the above correspondence is included in "Matters Submitted for the Information of Members" - See Item A(i)(a).

In recent years Council has donated an amount of $5,000 to the Service under the relevant provisions of the Local Government Act.

The most recent donation provided to the Service was in 1994 when Council at its meeting on 30th March, 1994 resolved as follows.

"THAT a subsidy of $5,000 for 1994 be paid to the Georges River Community Service under the provision of Section 356 of the Local Government Act 1993 and that the additional funds required for this purpose be voted from Working Funds Surplus."

Provision has been made in the 1994/95 Adopted Program Budget for the payment of a subsidy of $5,000 to the Service.

Accordingly the following recommendation is submitted for Council's consideration.

The following letter dated 7th April, 1995 has been received from the Peakhurst Amateur Swimming Club Inc. requesting Council to sponsor a swimming race or races at its carnival at the Peakhurst West Pool on 21st May, 1995.

"Since 1963, Peakhurst Amateur Swimming Club has fostered the talents of several top swimmers; provided a well controlled sporting club for our local children and (by way of its Annual Free Learn to Swim Campaign), taught thousands to swim.

At Peakhurst West Pool on 21st May, 1995, the Club will conduct our major fund raising event of the year, a carnival open to all swimmers 12 years of age and under.

Peakhurst Amateur Swimming Club would like to sell you a race - a swimming race. You could, of course, buy more than one, we have seventy-four for sale. If you buy an event for $20.00 you will have your name, address, phone number and brief business details printed in the programme as sponsor of that event. Major sponsors will be given special acknowledgment.

We expect over a thousand entries for this carnival with a large spectator audience, mainly from our own area. Your support would place your name before this audience, and you would also be supporting a local community group.

The carnival will be open to all swimmers 12 years of age and under and will be held on Sunday, 21st May, 1995 at the Peakhurst West Pool located in the grounds of Peakhurst West Primary School.

As indicated in the above correspondence there will be seventy-four (74) swimming races at the carnival and the Club is requesting Council to sponsor a race or races for $20.00 per race.

No provision has been made in the 1994/95 Adopted Program Budget for sponsorship in this matter to the Peakhurst Amateur Swimming Club.

However as the Club provides a service for local children and also as this carnival will be held in the Council's area, Council may wish to consider sponsoring a race or races at $20.00 per race.

Accordingly this matter is referred to Council for consideration.

03.20 HURSTVILLE SKILLSHARE - REQUEST FOR FINANCIAL SUPPORT (F/00036)

The following letter dated 10th April, 1995 has been received from Hurstville SkillShare requesting Council to provide financial support to the organisation in 1995.

"On behalf of our Management Committee, Staff and Clients, we would like to once again thank Hurstville City Council for their invaluable and ongoing support of Hurstville SkillShare, a division of St George Careers Development Centre.

As you would be aware, SkillShare is a community based program, which aims to provide unemployed people in the St George area with the necessary skills and confidence to gain employment or move onto further education or training. This is achieved through the provision of training courses, placement and other support services to unemployed people of all ages, especially those who have been out of work for 18 months or more or who are disadvantaged in some other way.

Hurstville City Council's ongoing yearly support has made a significant contribution to enable the Centre to provide an essential service for unemployed people in the St George area. It is through contributions such as this that Hurstville SkillShare and other programs at the Centre are able to continue to provide a quality service which is designed to meet local labour market needs and provide professional employment related training and support for those who are unemployed in our community. It is hoped that Hurstville City Council may be in a position once again to continue its financial support of this program in 1995.

At the present time we are working towards making our Centre more accessible for clients with disabilities. A disability access audit has been completed by a qualified architect and several modifications to our premises have been suggested. Any sponsorship received from Council would be directed towards this project which we are aiming to complete by December 1995.

All sponsors are highlighted on the Centre's Sponsor Board and in our Annual Report. A copy of our most recent Annual Report is enclosed for your information.

We thank you for your consideration of this request."

A copy of the organisation's 1993 Annual Report referred to in the above letter is included in "Matters Submitted for the Information of Members" - See Item A(i)(b).

Since 1989 Council has annually donated an amount of $2,000 to Hurstville SkillShare.

The most recent donation provided to Hurstville SkillShare was in 1994 when Council at its meeting on 3rd August, 1994 resolved as follows.

"THAT under the provisions of Section 356 of the Local Government Act, 1993, Council donate $2,000 to Hurstville SkillShare as provided for in the 1994/95 Adopted Program Budget."

As can be seen from the above resolution Council donated $2,000 to Hurstville SkillShare as provided for in the 1994/95 Adopted Program Budget and therefore there are no monies remaining in this financial year's Budget for a further donation to this organisation.

However Members will recall that when the question of payment of subsidies to a number of other community organisations was considered by the Council at its meeting on 16th February, 1994, the Council resolved, in part, to continue to make annual subsidies to these organisations and to pay the full subsidy at that time on the basis of such subsidy being paid in the first quarter of each calendar year on receipt of an appropriate request.

Hurstville SkillShare was not one of these organisations that received payment of a full subsidy during the transitional six month period from 1st January to 30th June, 1994.

As Hurstville SkillShare has been receiving an annual donation from Council usually in the first half of each calendar year and it is a community based program which provides unemployed people in the area with the necessary skills and confidence to gain employment or move onto further education or training, Council may wish to consider providing a subsidy of $2,000 for 1995 from Working Funds Surplus and request the organisation that if it wishes to apply for a donation in the future, an appropriate request should be submitted during the first quarter of each calendar year.

Accordingly the following recommendation is submitted for Council's consideration.

03.21 HURSTVILLE CROQUET CLUB - REQUEST FOR PROVISION OF A SHELTER SHED

The following letter has been received from the Hurstville Croquet Club requesting Council to provide a shelter shed at the Club's property at the Cnr. Cambridge & Percival Streets, Penshurst.

"I refer to the request of the Hurstville Croquet Club for Council's assistance in the provision of a shelter shed.

In our letter to Councillor Pickering (4th June, 1994) a copy of which is enclosed, we suggested that as Council had not made provision for funds for this purpose that Council apply to the Department of Sport, Recreation and Racing for a matching grant. The total cost of the shelter was estimated at $2,000. We have now been advised by the Minister that this application was not successful.

I am advised by Mr Little of Council's Engineering Department that Council will shortly be considering the allocation of its funds for the forthcoming period. Accordingly I ask that the matters raised in our letter to Councillor Pickering be taken into account in determining priorities.

Our expectation of Council assistance in this matter dates back to 1992 when Mr Targett drew up plans for shelter sheds on our site. It was considered at the time that Council would follow this up by making provision of funding. Our need for assistance is a relatively modest one and we hope that Council will now be able to accede to this request."

The Club's letter dated 4th June, 1994 referred to above reads as follows.

"I write to seek your assistance in a matter of concern to the members of the Hurstville Croquet Club.

Our Club has been in existence for almost 60 years. We provide a sporting facility for members of this community and others which is unique in Hurstville. In all this time we have managed to maintain and improve our Club from our own resources. In particular we have not received major assistance from Council.

We gratefully acknowledge however the annual assistance of Council staff in the coring of our lawns and recently the rebate of rates.

Like all sporting groups we face major expenses from time to time. In 1992 we decided to ask Council to assist in one major area namely the replacement of the shelter sheds on our grounds when foreseeable funds were insufficient to cover our other costs, e.g. painting of our building. Correspondence from Mr W J Park indicated that no provision has been made to assist us to date and it would appear that our request is not receiving serious consideration by Council.

Mr P Targett of Council drew up plans for the shelter sheds in 1992. Last year, when faced with the possibility of a collapsing shed, we were forced to have constructed a shed of smaller dimensions to those drawn by Mr Targett. Our reserves are now at a very low level. We need to replace the other shelter shed on the site; preferably with one of those designed for us by Council. Estimated cost is $1400 - $2000.

It is clear that we have been doing and are doing all we possibly can to maintain the croquet club as an important sporting facility. The fact that technically the land is not owned by Council should not preclude it from assisting us in a similar way that Council could be expected to assist any other sporting body which serves our community.

Our hope is that Council will construct or contract out the building of the remaining shed as a matter of priority in view of the long standing nature of our request, our expectation of assistance from Council and the obvious need for this shelter. It may be that Council could reduce some of the costs by including this as an item in its requests to the NSW Sport and Recreation Council, applications for which close in June. We know of at least one other metropolitan Council (Randwick) which has been able to very substantially assist its croquet club in this way.

Members would be aware that Council assists the Hurstville Croquet Club by way of a donation equivalent to the rates on the Club's property. The amount of this donation for 1994/95 was $134.00.

Council's Manager - Parks & Recreation, Mr Andrew Sharp, has advised that the original plans for the shelter sheds were for a structure quite different to that proposed by the Club. The current proposal is for a timber framed and clad shelter on a concrete base with colour bond roof sheeting. The total cost is approximately $2,000. Mr Sharp has also advised that as far as he is aware no firm commitment has ever been given to the Club that the shelter sheds would be funded by Council.

Council's application for funding under the Capital Assistance Program was unsuccessful.

No provision has been made in the 1994/95 Adopted Program Budget for a specific donation for this purpose.

The Club is a private organisation and any financial assistance given by Council would be considered a donation under Section 356 of the Local Government Act 1993. As Members would be aware, all proposed donations must be advertised in accordance with Section 705(3) of the Act.

In view of the above comments and there being no budget allocation for this project the following recommendation is submitted.

03.23A HURSTVILLE LIGHT OPERA COMPANY - REDUCED RENTAL FOR HIRE OF MARANA AUDITORIUM (H/00004)

The following letter dated 3rd April, 1995 has been received from the Hurstville Light Opera Company regarding the use of the Marana Auditorium for a performance on 31st August, 1995.

"On behalf of Hurstville Light Opera Company I seek permission from Council to use the Marana Hall for an extra night, Thursday, 31st August, 1995.

The Company is presenting "Australia Remembers"

We are very excited at the opportunity to be involved in this project as we have authorisation from the Hon Leo McLeay MP's office and also have permission from Veterans' Affairs, Melbourne, through Bladon Australia Pty Ltd to use the "Australia Remembers" logo.

The Watson "Australia Remembers" Committee have asked for the company to give five (5) performances instead of our usual four (4) and we would like to oblige if possible. Will the same arrangement of Cost plus 10% continue for this night?

Awaiting your reply and thanking you in anticipation."

Council has, since 1989, granted approval for the Hurstville Light Opera Company to conduct two performances per year, subject to conditions on the basis of Costs + 10%. The conditions of hire are:-

* Council meets the cost of technicians for one full dress rehearsal (Monday) and four (4) shows.

* Council meets the cost of operating the Candy Bar and receives the profit therefrom.

* Hurstville Light Opera Company meets the cost of technicians for one rehearsal (Sunday) and any other unscheduled rehearsals or performances.

As can be seen, the Hurstville Light Opera Company should meet the full cost of hiring the Marana Auditorium and also the cost of technicians for this unscheduled performance.

The Entertainment Centre Officer has advised that Council's normal costs would be $600.00 and Costs + 10%, $132.00. Further the Company is responsible for the cost of technicians, $240.00 and a lighting fee of $50.00.

The Company indicates that the additional performance is one to celebrate "Australia Remembers 1945-1995".

It should be noted that the Company will receive a grant of $3,500 from the Hon Leo McLeay, Member for Watson, to contribute towards the cost of the event.

Although the cause is one that should be applauded by Council, Members must also remember that Council is incurring costs in undertaking other activities to commemorate "Australia Remembers".

In view of the above, the following recommendation is submitted for Council's consideration.

03.25A THE SONS & DAUGHTERS OF ERIN - FREE USE OF MARANA AUDITORIUM (H/00004)

The following letter has been received from Mr F Corrigan representing the Sons & Daughters of Erin regarding a proposal to conduct a concert on Friday, 19th May, 1995.

"I am requesting the use of Council's Marana Auditorium, at no cost, on Friday, 19th May, 1995 to raise funds for "A Current Affair - Farmhand".

The Entertainment Centre Officer advises that the Auditorium is available however Council's normal cost would be $925.00 and Costs + 10% $309.00, not including technicians if such are required.

The Council's policy in respect of matters such as this is reproduced, in part, hereunder:-

"(a) For hire on Friday, Saturday, Sunday or Public Holidays by any organisation, the full hiring charges as fixed by Council from time to time be applied to such usage.

(b) For hiring on days other than Friday, Saturday, Sunday or Public Holidays by charitable, non-profit making local organisations located within the City, and schools within the City of Hurstville and Municipalities of Kogarah and Rockdale, the amount charged be the actual cost to Council for wages and direct costs plus ten (10) per cent."

As can be seen the request falls outside of Council's policy. Further, The Sons & Daughters of Erin is not a registered charity. No indication has been given as to who will be involved in the Concert nor what the entry fee would be.

Members would be aware that Council has already donated $25,000 towards drought relief and has co-ordinated the Hurstville City Drought Appeal which raised considerable funds from the community.

In view of Council's generous donations and that the application falls outside of its policy, the following recommendation is submitted for consideration.

03.27A AUSTRALIAN PROPERTY GROUP - PROPOSED MOOMBA TO SYDNEY ETHANE PIPELINE (G/00034)

Members may recall that in the past the Divisional Manager - Engineering has submitted a report to Council regarding the proposed Moomba to Sydney Ethane Pipeline in which it was indicated that the pipeline was proceeding through parts of Council's area and that the Australian Property Group would be taking steps to acquire easements through Council's area in association with the construction of the pipeline.

Correspondence dated 12th April, 1994 has now been received from the Australian Property Group in regard to this matter forwarding to Council copies of a "Pre-Acquisition Declaration" made under the provisions of the Federal Land Acquisition Act 1989 in relation to the proposed easements required through Council's area for the pipeline.

The Australian Property Group also indicated that a copy of the declaration will be published in the Commonwealth of Australia Gazette in the near future with the purpose of the declaration being to advise the public of the intention to acquire the easements as distinct from the actual acquisition.

The correspondence also advises that Council is able to seek formal reconsideration of the declaration within 28 days, by the Minister for Administrative Services and requests early advice of Council's intentions in this regard.

There are a number of steps involved in this process with the serving of the "Pre-Acquisition Declaration" on Council being the first which would no doubt be followed by gazettal of the acquisition of the easements and the subsequent requirement for Council to submit a claim for compensation for the easements so acquired.

The "Pre-Acquisition Declaration" attached to this correspondence incorporates a schedule of the affected properties over a number of Council areas, five (5) of which affect this Council's area. Four (4) of the five (5) portions of Council's area affected are streets where the easements over 1 or 2 metres wide would be acquired. The streets are Webb Street, Bryant Street, King Georges Road and Morgan Street.

The final part of Council's property affected is not a roadway but is in fact Council's Edgbaston Street Car Park which is Lot 2 in DP533022. In respect of the Edgbaston Street Car Park, the "Pre-Acquisition Declaration" proposes an easement 6 metres wide which would be adjacent to the adjoining railway property boundary.

The matter has been discussed with the Divisional Manager - Engineering who has indicated that he has no objection to the easements which affect Council's roadways, subject to the relevant instrument creating the easements, containing appropriate conditions to Council's satisfaction.

With regard to the easement proposed over Council's Edgbaston Street Car Park, the Divisional Manager - Engineering has suggested that Council should object to this proposal as the width of the easement, namely 6 metres, has the potential to seriously inhibit the possible future use of the site.

Whilst the site is currently used as a car park and could continue to be used as a car park, in the event of the 6 metre wide easement being implemented, serious restrictions would be placed upon the future development of the site such as a commercial building incorporating car parking to replace the car parking already provided, as has occurred in the Hurstville CBD.

Accordingly in view of the above, it is suggested that Council should advise the Australian Property Group that it has no objections to the easements proposed over Council's roadways subject to satisfactory wording of the relevant instrument creating the easements, but Council should lodge an objection in respect of the easement proposed over its Edgbaston Street Car Park.

As the properties in question are referred to within the Schedule attached to the "Pre-Acquisition Declaration" the recommendation to follow will include a reference to such schedule, as distinct to actual property details as Council will be required to comment on the contents of such Schedule.
